WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
ea Rule Charter, is vested with the authority of administering the

WHEREAS, a public hearing was held on the 16th day of Feb-
ruary, 1983 , at the hour of 2 : 00 o ' clock p.m. for the purpose
of hearing the application of Code Welders, c/o Burl Van Buskirk,
77. 140 Denver Avenue, Ft. Lupton, Colorado 80621 , requesting a
Change of Zone from A (Agricultural District) to I-3 (Industrial
District) for the following described parcel of land, to-wit:

WHEREAS, Section 21 . 6. 2 of the Weld County Zoning Ordinance
provides standards for review of such a Change of Zone, and
— WHEREAS, the Board of County Commissioners heard all the
_ testimony and statements of those present, has studied the re-
quest of the applicant and the recommendations of the Weld County
cqE Planning Commission, and having been fully informed finds as

1 . The applicant has complied with Section 21 . 7 et. seq. of
the Weld County Zoning Ordinance regarding the applica-
tion requirements for a Change of Zone.
Co ir! 2. The request is in conformance with Section 21 . 5 of the
Weld County Zoning Ordinance as follows:
a) It is the opinion of the Weld County Board of County
Commissioners that the proposed zone change is con-
sistent with the Weld County Comprehensive Plan and
the proposed Industrial District will be compatible
with the existing surrounding land uses and future
development. The subject site is located in the
City of Ft. Lupton' s General Plan for future land
use. The Ft. Lupton Planning Commission is recom-
mending approval of this request and supports this
subject neighborhood as a future industrial growth
location.
b) Weld County Road 181/2 will provide adequate access
to the site.
e) The proposed Change of Zone is not located within
any overlay district.
d) The proposed rezoning would not interfere with extrac-
tion of any known commercial mineral deposits .
Q) Soil conditions do not present limitations to the
construction of the structure on the site.
f) The subject site will have an adequate sewage system.
g) The subject site will have an adequate water source.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-

missioners of Weld County, Colorado that the application of Code
Welders, for a Change of Zone from A (Agricultural District) to
I-3 (Industrial District) on the above referenced parcel of land
' ,z be, and hereby is granted subject to the following conditions:
1 . The owner/operator shall submit to the Department of
Planning Services evidence of an adequate water supply
OD c source prior to the issuance of any building permits on
the subject site.
2 . The owner/operator shall submit to the Department of
Planning Services evidence of an adequate sewage system
prior to the issuance of any building permits on the
_ subject site.
3 . The owner/operator shall not build any structure closer
than fifty (50) feet from the center of the Platteville
Milling & Irrigation Co. Ditch. (It should be noted
that the proposed structure on the submitted Change of
Zone plat is greater than sixty (60) feet from the sub-
ject ditch at nearest point. )
4 . Weld County Road 181 shall be the only point of ingress
and egress to the subject site.
5. The Change of Zone plat should reflect the roadway right-
of-way in the northwest part of the property granted to
the Continental Pipeline Company for an improved turning
radius.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 16th day of

The following business was transacted:
I hereby certify that pursuant to a notice dated on January 10, 1983, _duly
published January 13, 1983 and February 3, 1983 in the LaSalle_Leader, a
public hearing was held an the request of Code Welders for a Change of Zone,
from A (Agricultural District) to I-3 (Industrial District) . The Planning
Commission recommended that this request be approved with conditions. Burl
Van Buskirk represented the applicants. He discussed the location, -adjacent
properties, and stated that it is not a good property to farm because wat-er
must be piped in for irrigation. He stated that they plan to_register the
domestic water well for _domestic purposes and install the septic system.
This property is located in -the Fort Lupton Fire Protection District.
Sam Sims, part owner of Code Welders, stated that-they will not have any flam-
mable materials on the site except for a gas tank. The _gasoline stored
in the gas tank will be used to fill their vehicles and it will not be used
in the welding operation. Fred Thompson, adjacent landowner, stated that
he is in favor of this Change of Zane and agreed that the easement along the
ditch was adequate. After discussion, Commissioner N. Carlson moved to grant
this Change of Zone request and included the conditions as specified by the
Planning Commission. Commissioner Brantner seconded the motion and it carried
unanimously.

2. The request is in conformance with Section 21.5 of the Weld County Zoning
Ordinance as follows:
It is the opinion of the Department of Planning Services staff
that the proposed zone change is consistent with the Weld County
Comprehensive Plan and the proposed Industrial District will be
compatible with the existing surrounding land uses and future
development. The subject site is located in the City of Ft. Lupton
General Plan for future land use. The Ft. Lupton Planning Commission
is recommending approval of this request and supports this subject
neighborhood as -a future industrial growth location.
- Weld County Road 18-1/2 will provide adequate access to the site.
- The proposed change of zone is not located within any overlay district.
- The proposed rezoning would not interfer with extraction of any
known commercial mineral deposits.
- Soil conditions do not present limitations to the construction of
the structure on the site.
- The subject site will have an adequate sewage system.
- The subject site will have an adequate water source.
These determinations are based, in part, upon a review of the information submitted
by the applicant, other relevant information regarding this request and responses of
referral entities which have reviewed the request.
The Department of Planning Services staff recommendation for approval is conditional
and based upon the following:
The owner/operator shall submit to the Department of Planning
Services evidence of an adequate water supply source prior to
the issuance of any building permits on the subject site.
- The owner/operator shall submit to the Department of Planning
Services evidence of an adequate sewage system prior to the
issuance of any building permits on the subject site.
- The owner/operator shall not build any structure closer than
fifty (50) feet from the center of the Platteville Milling &
Irrigation Co. Ditch. (It should be noted that the proposed
structure on the submitted change of zone plat is greater than
sixty (60) feet from the subject ditch at nearest point.)
- Weld County Road 18-1/2 shall be the only point of ingress and
egress to the subject site.
- The change of zone plat should reflect the roadway right-of-way
in the northwest part of the property granted to the Continental
Pipeline Company for an improved turning radius.

8. The rezoning of this property is consistent with the City of Fort Lupton' s
Growth and Ground Use Plan and is consistent with the Weld County
Comprehensive Plan. It is recognized that much of the ground north of
Fort Lupton should be industrial used ground.
9. This ground is located between the railroad track on the east and four
lane highway on the west. County Road #18z is on the north. Across the
county road north is the Conoco loading station with much truck traffic.
The industrial use of this _ground would not affect any of the adjoining

Code Welders are purchasing a 10 acre tract about 2 miles north of Fort Lupton.
This is a request to rezone the property from Agriculture to Industrial 3. The
property lies in the NZSWy, Section 20, T20N, R66W and lies just south of Weld
County Road #181 between the four lane Highway 85 and the Railroad. The property
to the north is an industrial use (Conoco Loading Station) and the property to
the south is an agricultural 10-12 acre tract who also wishes to be zoned
industrial. The other surrounding property is zoned agricultural.
I have already talked with the Planning Commission of Fort Lupton and they seem
to have no objection, however, no formal action will be taken until they get the
package from the County.

We have reviewed the Code Welders application for a zone change, and we
have the following comments.
1 . The "Proposed Zoning Map" may need to be revised at the intersection of
U.S. Highway 85 and Weld County Road 184. A portion of the northwest
corner of this property was granted as a "Roadway Right of Way" by the
property owner to Continental Pipeline Company to allow for an improved
turning radius. The zoning map should note this recent right-of-way
change.
2. We note in the application that access to this property would be obtained
from County Road 184. We support this proposed means of access, and
we point out that direct access to the highway cannot be permitted,
since U.S. 85 is an access-controlled highway.

In reference to a letter pertaining to a zoning change in the
Nyz SW) Sec. 20 T 2 N R66W, the Platteville Milling & Irrigat—
ing Company wishes to place an record an objection to a change
from Agricultural to Industrial use for all land 50 feet on
either side of the center line of the ditch right-of-way for an
irrigation canal through this portion of land.
Historically we have been able to burn the weeds and maintain
the ditch with no obstruction on wither side of the ditch. Any
construction within 50 feet of the center of the ditch would
prevent us from maintaining our ditch properly.

Dear Mr. Allison:
We have received the above referenced proposal to rezone 10.37 acres from
agricultural to industrial. An existing domestic well is indicated to be the
source of water. We have reviewed our records and have not found any registered
wells at this location.
No information is given regarding the applicant 's water requirements and
no specifics are provided concerning the existing well. Before we could recom-
mend approval of a proposal to use the existing well, it would be necessary for
the owner to late register the well with our Ground Water Section. With the
late registration and an analysis of water requirements for the proposed new use
of the well, we should be able to determine whether the proposed use could be
permitted as exempt pursuant to CRS 1973, 37-92-602. If the uses could be allowed
as exempt, then a new permit could be issued for the proposed use. If the pro-
posed uses could not be allowed as exempt, then it may be possible to allow a well
in the deeper Laramie-Fox Hills formation. We have not conducted a thorough review
of this proposal since no significant information was provided.
We cannot recommend approval of this proposal since we have not been provided
an adequate water supply plan. If the existing well remains the intended source of
water, then, as we previously stated, the applicant should contact our Ground Water
Section and apply for late registration. At the same time, the applicant should
discuss the procedures for submitting a well permit application for the proposed
new use.
