USR Questionnaire
1) The main use for this property is transloading agricultural materials from truck to rail
and vice-versa. The property is 8.5+ acres and has on it a scale house, silos, and a
spur to the Great Western Railroad. The property has historically been used for
agricultural purposes and over the last ten the years the property has been used for
exporting grains and beans and importing fertilizers and petroleum products as
permitted under USR-935. BritTara Land Company is requesting an addendum to
USR-935 to include landscape materials as a permitted product for transloading.
The material to be added to the list of allowable products to be transloaded will
include mulch, sand, gravel, timbers, and products associated to the landscaping
industry. The short term use for this site is to move mulch materials primarily with
the site being a distribution hub for Pioneer Sand and Gravel. There is the intent of
providing retail services and distributing small volumes as the site develops and the
septic system and offices are constructed.
2) The Weld County Comprehensive Plan fundamentally supports the agricultural
community and has set out to preserve the agricultural way of life. It allows for
progress to occur without detriment to farming and ranching. This request for an
amended use by special review is completely in-line with the Weld County
Comprehensive Plan as the property owner has developed an opportunity to service
maintain an agricultural supply depot and requests that the service capacity be
expanded to provide commercial services to surrounding developments.
3) The agricultural zoning of this property allows for commercial operations to occur
with an approved Use by Special Review application. There is no request to change
the zoning, therefore, consistent with Chapter 23 of the Weld County Code, Article
III.
4) The surrounding area consists of residents with acreage. The surrounding land uses
are farming of grain and hay. The landscape material operations shall not impact any
of the land uses on the property that have not already been approved through USR
935. The surrounding lands owners who have recently relocated to this area should
have been made aware of the use of this property and the residents who have been
living in this area since the 1980's have lived with this rail site in their back yard for
over 10 years. This is not a new facility or even an expansion of an existing one; but
rather a request for the amendment of USR Q35 to include landscape materials as a
permitted product to operate.
5) Details
a) The retail side of the operation is anticipated to generate 20-30 customers per day.
b) There are plans to have three to five personnel.
c) The hours of operation of the shop are dawn to dusk during the winter months;
however, normal hours of operation during the summer shall be between 6:30 am
to 7:30 pm.
d) The operators shall utilize the existing structures on the property and plan to
construct a store with offices for retail sales in the future.
e) There will not be any animals on the site.
f) The typical vehicle to access this site will be 18 wheelers (85,000 gvw), 10 wheel
trucks(52,000 gvw), and pick up trucks. The traffic volume is anticipated to be
significantly less than what has been approved under USR 935, and is estimated
to be on average 15 trucks per day.
g) Fire protection for this operation shall be provided by the Mead Fire Protection
District.
h) The water source for this property is a tap from the Little Thompson Water
District. The tap shall provide service to the scale house and fire hydrant.
i) The sewage disposal system will be an I.S.D.S. that shall approved by the county.
The system shall be designed to provide treatment for the retail operation as well
as the employee based use.
j) There are areas designated as storage for the landscape products. These products
shall include bark, mulch, soils, rock, boulders, building stone, railroad ties,
timbers, etc.
6) The landscaping for this site is limited and shall be delineated as requested from the
County.
7) There will not be a need for reclamation as that there is not any significant impact to
the land or the farm caused by these operations. The operation is contained within the
property and should the business cease to exist, the stockpiles would be sold and
other assets would be demobilized. Any disturbed areas shall be reseeded if the
operation ceases to exist.
8) There is no change to the storm drainage system caused by this operation as there is
no increase in the total impervious area of the property. The drainage flows and
surface runoff patterns shall remain as they have historically; to a ditch along the
Great Western Rail line. As development of the retail facilities occurs, the drainage
impacts associated to the development shall be designed.
9) There is no construction necessary for this operation initially. The site would only
need to be regraded for the construction of the retail facilities. The landscaping is
limited at this time and shall be improved during the operations occur. It should be
noted this site has been approved for this type of operation through USR 935 and has
operated under the adopted development agreement. This is not a new facility and
site improvements to the property should be a function of site development and not
through a product list expansion.
10)The waste products from this site shall be stored in dumpsters, recycle containers, and
an area designated on the Site Plan. Waste materials will that associated with office
supplies, lunches, and paper products.

BritTara Land Company this week submitted a USR change request on our Mead
Transfer Rail Terminal located at 5351 WCR 38 E, known legally as Lot A of RE no.
1060-36-3-RE 1331 being part of E1/2 SW 1/4 36-4N-68W.
We formally request a Pre-Advertisement on this project in hopes of consolidating the
time line on this process. Reasons are as follows:
A) We currently have a customer via lease agreement that is ready to operate a
landscape materials transload on site. Time is of the essence for the validity
of this deal.
B) We have tried the administrative (minor) change and were instructed to take
this route instead.
C) The nature of the product and business coming through our site is seasonal
and we do not want to lose any additional business. Economic impacts are
numerous as the customer will be distributing to several retail sites in the
region.
D) Our products (mulch & decorative rocks) are non-invasive and not a harm to
the immediate environment.
E) The Great Western Railway is ready to operate and deliver immediately.
