RE: ACTION OF BOARD CONCERNING RENEWAL OF MOBILE HOME PERMIT, ZPMH

WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board of County Commissioners of Weld County, Colorado, on June 14,
2004,considered the request of Eugenia and David Harris, 18636 Weld County Road 3, Berthoud,
Colorado 80513,to renew a Zoning Permit for a mobile home to be used as a Temporary Accessory
to the Farm, and
WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a
parcel of land being more particularly described as follows:
S1/2 N1/2 S1/2 NW1/4 of Section 32, Township 4
North, Range 68 West of the 6th P.M.,Weld County,
Colorado
WHEREAS, at said hearing the Board of County Commissioners deemed it advisable to
continue said matter to July 12, 2004, at 9:00 a.m.,at the request of the applicant,who was not able
to attend the meeting on June 14, 2004, and
WHEREAS,at said meeting of July 12, 2004,the Board of County Commissioners, having
heard all of the testimony finds that, pursuant to Section 23-4-170 of the Weld County Code, said
request should be denied for the following reasons:
1. Section 23-4-170.A.1. The applicant has not provided sufficient evidence showing
that the mobile home will be occupied by persons principally employed at or
principally engaged in the operation of the use where the mobile home is located.
2. Section 23-4-170.A.2. The applicant has not provided sufficient evidence showing
that the mobile home is necessary for the effective and economical operation of the
use and/or protection of the agricultural use. The Board of County Commissioners
finds that the farming operation is too small and the amount of income derived
therefrom less than would be expected of a viable farming operation to justify a
temporary accessory permit for a mobile home.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of Eugenia and David Harris for renewal of a Zoning Permit for
a mobile home to be used as a Temporary Accessory to the Farm on the above described parcel
of land, pursuant to the requirements of Chapter 23,Article IV, Division 3, of the Weld County Code,
be, and hereby is, denied.

This is case ZPMH-1165, a renewal for a Zoning Permit for a mobile home permitted as a
Temporary Accessory to the Farm. The legal description is the S2N2S2NW4 of Section 32,T4N,
R68W of the 6th P.M.,Weld County, Colorado. The property is located east of and adjacent to CR
3 and approximately 1-1/4 mile north of CR 38.
The property owners are David and Eugenia Harris.
The sign for his hearing was posted on June 4, 2004, and this case was continued on June 14t',
2004 to todays hearing date.
The Department of Planning Services staff met on April 23, 2004, to discuss the renewal for a
mobile home being used as a Temporary Accessory to the Farm. Staff has denied this request as
there is not enough justification for an additional home to continue as an accessory to the farm due
to the size of the parcel and the occupant of the mobile home is not a full time employee.
There is also an additional mobile home located on this 18.75 acre parcel. The Department of
Planning Services has not been able to locate a permit for the second unit, nor does it come up on
the Assessor's records. The Department of Planning Staff is recommending that this home be
removed from the property. There is also an employee that resides in this mobile home, who
provides supervision to the part time employees.
The Harris's have been given the option of doing a recorded exemption, which is the
recommendation of the Department of Planning Services staff, along with the removal of the
unpermitted mobile home.

Should the Board approve for the use to continue, the Department of Planning Services
recommends the following conditions be amended into the existing permit:
1. The mobile home which is not currently permitted through the Department of Planning,shall
be removed from the property.
2. The applicant shall submit a statement of an exit plan acknowledging that the temporary
permit shall cease to exist at any such time as the mobile home is used for other than the
permitted use. Such statement shall include detailed plan for removal of the mobile home
upon expiration of the permit, or at such time the permit is not renewed by either the
Department of Planning or Board of County Commissioners,the applicant will have 30 days
to put the exit plan into place.
3. The mobile home will be occupied by persons principally employed at or principally
engaged in the operation of the use where the mobile home is located. Accessory farm use
of the mobile home shall be established and revalidated on an annual basis as follows:
evidence shall be submitted by the applicant or property owner by the first of each year for
review and acceptance by the Department of Planning Services verifying that the mobile
home occupant is principally employed at or engaged in the farming operation on the
subject property. The evidence shall consist of tax records, employment agreements or
other documentation as determined suitable by the Department of Planning Services.
Failure to submit the required documentation may result in cessation of the allowance of
the mobile home for temporary accessory farm use.
4. The mobile home will not be used as an income source by the applicant for rental to
persons who are not principally employed upon the lot.
5. The applicant shall submit documentation to the Department of Planning Services by June
1st of each year describing the status of the accessory farm unit. This permit is temporary
and shall terminate once the use ceases to exist, or at which time is used for purposes
other than those permitted,at which time the applicant shall have thirty(30)days to remove
the mobile home from the property.
6. All temporary permits for mobile homes shall not be transferable by the applicant and/or
owner to any successor; the zoning permit shall terminate automatically upon conveyance
or lease of the property. The mobile home shall be removed from the property, or a new
zoning permit shall be applied for and approved.
7. The property is in violation of Chapter 23 of the Weld County Code (Violation #0100279).
The applicant shall schedule a final inspection with the Weld County Zoning Compliance
Officer and submit a copy of the closure letter indicating compliance with Chapter 23 of the
Weld County Code.
8. The applicant shall maintain compliance with Section 23-4-170 of the Weld County Code
at all times.

RE: Two accessory mobile homes.
Dear Mr. and Mrs. Harris:
The Department of Planning Staff met on Friday, April 23, to discuss your request for your two accessory
to the farm units located at the above address.
One mobile home is permitted under ZPMH-1165, located on the back side of your property, as an
accessory farm unit. Staff concurred that there is not enough justification for this use to continue, and has
denied the renewal. You do have the option to go before the Board of County Commissioners who would
have the final decision on this permit.
As to the second home, located at the front of your property, we have been unable to find any zoning or
building permits, therefore this mobile home is in violation and a zoning permit would need to be applied for
and approved, unless you have additional information on how this was permitted. Again, staff would also
be recommending denial of this unit, as this would be the second accessory. This would also go before the
Board for a final decision. I am sending you an application for this should you decide to permit it. Should
you have further information as to how this was permitted, please provide that to our office. You may also
have the option of doing a recorded exemption, also included, that would allow for the newer home to stay
on a separate parcel also.
Please let us know how you wish to proceed, along with any additional information, within 14 days of receipt
of this letter, to avoid any further violations.

letter stated that our office is requiring written notice of evidence within 30 days, that the need for the
additional mobile home still exists. To date, our office has not received any new information.
Evidence shall be submitted by the applicant or property owner by the first of each year for review and
acceptance by the Department of Planning Services verifying that the mobile home occupant is principally
employed at or engaged in the farming operation on the subject property. The evidence shall consist of tax
records, employment agreements or other documentation as determined suitable by the Department of
Planning Services. Failure to submit the required documentation may result in cessation of the allowance of
the mobile home for temporary accessory farm use.
If the use of the mobile home has changed or been removed, please contact me at the above address or
phone number. If our office does not hear from you within 10 days of receipt of this letter, your Zoning Permit
will be turned over to our Zoning Compliance Officer, as it will be in violation with the Weld County Code

Such permits are subject to review annually on the anniversary of the original permit's issuance.Our review of ZPMH-
1165 issued to the above property needs to be updated. If the mobile home is currently located on the property, staff
is requesting written evidence within 30 days of this letter, that the use still exists. Evidence shall be submitted by

DURING THAT TIME. RUSSELL STRADLEY LIVES IN THE LARGE MOBILE
AND WORKS HERE PART TIME YEAR ROUND.

KINCH'S. WE HAVE USE OF 20 ACRES OF EICHLER'S LAND FOR OUR

The first month rent, $700.00 and a damage deposit of$700.00 will be paid on or before move-in date. The

Pursuant to your previous conversations with Tina Toll, the following proposal is
being submitted to you for the rental of sheep for the Australian Cattle Dog Club of
America National Specialty Herding Trial to be held at Island Grove Park in Greeley, CO
in September of 2000.
Rental will be from Wednesday, September 20`h, through Friday, September 22nd
The rental cost will be 5.00$per head up to a maximum of 60 head of sheep with exact
numbers to be provided once trial entries have closed (approximately August 20t°
The transportation charge will be included in the rental fee, which includes delivery on
Wed. by 4pm and pickup on Friday after 6pm.
The ACDCA will provide feed and care of sheep from time of delivery until pickup.
The stock will be valued at $/head replacement for the purpose of posting in our
premium list.
If this agreement meets with your approval, please sign and return one copy of this letter
as soon as possible. A stamped, addressed envelope is provided for your convenience.

Dear Sirs:
We are applying for a zoning permit for a mobile home to be
placed on our 18.15 acres in Weld County, 18636 Weld County Road
13, Berthoud, Colorado 80513.
We raise and train Australian Shepherds. I also teach all breeds
of working dogs. This takes me all over these United States and
Canada doing clinics and seminars as well as attending shows and
stock trials with our own dogs.
We also raise Dorset sheep, have several kinds of fowl for insect
control, raise our own beef and hay.
In the past, we hove hired people to come in and stay in our home
for the duration of time we are away. This hasn't worked out at
all because of the time and instruction involved with the care
and feeding amounts and procedures of all the different animals,
especially the dogs.
The last time we were gone, a very valuable bitch got away, was
very frightened, and stayed gone for several days. She finally
returned, but she could have been killed or lost the litter she
was carrying, either would have been devastating.
We want to have the mobile home here and have someone live in it
permanently, so they will know the dogs, what everything eats,
how much and when. We will also have permanent help at lambing
and shearing times es well as for butchering and haying time.
We appreciate your consideration of this application.

Dear Sirs:
I manage Crown Point Ranch owned by Wayne and Kaye
Harris, and have worked here for eight years. As manager, I
am responsible for the care and well being of all livestock,
new fencing, repairs to fencing and buildings, keeping
corrals clean, planting wind breaks, repairing water lines,
mowing fields and weeds, spraying weeds, trimming trees,
finding leaks, replacing water lines, and irrigating. The list
goes on.
A few specific things regarding livestock are; working 6 times
per year, trimming feet, calving, lambing, (which greatly cuts
into our sleep for a few months) taking sheep out to pasture
and up to corrals twice daily, cattle out to pasture and up to
lot once daily, (and moving fence of graze area) rounding
them up when they break out (or calves slip under) feeding
hay when pastures are too dry or winter. That's all I can
think of off hand.
Since I have extensive chemical burns and two and a partial
missing fingers, we have two other employees that help me.

Scrapie Surveillance: Tagging Sheep and Goats
In an effort to eradicate scrapie in the United States,a new USDA regulation requires sheep and goats to have premise
identification ear tags that lists their flock of origin. Although the compliance date is November 19,2001, enforcement of
the rule will begin in at a later time due to the limited availability of the tags.
• Animals required to have premise tags:
Slaw
• All sheep over 18 months of age upon change of ownership t
or when they are sent to slaughter •
• All sheep that are sexually intact and for show or exhibition
• All breeding sheep regardless of age /
Goats
• All show or exhibition goats that are sexually intact and do not have a registration tatoo**
• All breeding goats,regardless of age,that are or have been commingled with sheep
**Registered meat and dairy goats may use tattoos with Breed Registration Numbers until they are sent to slaughter
when a premise ID tag will be required. Identified sheep and goats may have several ear tags,depending on how many
premises from which they have been moved or sold.Tags must accurately reflect the premises on which the animals have
been co-mingled with other sheep or goats.
Cull breeding sheep and goats destined for slaughter will be tested for scrapie.During the scrapie surveillance pro-
gram, the ID tags will be collected to accompany the test sample and used to trace an animal that tests positive for scrapie
back to its infected flock.
Keeping Records
Records on purchases must be maintained for five years for disease investigation purposes.When selling sheep and
goats at the livestock market,owners should have premise ID numbers recorded on the market check-in document.
Buyers
Sheep and goat buyers should maintain records on the number of animals acquired;the date of acquisition;the name,
address and phone number of the person from whom they were purchased; and their premises of origin ID numbers. Only
livestock barns that tag sheep with their premise ID tags are required to comply.
Sellers
Individuals who sell or dispose of sheep and goats should maintain records of the number of animals sold and dis-
posed; the date of sale;the name, address and phone number of the buyer or person who acquired the animals;and the
premises of origin ID numbers or their individual numbers.
To obtain tags, owners must contact the APHIS Area Veterinary Services at(303)231-5385 to obtain a premise
identification number.APHIS will also assist owners in ordering the tags, which are provided at no cost. Sale barns will
also be assigned a premise ID number and will be supplied with white metal tags to identify sheep.

CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested
water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval
of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation
Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-92-602(3)(b)(II)(A)as the only well on a tract of land of 37.00 acres described as that portion
of the S1/2 of the S1/2 of the NW 1/4,Sec. 32,Twp.4 N, Rng.68 W, Sixth P.M.,Weld County,more particularly described on
the attached exhibit A.
4) The use of ground water from this well is limited to fire protection,ordinary household purposes inside not more than
three (3)single family dwellings,the irrigation of not more than one(1)acre of home gardens and lawns, and the watering
of domestic animals.
5) The maximum pumping rate of this well shall not exceed 15 GPM.
6) The return flow from the use of this well must be through an individual waste water disposal system of the
non-evaporative type where the water is returned to the same stream system in which the well is located.
7) This well shall be constructed not more than 200 feet from the location specified on this permit.
