Union Pacific Railroad Company—Abandonment Exemption—in Weld County, CO.
To Whom It May Concern:
The 1997 General Assembly passed legislation dealing with the disposition of rail lines. Under this
legislation, the Executive Director of the Colorado Depai tu,ent of Transportation "shall within thirty
days after receipt of such notice, inform all Departments of the State of Colorado,the metropolitan or
regional transportation authorities, and cities, counties and towns where the property thereof is located of
the owner's intention to dispose of the rail line or right-of-way."
The purpose of this letter is to notify your agency that the Union Pacific Railroad Company (UP), has
filed with the Surface Transportation Board(STB) a Notice of Exemption seeking authority to abandon a
line segment consisting of 1.12 mile portion of its Monfort Industrial Lead rail line located between
milepost 141.12 and milepost 140.00 near Kersey, Colorado in Weld County, Colorado. The line
traverses United States Postal Service Zip Code 80644 and includes no stations. Upon receipt of
abandonment of rail service and salvage, the line may be suitable for other public use, including interim
trail use. Any request for a public use condition will be due no later than July 22, 2004. Each trail use
request must be accompanied by a$200 filing fee. See CFR 1002.2(0(27).
All filings in response to this notice must refer to STB Docket No. AB-33 (Sub-No.216X) and must be
sent to:
(1) The Surface Transportation Board, 1925 K Street,N.W., Washington,D.C. 20423-0001 and
(2) Mack H. Shumate, Jr., 101 North Wacker Drive, Room 1920, Chicago, IL 60606.
Replies to the UP petition are due on or before July 22, 2004.
