RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0400108
AGAINST CLAY AND LAVONDA GATES FOR VIOLATION OF THE WELD COUNTY
CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Clay and Lavonda Gates, VI #0400108, are allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 9th day of November,2004, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, at which
time this matter was continued to December 14, 2004, to allow adequate time for the Department
of Planning Services to notice property owners of hearing date, and
WHEREAS, on the 14th day of December, 2004, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,and
WHEREAS, Clay and Lavonda Gates were not present or represented at said hearing,
although all parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Clay and Lavonda Gates to remedy the violation of the Weld County Code, and
any other persons occupying the properties,any persons claiming an interest in the properties, and
any persons acting in active concert with the identified parties.

RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney for
immediate action.
CASE HISTORY
September 22, 2003 10-day compliance letter issued
September 29, 2003 Phone call from Clay Gates, he is living in Texas following a car accident. The
house is vacant but they may lease it. An inspection was scheduled.
October 2, 2003 Attempted to contact Clay Gates regarding inspections results, phone number
disconnected.
March 29, 2004 10-day compliance letter issued
April 12, 2004 30-day violation letter issued
April 21, 2004 Phone call from Clay Gates. He will speak to the tenant to verify everything is done
and call for inspections. I told him no one should be living in the house until a
certificate of occupancy is issued. He says the house was broken into and the hot
water heater and hot tub were stolen. The original floor plan has been changed.
May 25, 2004 10-day followup letter issued as no inspections were scheduled.

June 11, 2004 Kermit Feser, tenant, was in the office. He is a licensed electrician and will be ready
for an inspection by July 15, 2004.
July 22, 2004 10-day letter to tenant/electrician as no inspections were scheduled.
August 26, 2004 10-day compliance letter issued
September 9, 2004 30-day violation letter issued
October 8, 2004 Inspections were scheduled and then cancelled.
October 27, 2004 Letter indicating the violation case is scheduled before the Board of
County Commissioners, mailed certified and regular mail.
November 10, 2004 Phone call to Kermit Feser, tenant. They have moved out of the house but will
complete the project. He will schedule an inspection for November 19, 2004.
November 16, 2004 Certified letter returned.
