RE: APPROVE CONTINUANCE OF HEARING FOR CHANGE OF ZONE - ORVILLE
W. AND BILLIE JEAN SMITH
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , a hearing for a Change of Zone, from R-5 (Mobile
Home Park) and A (Agricultural) to C-4 (Commercial Four) requested
by Orville W. and Billie Jean Smith was scheduled for June 6 ,
1984 , and
WHEREAS , at the hearing of June 6 , 1984 , the applicant re-
quested that certain property included in the original request
for Change of Zone be excluded, and
WHEREAS , after consideration, the Board deems it advisable
to continue this matter to June 20 , 1984 , at 2 : 00 p.m. to allow
the applicant time to submit a revised mylar showing the property
he wishes to have rezoned.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the Change of Zone
hearing requested by Orville W. and Billie Jean Smith be, and
hereby is, continued to June 20 , 1984 , at 2 :00 p.m.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 6th day of
June, A.D. , 1984 .

FE: CHANGE OF ZONE, R-5 AND A TO C-4, ORVTTJ F W. AND BILLIE JEAN SMITH
A public hearing was conducted on June 6 , 1984, at 2:00 P.M. , with
the following present:
Commissioner Norman Carlson, Chairman
Commissioner Jacqueline Johnson, Pro-Tem
Commissioner Gene Brantner
Commissioner Chuck Carlson
Commissioner John Martin
Also present:
Acting Clerk to the Board, Mary Reiff
Assistant County Attorney, Lee D. Morrison
Planning Department Representative, James Mayerl
The following business was transacted:
I hereby certify that pursuant to a notice dated April 18, 1984, and duly pub-
lished in the La Salle reader on April 19, 1984, and May 10, 1984, a public hear-
ing was conducted to consider the application of Orville W. and Billie Jean
Smith for a Change of Zone from R-5 and A to C-4. Lee Morrison, Assistant County
Attorney, read this application into the record. Jim Mayerl, Planning Department
representative, read the favorable ree wumendation of the Planning Commission into
the record. Mr. Smith came forward and said it had been called to his attention
that the area proposed for a Change of Zone takes in sane of the existing mobile
have lots and requested that a 50' by 400' area shown on the plat be exempted
from the Commercial Zoning, rezoning an area only 100' wide, rather than 150'
wide, for a depth of 400' . After considerable discussion, Mr. Morrison recom-
mended that this hearing be continued to allow time for the map to be redrawn.
Art Rebovich, a resident of the mobile home park, stated that he had taken
measurements and discovered that the area requested to be rezoned took in a
portion of the trailer park, stating that more than 50' of the mobile home park
is within the original proposalforrezoning. Commissioner C. Carlson, stating
that there seemed to be a discrepancy in the footage, moved to continue the Change
of Zone h-aring for Orville W. and Billie Jean Smith two weeks, to June 20, 1984,
at 2:00 p.m. Seconded by Commissioner Martin, the motion carried unanimously.
