To whom it may concern:
After extensive research on mineral owners and lessees or mineral
owners on or under the parcel of land being considered we fmally
talked to a mineral rights attorney, Robert Messana for advice on
affidavits and certified lists of mineral owners. He stated that this
law was designed for developers and commercial development. In
his opinion, C.R.S. 24-65.5 101-104 does not apply to private
residence's that are not making changes to the property. i.e.
adding buildings or subdividing the property. It is also cost
prohibitive to private individuals, involving several thousand
dollars in search fees. We feel this is not applicable to our private
residence or to this review.
