by Special Review Permit.

SITE SPECIFIC DEVELOPMENT PLAN AND
USE BY SPECIAL REVIEW (USR) QUESTIONNAIRE
David and Darlene Rothrock
1. Explain, in detail, the proposed use of the property.
The parcel under consideration for the Use by Special Review application is Lot B of Recorded
Exemption , RE-3635. This 107+acre parcel is part of the greater 1,706-acre property known as the
David J. Rothrock, dba 2dr Cattle Company (Ranch). Mr. and Mrs. Rothrock need to keep two
Dwelling Units on Lot B of Recorded Exemption,RE-3635. The second dwelling unit is necessary
to the Ranch operations and shall be occupied by family or persons necessary to Ranch operations.
In no event shall this modular structure become a rental unit. This dwelling unit was issued Building
Permit #PR9730045 in 1997. The current resident of the Modular Home is also afamily member
and is further currently involved with various Ranch operations as a book-keeper and care-taker.
The Use by Special Review permit is the method provided by the Department of Planning Services
to accomplish this desire. This application is for a single-family dwelling unit other than what is
permitted by Section 23-3-20 in the Agricultural Zone District.
2. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22
(Comprehensive Plan).
• The applicants believe they have been good stewards of their property and have a strong
desire to be responsible stewards. A. Policy 10.1 supports property owners who have
demonstrated responsibility of ownership by minimizing safety and health hazards.
• This application is the result of a potential violation. Therefore the principle statement in
Section 22-1-50.C.e has been upheld. The Weld County Planning Services has evaluated
the objectives of the applicant and the options available to the applicant while ensuring
the health, safety and welfare of County residents.
• The property is not located within an Overlay District or within an Intergovernmental
Agreement or standard Urban Growth Boundary.
• The property shall remain free of unsightly materials, including but not limited to, derelict
vehicles, refuse and litter. (A.Goal 10).
• A.Goal 6 and R. Goal I both stipulate that public facilities and services are currently
available to serve the desired use. The property is served by septic for sanitary sewer
(one for each residential structure), a well for domestic water (one for each residential
structure) and an existing access from State Highway 52. As this proposal is not for new
residential structures, the impact to the School District does not exist.
• The Right to Farm Statement shall be observed.
• Conditions of Approval and Development Standards shall be adhered to, minimizing
negative impacts.

3. Explain how this proposal is consistent with the intent of the Weld County Code,Chapter 23
(Zoning) and the zone district in which it is located.
• The site is not in an Overlay District, verified by documentation supported by and/or created by the
Department of Planning Services.
• The property is within the Agriculture(A)Zone District. A second Single Family Dwelling Unit for
the operation of the David J. Rothrock Cattle Company is needed. The Department of Planning
Services has provided the applicants with the opportunity to apply for Use by Special Review in the
Agricultural (A) Zone District to accomplish this goal.
• This application has been filed in accordance with Article 2, Division 4, Chapter 23 of the Weld
County Code, starting with Section 23-2-200.
• The plans submitted with this application detail circulation, lot configuration, setbacks, and
structures on site.
• Conditions of Approval and Development Standards ensure the development upholds the purpose
and intent of the Weld County Code, Chapter 23 as listed in Section 23-1-40.
• A noise report, as stipulated in Section 23-2-260.E.A is not applicable. Based upon the proposed
uses, the applicants believe the proposed uses will not necessitate such report and are thereby
requesting a waiver from this requirement.
4. What type of uses surround the site? Explain how the proposed use is consistent and
compatible with surrounding land uses.
Surrounding land uses include agricultural and rural residential activities. The applicants believe
they have been good stewards of their property and have a strong desire to be responsible
stewards. A. Policy 10.1 supports property owners who have demonstrated responsibility of
ownership by minimizing safety and health hazards. The use of the property will not be changing
as a result of this Use by Special Review application.
5. Describe, in detail, the following:
a. How many people will use this site? Two people currently live in the Principle Residence
on site. These two individuals are immediate family and are principally engaged in Ranch
operations. Of these two individuals one is employed full time in the Ranch operations. One
person currently resides in the Modular on site. This individual is also immediate family and
is currently engaged in Ranch operations, as requested. These persons are directly involved
in, and necessary to the Ranch operations.
b. How many employees are proposed to be employed at this site? There are currently two
employees who are employed on site. On a seasonal basis, additional employees may
increase according with demand.
c. What are the hours of operation? Use of the residence is consistent with any other
residential structure typical for farming and ranching operations.

d. What type and how many structures will be erected(built)on this site? Two Residential
Structures and Agricultural Buildings exist on site. Additional agricultural structures such as
fences, barns, etc. will be permitted if necessary through Weld County.
e. What type and how many animals, if any, will be on this site? Animal units shall not
exceed what is permitted by right as outlined in the Weld County Code for the Agricultural
(A)zone district. The following animals currently exist on this parcel: 30 Fowl (Chickens,
Ducks, Guinnea, Peacocks), 30 Cattle, 30 Buffalo and 4 dogs.
f. What kind (type, size, weight) of vehicles will access this site and how often?
Trucks and tractors as necessary to the Ranch operations.
g. Who will provide fire protection to the site? Hudson Fire Protection District
h. What is the water source on the property? Well Permit #36075F (Modular) and Well
Permit#35250-F (Principle) are attached.
i. What is the sewage disposal system on the property? Septic Permit #G-900133
(Modular) and SE-0300076 (Principle) are attached.
j. If storage or warehousing is proposed, what type of items will be stored?
Typical agricultural equipment and products shall be stored on site.
6. Explain the proposed landscaping for the site. The landscaping shall be separately submitted

as a landscape plan map as part of the application submittal.
The site location and nature of this application do not necessitate a landscaping or screening plan.
7. Explain any proposed reclamation procedures when termination of the Use by Special Review
activity occurs.
Reclamation procedures are not applicable to this application.
S. Explain how the storm water drainage will be handled on the site.
Historic drainage patterns will not be changed as a result of this application as the structures are
existing.
9. Explain how long it will take to construct this site and when construction and landscaping is
scheduled to begin.
Upon acceptance of this application, and the recording of this Use by Special Review plat, the site
will be in compliance with the Weld County Code. The second Residential Unit is on site.
10. Explain where storage and/or stockpile of wastes will occur on this site.
Garbage collection is currently contracted with Waste Management. The Ranch maintains a
dumpster on adjacent property. This dumpster is emptied every two weeks.
