Department of Public COLORADO Health and Environment CASE NO.: PZ-1059 NAME: Applied Films Corporation The Department has reviewed the request to change from Agricultural to Commercial (C-3). There is an existing house on the property that is currently served by Central Weld County Water District and an individual sewage disposal system (G19879028; a Statement of Existing). The existing house is currently used as a residence. The application does not state the intended use of the property after the zone change. The application states that the water service for the property will be Central Weld County Water District and the sewer service will be "St. Vrain Sanitation District, Current Septic Permit". The Department recommends that at the time of further development the existing septic system be properly abandoned and St. Vrain serve the entire property. However, if prior to that development, if the septic system fails and St.Vrain sewer is available, the house may be required to connect to sanitary sewer. Any further development of the site will require a Site Plan Review. Any commercial/industrial development must comply with all applicable Weld County Department of Public Health and Environment, Colorado Department of Public Health and Environment, EPA and/or Oil and Gas regulations. The applicant/developer must contact the appropriate agency for more information regarding the site-specific requirements of each development. The Department recommends approval of this application with the following conditions: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. Fugitive dust shall be controlled on this site. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in 25-12-103 C.R.S., as amended. 6. All septic systems located on the property shall be properly abandoned in accordance with Section 30-4-20(D)of the Weld County Code. May T 24, 2004ne tch, Planner COLORADO FROM: Kim Ogle, Planning Manage* i SUBJECT: Applied Films Corporation, PZ-1059 Change of Zone for a One Lot Commercial PUD Landscape Referral The Department of Planning Services has reviewed the submitted Sketch Plan Map for the Applied Films Corporation and offers the following comments. Per the application materials, the applicant is proposing a one parcel PUD within the Mixed Use Development overlay zone. The property is surrounded by the Town of Frederick to the North, East and South. The proposed PUD is located on Lot A of Recorded Exemption RE-1009, being part of the west one-half of the Northwest one-quarter of Section 14, Township 2 North, Range 68 West of the 6th Prime Meridian, Weld County. The total site area is approximately 5.3 acres, of which no area has been delineated as open space. The Sketch Plan application submitted provided minimal detail specific to any proposed on-site use, aside from the request for a Change of Zone from Agricultural to Business Commercial, (C-3). There is discussion, via a letter from John Zadel of Central Weld County Water District concerning the availability of water to the site, however, the current tap appears to be for household use only. Prior to submitting the Change of Zone application a tap agreement reviewed by the County Attorney shall be submitted, reviewed and approved prior to acceptance of any application by this office. From the application documents, the critieria has not been met. It is strongly suggested that an agreement be drawn up which outlines the available options and provides evidence that the issue of water has been addressed. A "Will Serve" letter is not adequate per the County Code. There is discussion via a letter from Steve Beck, District Manager for St. Vrain Valley Sanitation District concerning the availability of sanitary sewer to the site. Prior to submitting the Change of Zone application a tap agreement reviewed by the County Attorney shall be submitted, reviewed and approved prior to acceptance of any application by this office. There was not an agreement provided, further, the area to be serviced is not within the District 208 Boundary of St. Vrain. The applicant shall provide evidence of inclusion of this property into the District 208 Boundary of St. Vrain Sanitation In the application materials, the applicant has not provided a verbal description of the Landscape proposal for the PUD. There was not a graphic Landscape Plan submitted with the referral. The application materials did not graphically address the location and type of sign for the proposed development. Both the sketch plan and the Change of Zone application have not identified an internal trail system for the development. Should one be proposed, the trail and all amenities shall be described and delineated. Future correspondence shall identify the trail location and type of material utilized in trail construction. There has been no discussion concerning mail box locations, internal lighting, connectivity, etcetera. Future correspondence shall describe and delineate on the plans this information. Comments during the Sketch Plan application stated given the vagueness of the on-site landscape treatment proposed by the applicant, the Department of Planning Services recommends that a Preliminary Landscape Plan be submitted for review with the Change of Zone application. No information was provided. Given that this parcel is within the MUD, with strict design standards, it is strongly suggested that the applicant submit a preliminary sketch identifying a conceptual landscape treatment by area, including evidence that a building is able to be placed on the property given this criteria.
