The applicant has complied with Section 21 . 7 et. seq. of the Weld County Zoning Ordinance regarding the applica- tion requirements for a Change of Zone. Co ir! 2. The request is in conformance with Section 21 . 5 of the Weld County Zoning Ordinance as follows: a) It is the opinion of the Weld County Board of County Commissioners that the proposed zone change is con- sistent with the Weld County Comprehensive Plan and the proposed Industrial District will be compatible with the existing surrounding land uses and future development. The subject site is located in the City of Ft. Lupton' s General Plan for future land use. The Ft. Lupton Planning Commission is recom- mending approval of this request and supports this subject neighborhood as a future industrial growth location. b) Weld County Road 181/2 will provide adequate access to the site. e) The proposed Change of Zone is not located within any overlay district. d) The proposed rezoning would not interfere with extrac- tion of any known commercial mineral deposits . Q) Soil conditions do not present limitations to the construction of the structure on the site. f) The subject site will have an adequate sewage system. g) The subject site will have an adequate water source. Page 3 RE: COZ - CODE WELDERS NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- o missioners of Weld County, Colorado that the application of Code Welders, for a Change of Zone from A (Agricultural District) to I-3 (Industrial District) on the above referenced parcel of land ' ,z be, and hereby is granted subject to the following conditions: 1 . The owner/operator shall submit to the Department of Planning Services evidence of an adequate water supply OD c source prior to the issuance of any building permits on the subject site. 2 . The owner/operator shall submit to the Department of Planning Services evidence of an adequate sewage system prior to the issuance of any building permits on the _ subject site. 3 . The owner/operator shall not build any structure closer than fifty (50) feet from the center of the Platteville Milling & Irrigation Co. Ditch. (It should be noted that the proposed structure on the submitted Change of Zone plat is greater than sixty (60) feet from the sub- ject ditch at nearest point. ) 4 . Weld County Road 181 shall be the only point of ingress and egress to the subject site. 5. The Change of Zone plat should reflect the roadway right- of-way in the northwest part of the property granted to the Continental Pipeline Company for an improved turning radius. The Planning Commission recommended that this request be approved with conditions. Burl Van Buskirk represented the applicants. He discussed the location, -adjacent properties, and stated that it is not a good property to farm because wat-er must be piped in for irrigation. He stated that they plan to_register the domestic water well for _domestic purposes and install the septic system. This property is located in -the Fort Lupton Fire Protection District. Sam Sims, part owner of Code Welders, stated that-they will not have any flam- mable materials on the site except for a gas tank. The _gasoline stored in the gas tank will be used to fill their vehicles and it will not be used in the welding operation. Fred Thompson, adjacent landowner, stated that he is in favor of this Change of Zane and agreed that the easement along the ditch was adequate. After discussion, Commissioner N. Carlson moved to grant this Change of Zone request and included the conditions as specified by the Planning Commission. Commissioner Brantner seconded the motion and it carried unanimously. Historically we have been able to burn the weeds and maintain the ditch with no obstruction on wither side of the ditch. An existing domestic well is indicated to be the source of water. We have reviewed our records and have not found any registered wells at this location. No information is given regarding the applicant 's water requirements and no specifics are provided concerning the existing well. Before we could recom- mend approval of a proposal to use the existing well, it would be necessary for the owner to late register the well with our Ground Water Section. With the late registration and an analysis of water requirements for the proposed new use of the well, we should be able to determine whether the proposed use could be permitted as exempt pursuant to CRS 1973, 37-92-602. If the uses could be allowed as exempt, then a new permit could be issued for the proposed use. If the pro- posed uses could not be allowed as exempt, then it may be possible to allow a well in the deeper Laramie-Fox Hills formation. We have not conducted a thorough review of this proposal since no significant information was provided. We cannot recommend approval of this proposal since we have not been provided an adequate water supply plan. If the existing well remains the intended source of water, then, as we previously stated, the applicant should contact our Ground Water Section and apply for late registration. At the same time, the applicant should discuss the procedures for submitting a well permit application for the proposed new use.
