SITE SPECIFIC DEVELOPMENT PLAN AND
USE BY SPECIAL REVIEW (USR) QUESTIONNAIRE
Valencia Construction, Inc.
1. Explain, in detail, the proposed use of the property.
The proposed use of the property will be the storage of business-related items in the existing Pole
Barn. The use proposed is for the Valencia Construction Business. This business is a family-operated
business. The book-keeping, storage of concrete forms and equipment will be accomplished on-site
within the pole barn. The actual construction component of the business is accomplished off-site on
particular construction sites. Business related items to be stored on site include concrete forms,
blankets and miscellaneous equipment. An office within the pole barn will be used for book-keeping
and record-keeping associated with the business.
An active violation with the Weld County Zoning Compliance Officer, VI-0300324 exists. This
application will remedy the violation.
Two gasoline tanks have been placed on the plat southeast of the existing pole barn. Each tank will
be less than 660 gallons each. They are both proposed to be 500 gallons each. Being so, the total
will also be less than 1,320 gallons and will not be regulated by state or federal guidelines. One tank
will be for diesel fuel. The second tank will be for regular fuel. The applicants and their
representatives have contacted the new Fire Chief for the Ault Fire Protection District on numerous
occasions regarding setbacks and other regulations without success. The applicants representative
contacted the old Fire Chief, Dave Jansen on 2/19/04. Mr. Jansen indicated no conflict with the
placement illustrated on submitted materials. However,the applicants request the proposed location
be able to move based upon referral response from appropriate agencies. The proposed location was
made due to accessibility, on site circulation patterns, and security.
2. Explain how this proposal is consistent with the intent of the Weld County Code,Chapter 22
(Comprehensive Plan).
• By allowing the Valencia family the proposed use, they will be able to stay on their
property. The applicants believe they have been good stewards of their property and have
a strong desire to remain on their property. A. Policy 10.1 supports property owners who
have demonstrated responsibility of ownership by minimizing safety and health hazards.
• This application is the result of a building violation. Therefore the principle statement in
Section 22-1-50.C.e has been upheld. The Weld County Zoning Compliance officer has
been cooperative in evaluating the objectives of the applicant and the options available to
the applicant while ensuring the health, safety and welfare of County residents.
• A small portion of the property is classified as Prime, If Irrigated on the Farmlands of
Importance Map recognized by the Weld County Planning Services Department. The
majority of the property is unclassified on this same map. Land classified as"Prime" has
not been removed from agricultural production.
• The property is not located within an Overlay District or within an Intergovernmental
Agreement or standard Urban Growth Boundary.
• The property shall remain free of unsightly materials, including but not limited to, derelict
vehicles, refuse and litter. (A.Goal 10). The purpose of this application is to afford the
clients the opportunity to store business related items such as concrete forms and concrete
blankets within the pole barn.
• A.Goal 6 and R. Goal 1 both stipulate that public facilities and services are currently
available to serve the desired use. The property will be served by septic for sanitary
sewer, a well for domestic water, an existing access from Weld County Road 86, Ault Fire
Protection District, and the Weld County Sheriff. As this proposal is not for additional
residential lots, the impact to the School District does not exist.
• The Right to Farm Statement shall be observed.
• Conditions of Approval and Development Standards shall be adhered to, minimizing
negative impacts.
3. Explain how this proposal is consistent with the intent of the Weld County Code,Chapter 23
(Zoning) and the zone district in which it is located.
• The site is not in an Overlay District,verified by documentation supported by and/or created by the
Department of Planning Services.
• The property is within the Agriculture(A)Zone District. A Home Business is listed in Section 23-3-
40.O as a Use by Special Review in the Agricultural (A)Zone District.
• This application has been filed in accordance with Article 2, Division 4, Chapter 23 of the Weld
County Code, starting with Section 23-2-200.
• The plans submitted with this application detail circulation, lot configuration, setbacks, and a
building envelope for future building.
• Conditions of Approval and Development Standards ensure the development upholds the purpose and
intent of the Weld County Code, Chapter 23 as listed in Section 23-1-40.
• A noise report, as stipulated in Section 23-2-260.E.A is not applicable. Based upon the proposed
uses, the applicants believe the proposed uses will not necessitate such report and are thereby
requesting a waiver from this requirement.
4. What type of uses surround the site? Explain how the proposed use is consistent and
compatible with surrounding land uses.
Surrounding land uses include rural residential. All storage of forms will occur inside the pole
building, limited employees will be on site, and limited traffic will come from the site. These items
will negate any conflicts with compatibility.
5. Describe, in detail, the following:
a. How many people will use this site? 1 —2 persons,on occasion,to pick up concrete forms
and to perform tasks associated with bookkeeping. Under normal circumstances, the
concrete forms will be moved from site to site and not return to the office location.
b. How many employees are proposed to be employed at this site? Mr. and Mrs. Valencia
are employed on site for storage, any transfer of forms, book keeping, and truck transfers.
The Valencia's live on site. Mr. Valencia's primary work location is on the particular job site.
Lorraine is the one employee that will be on site during operating hours.
c. What are the hours of operation? 7 a.m. —8 p.m. Hours may vary due to seasonal work.
d. What type and how many structures will be erected(built)on this site? One pole barn is
waiting for a Certificate of Occupancy through the Weld County Building Inspection
Division. The inspections for this pole barn triggered the current violation. Any additional
structures to be constructed on site will be done in the building envelope noted on the USR
Plat. The plat illustrates a future building site. This building, if ever constructed, shall be of
similar style and materials as the first building. This building shall be used for the business
permitted herein.
Two 500 gallon above ground gas tanks are proposed as illustrated on the plat. One tank will
be for diesel fuel. The second is for regular fuel. These tanks will be accessed when trucks
are dispatched from the site to a work location. Trucks will not generally drive back to the
site for refueling.
e. What type and how many animals,if any,will be on this site? Currently two(2)dogs are
on site. Additional animal units shall not exceed those allowed by right in the Agricultural(A)
zone district.
f. What kind (type, size,weight)of vehicles will access this site and how often? Delivery
trucks to carry concrete forms from storage to the construction site. The following vehicles
are used. Vehicle replacement will be accomplished by similar vehicles.
One 10,400 pound 1981 International Dump Truck will be located on site
when not at a job site.
One 23,160 pound Chevy Truck will be located on site when not at a job site.
One 21,000 pound International Truck will be located on site when not at a
job site.
One 8,100 GMC Flatbed Truck be located on site when not at a job site.
g. Who will provide fire protection to the site? Ault Fire Protection
h. What is the water source on the property? Domestic Irrigation is provided by a Well. See
attached permit.
i. What is the sewage disposal system on the property? A septic system provides sewage
disposal. See attached permit.
j. If storage or warehousing is proposed,what type of items will be stored?
Concrete forms, concrete blankets, small generators,trowel machines,small job materials such
As saws, shovels, concrete brooms.
6. Explain the proposed landscaping for the site. The landscaping shall be separately submitted
as a landscape plan map as part of the application submittal.
The soil characteristics coupled with the location of the property in Weld County do not support a
landscaping plan. Screening is not applicable to this application.
7. Explain any proposed reclamation procedures when termination of the Use by Special Review
activity occurs.
Reclamation procedures are not applicable to the Valencia Use by Special Review application.
8. Explain how the storm water drainage will be handled on the site.
Gutters are on all sides of the building to allow water to distribute evenly on the ground.
9. Explain how long it will take to construct this site and when construction and landscaping is
scheduled to begin.
Upon acceptance of this application, and the recording of this Use by Special Review plat, a
Certificate of Occupancy can be obtained for the existing pole barn.
10. Explain where storage and/or stockpile of wastes will occur on this site.
A dumpster will be on site at all times and emptied on a monthly basis.
