RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A NATURAL GAS PRO- CESSING PLANT EDITH WOELFLE/HUGASCO, INC. WHEREAS , the Board of County Commissioners of Weld County , Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 13th day of July, 1983, at the hour of 2 : 00 o'clock p.m. in the Chambers of the Board for the purpose of hearing the application of Edith Woelfle/HUGASCO, Inc . , c/o Frank Hummel, Jr. , 1530 9th Street, Greeley, Colorado 80631 , for a Use by Special Review for a natural gas processing plant, on the following described real estate, to-wit: Part of the SE4, Section 13 , Township 4 North, Range 68 West of the 6th P .M. , Weld County, Colorado. WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Plan- ning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that: 1 . The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4. 2 of the Weld County Zoning Ordinance as follows : a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on continued agricultural use in the vicinity or County. The proposal does not appear to have any adverse impacts on the agricultural interests of the County or the environment. b. The proposal is consistent with the intent of the Agricultural Zone District; and is provided for as a Use by Special Review. c. No overlay districts affect the subject site. d. It is the opinion of the Board of County Com- missioners that the attached Operation Standards will minimize impacts on surrounding uses and the area to the greatest extent possible, and provide adequate protection for the health, safety, and welfare of the inhabitants of the area and the County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners that the application for a Use by Special Review for a natural gas processing plant on the hereinabove described par- cel of land be, and hereby is, granted subject to the following conditions: 1. The attached Standards for Use by Special Review be adopted. 2 . The applicant shall submit a revised mylar to the De- partment of Planning Services indicating the location of the prescribed tank. 3. The corrected plat for the Use by Special Review Permit shall be placed on record by the Department of Planning Services staff. The permitted use on the said described parcel of land shall be a portable skid mounted natural gas processing (compression) station. 2. The major facilities shall be three (3) pieces of skid mounted equipment (i.e. , gas compressor, refrigeration unit, and a processor) , an eighteen-thousand (18,000) gallon storage tank, a six (6) foot high chain link fence with security barbed wire, a safety drip tank (i.e. , drainage tank) and additional equipment as listed and identified on the plat submitted for record. 3. The permitted use shall comply with Section 24.5 et seq. (Design Standards for Use by Special Review) of the Weld County Zoning Ordinance. 4. The permitted use shall comply with Section 24.6 et seq. (Operation Standards for Uses by Special Review) of the Weld County Zoning Ordinance. 5. Design and construction of the facility shall be in accordance with the submitted application materials, recorded plat and Weld County Building Code Regulations. 6. The appearance of the facility shall be maintained in a neat and orderly condition through periodic painting and maintenance. 7. The Use by Special Review Permit area shall be maintained in such a manner as to prevent soil erosion and fugitive dust. 8. The Use by Special Review Permit shall be limited to the plans shown hereon and governed by the Operation Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Operation Standards, as shown or stated above, shall require the approval of an amendment of the Use by Special Review Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Operation Standards shall be permitted. Any other changes from the plans and/or Operation Standards shall be filed in the office of the Department of Planning Services. 9. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Operation Standards. Noncompliance with any of the above stated Operation Standards may be reason for revocation of the Use by Special Review Permit by the Board of County Commissioners. 10. The applicant produce evidence of liability insurance adequate to cover potential loss to the adjacent properties prior to this case going to the Board of County Commissioners and that evidence of liability insurance be maintained throughout the life of this project. The plant will be located North of the intersection of County Road 13 and County Road 44 Southwest of Johnstown. The plant will process natural gas produced from the present wells located on the Frances Rutt, Edith Woelfle and the Virgil D. Podtburg properties plus other wells to be drilled in the area in the near future. This gas plant (initially 1,000 MCF) is necessary because Panhandle Eastern, the pipeline company which has previously purchased the gas from the wells in the area, has stopped any new "hook-ups" for the next two years. Also, it is understood that they plan to cut back on a number of the present "hook • - ups" to producing wells in the immediate vicinity. We have been fortunate that our affiliate, HUMMEL OIL AND GAS, INC. has ob- tained a gas purchasing contract from Western Slope Gas Company to purchase gas from our wells and others in the area which have been drilled or will be drilled in the near future. Our processing of the gas from said wells will prevent the need for "shut- in" wells which are of no benefit to the mineral owners, the producers or Weld County. -1- Application for Use Special Review Page 2. The plant will be located in a non-congested area with full considera"or being given to the adjoining property owners and other persons frequerti- the area. A full discussion of the plants existence and function has been held all of the property owners in the vicinity. There have been no cbjec-'__: raised by any party to this time. Supporting Statements: a. It is the petitioner's understanding that the proposed use is consistent with the Weld County Comprehensive Plan. b. It is also the petitioner' s unserstanding that the proposed use is consistent with the intent of the district which the USE is located. c . The USES will be compatible with the existing surrcunding land USES. The adjacent properties are agricultural. There will be no interference withe operations thereon including the movement of equipment, water flow or any other function necessary for agre- cultural activity. d. It is the petitioner's understanding that there are no planned changes in the development of the surrounding areas in the for- seeable future. e. The records indicate that the location of the Proposed USE does not lie within any Overlay District Area adopted by Weld County. f. The proposed USE is located in the "A" District. The applicant will operate the plant in order to conserve productive land. The fact is that the site was reduced from 5 acres to 2 acres which will conserve agricultural use. g. Due diligence has been taken for the health, safety and welfare of the inhabitants of the area and the County. The plant site was particularly selected to be away from habitation in order to provide for protection from fire, noise or other. hazards. Proper ingress and egress at the facility has been provided for. Application for Use L special Review Page 4. 5. Description of proposed operation a. The application is for a permit to establish and operate a gas processing (stripping) plant to process natural gas produced from wells in the surrounding area. b. The closest residential structures will be more than 600 feet. c. The plant is planned to operate 24 hours per day. d. There will be one or two operating and/or maintenance personnel involved. There will be no patrons, members or buyers. f. There will be no animals located at the site at any time. g. The plant will include three skid mounted units, the compressor, the refridgeration unit, and the processor. These units will require a total area of 30' x 61' . There will also be an 18,000 gallon storage tank on location. h. A tanker truck will enter and leave the premises once a week. There will be daily entrances and exits of maintenance vehicles, which will be pick-up trucks. These units will enter and leave the premises from County Road #13. i. There will be no requirement for the use of domestic sewage facilities. j. There will be no stockpile or waste areas utilized. The only storage will be a storage tank for processed liquids which will be picked up by truck on a frequent basis. k. There will be no requirement for removal or disposal of debris or junk or other wastes associated with the proposed USE. In the event any debris or junk does accumulate, the petitioner will remove same immediately. H Application for Use by Special Review Page 5. 1. The plant is being constructed at this time and is planned to be in operation sometime within the next two or three weeks m. The plant site has been prepared with the necessary levelling, gravelling and other measures necessary. There will be no re- quirement for "LANDSCAPING" from the esthetic sense. The property will be prepared and maintained in a fashion commensurate with the surrounding area. n. It has been agreed with the "LESSOR" of the property that upon termination of the operation and the Lease, the property will be returned to in as good as or better condition than it was upon commencement of operations. o. There will be no residence or resident personnel on the premises. The plant and attendant equipment is developed to "shut-down" in the event of indicated or anticipated fire hazard. On site, there will be a 150 lb. wheel mounted extinguisher. In addition there will be two 60 lb. wheel mounted extinguisher units,. The said extinguisher will contain and utilize ansul purple K powdered compound. Application for Use by Special Review Page 6. 6. There will be no requirement for an outside water supply. c. The Lease for the premises. d. The equipment placed on the premises will yield less than 75 decibles at a 25 foot distance. This measurement was taken at the manufacturing facility. The actual noise levels at distances further than 25 feet and under operating condi- tions will necessarily be measured after installation. If required, noise inhibitors will be installed to substan- tially reduce any undersirable noise level. e. Soils are Colombo clay loam with 0 to 1% grades. The top soil appears to be approximately 14 inches thick. Soils have been compacted with soil tamping compactors and an 8" gravel road base has been spread and compacted. All equipment, since it is portable skid mounted, has been set on oak 3" x 14" planks to allow the weight to be distri- buted evenly. This soil information was furnished by the USDA Soil and Conservation Service in cooperation with the Colorado Agri- cultural Experiment Station.
