The Proposed Use of the Property: Duke currently operates an oil and gas processing facility on the property. The equipment includes compressors associated with gas processing and other equipment to allow gas produced in Weld County to be transported to market and sold. 2. Consistency with Weld Comprehensive Plan: The proposed use is consistent with the Comprehensive Plan because it seeks to use the land to foster the development of the vast natural resources in Weld County. Moreover, given the property's size together with the absence of any water rights attached to the property,it is impractical to use this property for farming. 3. Consistency with the Intent of the Weld County Zoning Ordinance and the zone district: The proposed use is consistent with the intent of the Agricultural Zone District, as it will foster the development of oil and natural gas resources, and Section 31.2 of the Weld County Ordinance provides that Oil and Gas Production Facilities are allowed as a matter of right in the Agricultural Zone District. Further, it will not interfere with any agricultural operations. 4. Surrounding Uses: The site is surrounded by agriculture uses. 5. Details regarding Use: a. How many people will use the site? Duke is working on a detailed list of the equipment shown on the enclosed map, and will provide that to you. Also, we have asked for an extension on the January hearing for the Greeley Frac Facility. The reason for this request is that the City of Evans contacted me in late November,and after discussing the matter with them,we decided we should have a meeting. CO 80202 303 595 3331 November 10, 2003 Weld County Building Defeat talent 1555 North 17th Ave. Greeley, CO 80631 A.ttn- Kim Ogle Dear Kim: Colorado Interstate Gas Company (CIG)has notified Duke Energy Field Service(DEFS) that gas from its Mewbourn processing plant is slightly out of compliance with CIO's tariff specification for carbon dioxide. DEFS must comply with CIG's request to bring the gas into compliance as soon as possible or it risks having over 50 MMcf/d of gas shut in. This problem can be corrected through the installation of relatively simple separation equipment and will be done without adding any new emission sources. DEFS requests Weld County's approval as soon as possible so that it may start construction on this project and keep gas flowing without interruption.
