There are still a few things that need to be completed. The line is in and I believe has been tested and passed. However, the vaults are not complete and if flow was coming through, it would be exposed since the tops have not been completed. Our main concern is getting the money. Hall-Irwin has been calling us about payment and we have immediately submitted all bills as soon as they were received. We have yet to receive any remittance from the grant money and are definitely in violation of the contract payment clauses. We need some $$ really quick or else the District will have to foot the bill if the dairy does not come up with the cash PDQ and the board is definitely not going to like that. Likewise, because of the way this has turned out, they -the board -will be extremely skeptical if any other entity ever wants to use such a grant. We have talked to Jean Daviet and she has said that someone in the state has been sitting on the original invoice and that it looks to be another 2 weeks before it might get paid and that is the reason she has not submitted the second invoice because she does not want to confuse the state. Any help you can provide in expediting this will really be appreciated. As to when the flow will start, I am not sure because the dairy has to get their pretreatment plant working good first. I think they are about there so it could be soon. I hope that this answers your questions. Please let me know if you need anything else. The Department of Planning Services has determined that the proposed use as a milk-processing facility is a major change to the approved Special Review Plan Map and Development Standards of USR-1405. Therefore an amended Special Review Permit application will need to be submitted for review and approval. Section 23-2-280 of the Weld County Code states: "Major changes from the approved Special Review Plan Map or Development Standards for the Special Review Permit shall require the review of the an amendment to the permit by the Planning Commission and approval by the Board of County Commissioners before such changes from the plan map or Development Standards are permitted." Your letter outlines a fundamental change in the use of the facility versus simply a change in the scale of the use. The original USR-1405 application states: "The proposed use of the property is for a dairy operation for the production of milk. The use of the property will include associated activities for dairy production, feeding and care of livestock, receiving and processing of feed(s), and shipping of the product off-site." The application does not indicate that milk processing will be occurring on site. In addition, the preliminary site layout that was submitted with the application materials and reviewed by referral agencies along with Weld County staff, Planning Commissioners and County Commissioners indicated a "milk parlor" instead of a "milk processing parlor". Furthermore, it is our understanding that cows will not be located permanently at the site. As a result, the proposed changes to this operation were not reviewed by outside referral agencies, county referral agencies, the Planning Commission and the Board of County Commissioners. Their review and recommendations (along with proposed development standards) were based on the original application materials. These agencies, appointed and elected bodies should be given another opportunity to review this proposal. If approved, it is likely that many of the Development Standards will need to be amended along with the special review plan map. • • You are provided the opportunity to appeal this administrative decision of the Department of Planning Services to the Board of Adjustment under Section 23-6-20 of the Weld County Code. It is our opinion that the intensity of the use of the milk processing facility alone will be equal to or less of an impact than the originally planned dairy pens, shelters and other structures and related animal husbandry activities. While the milk processing facility will have truck traffic and employees at levels similar to USR 1405, the fact that the dairy pens and buildings will not be built and associated cleaning, moving, feeding and maintenance operations conducted should lessen impacts considerably. The activities internal and external to the site should be less than the operation of the milk processing facility. Finally, the conditions that may be typical of an animal husbandry operation such as flies, odor and dust from the animal confinement areas will not occur. Listed below are the specific information requested by your department. Truck traffic will be approximately 28 trucks per week and transportation patterns and access will remain the same as planned in USR 1405. The first shift will utilize 20 employees per day; the second shift 10 employees per day. We do not expect the amount or types of proposed users to change significantly. Users will continue to consist of salesmen, vendors, and visitors to the site. We estimate one or two users per day to consist of inspectors, salesmen or visitors.
