Itl I \ N _ e;2' -___ \ -.... 1., li We II Sli DAl 4 III -- is I I I I I RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR OIL AND GAS PRODUCTION FACILITIES - BELLWETHER, CACHE AND ELWOOD OIL COMPANIES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 28th day of December, 1983, at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board for the purpose of hearing the application of Bellwether, Cache and Elwood Oil Com- panies, c/o Kenneth Lind, 1011 Eleventh Avenue, Greeley, Colorado 80631, for a Use by Special Review for oil and gas production facilities on the following described real estate, to-wit: Parts of Section 23 , 25 and 26 , all in Town- ship 6 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 .4 .2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the re- quest of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence pre- sented in this matter, and having been fully informed, finds that this request shall be approved for the following reasons : 1. The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows : a. The proposal is consistent with the Weld County Comprehensive Plan. Industries such as oil and gas production require location adjacent to their raw materials . The mineral extraction industry is therefore restricted in its operation to those areas where the resources exist. b. The proposal is allowed as a Use by Special Review in the Residential Zone District and will be con- sistent with the district. The subject Residential Zone District is used for agricultural production and is not a platted subdivision for residential use. The soils at this location are classified LHR 107 'i L Hl95 830157 Page 2 RE: USR - BELLWETHER, CACHE AND ELWOOD OIL COMPANIES as IIe and IIIe prime agricultural land. The tank battery clusters have been located in order to preserve as much prime farm land as possible. c. The use permitted will be compatible with the existing surrounding land uses . The surrouding land uses are agricultural in nature except for the east of Seeley Lake which is single family residential. d. No overlay districts affect the site . e. Use by Special Review Operation and Design Stand- ards, as amended, provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application for a Use by Special Review for oil and gas production facilities on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions : 1. The attached Standards for Use by Special Review, as amended, be adopted and placed on the Use by Special Review plat prior to recording. 2 . No additional building or electrical permits shall be issued for the Use by Special Review Permit area until the Standards for the Use by Special Review, as amended, have been placed on the Use by Special Review plat and the plat has been delivered to the Department of Plan- ning Services Office . The uses permitted shall be oil and gas production facilities as described in the submitted application materials and as located on the submitted U.S.R. plat maps. 2. There shall be two (2) driveways for ingress and egress for the Eldridge #1-23 tank battery cluster and one (1) driveway for ingress and egress for the Kissler-Amen #1-26 tank battery cluster onto Weld County Road 66. There shall be one (1) driveway for ingress and egress for the Kissler-Amen #1-25 tank battery cluster onto Weld County Road 35. All driveways shall have a fifteen (15) inch by forty (40) foot C.M.P. culvert for drainage. 3. All tank batteries shall be designed to meet the following standards: a. A berm shall enclose each tank battery cluster. Volumetric capacity of the bermed area shall not be less than the greatest amount of liquid that can be released from the largest tank within the bermed area, assuming a full tank. To allow for volume occupied by tanks, the capacity of the diked area enclosing more than one tank shall be calculated after deducting the volume of the tanks other than the largest tank below the height of the berm. b. A six (6) foot chain link fence with three (3) strand barbed wire top shall enclose each tank battery cluster area. 4. In the event that a Final Plat Subdivision application is submitted within the subject Use by Special Review area to the Weld County Planning Department or City of Greeley Planning Department, the Operation Standards and conditions of U.S.R. - 599:83:62 shall be reconsidered through the Use by Special Review application process. The intent of this standard is to review the appropriateness of tank battery locations and landscaping and not the proposed use. 5. Upon cessation of the permitted use, the tank battery and all associated equipment shall be removed by the applicant or owner and the land reclaimed to its prior use. 6. All produced brine water shall be transported to approved disposal sites. 7. The proposal shall comply with all Eaton Fire Protection District requirements. 8. Only hydraulic type pumps shall be used in conjunction with the oil and gas production facilities. 9. The body of all tank batteries shall be painted in earth tone colors. The tank batteries shall be maintained in a neat and orderly manner through periodic painting and maintenance. 10. The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 11. The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq. , of the Weld County Zoning Ordinance. 12. Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Development Standards stated hereon and all applicable Weld County Regulations. The Use by Special Review area shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 14. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. 15. Within thirty (30) days after final approval by the Board of County Commissioners, the Eaton Fire Protection District shall be contacted and invited to attend instructional training meetings concerning shutdown procedures and fire control measures at said plant sites. HEARING CERTIFICATION DOCKET NO. 83-88 RE: USE BY SPECIAL REVIEW, OIL AND GAS PRODUCTION FACILITIES - BELLWETHER, CACHE AND ELWOOD OIL COMPANIES • A public hearing was conducted on December 9R , 1983 at 2:00 P. M. , with the following present: Chuck Carlson Chairman, Excused John Martin Pro Tern Gene Brantner Commissioner Norman Carlson Commissioner Jacqueline Johnson Commissioner Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, R. Russell Anson Planning Department Representative, Michael Mullen The following business was transacted: I hereby certify that pursuant to a notice dated December 12, 1983, and duly published in the LaSalle Leader on December 15, 1983, a public hearing was held for the purpose of considering the request of Bellwether, Cache and Elwood Oil" Companies for oil and gas production facilities. Prior to this hearing, John Martin, Chairman Pro-Tem, announced that the applicant could continue this hearing to another date since only four Commissioners were present. Russ Anson, Assistant County Attorney, read this request into the record. Planning Depart- ment representative, Mike Mullen, read the favorable recommendation of the Plan- ning Commission, along with the sixteen Operation Standards. Kenneth Lind, representing the landowners and applicants for the Use by Special Review, began his presentation with photographs of oil and gas operations within one-half to five miles of the City of Greeley, along with photographs of the tank batteries under consideration. Mr. Lind gave background information on the submission of this application for a Use by Special Review, along with a copy of the Weld • County Comprehensive Plan map and a map of the City of Greeley Comprehensive Plan. Mr. Lind further stated that the companies involved have no objections to the Operation Standards except Standards #2, 3a, and 16. On Standard #2, the companies request two driveways for the Eldridge tank battery. Mr. Lind then introduced Tony Sharp, of Denver, representing Bellwether Exploration. Mr. Sharp explained that all tanks in a battery cluster are never full at the same time, and the companies are requesting that Standard #3a read that the berms are to contain the volume of the largest tank, rather than the volume of of the entire tank battery. Mr. Sharp also presented information concerning the proposed Operation Standard #16. (Tape change #83-155) He stated that the current set-back requirement in Weld County is 20' from the public right-of-way, rather than 300' as Operation Standard #16 states, and ccnrented on the cost of moving tank batteries and the well which are within the 300' . He also commented on the amount of farm land which would be necessary if facilities are located 300' from rights-of-way or structures. Mike Mullen stated that the 300' requirement was added by the Planning Commission at the request of the City of Greeley. (The Chairman Pro-Tem called a five-minute recess.) Commissioner Johnson stated that the issue seems to be what the City of Greeley would allow and what it would zone residential if this area were to be annexed. Mr. Lind asked two owners of the land under consideration, Jack Eldridge and Roland Kissler, to comment on the placement of the tank batteries under discussion and their wishes concerning annexation to the City of Greeley. Bob Richardson, of Bell- wether Exploration, commented on the placement of wells in the area. Also speaking were Harry Rupp, Jay Underwood, representing Elwood Oil Company, and Don Leffler. They each commented on the advantages of having oil facilities at the side of fields, rather than 300' into the fields. Commissioner Johnson again stated that a major issue is one of cooperation with the City of Greeley. She also stated her objection to being asked to approve a facility already in place. After further discussion, Commissioner N. Carlson moved to approve this request for a Use by Special Review for oil and gas production facilities for Bellwether, Cache and Elwood Oil Companies, including the Operation Standards as set forth with the following changes: Standard #2 shall allow two driveways for ingress and egress for the Eldridge #1-23 tank battery cluster; Standard Ua shall read, "A berm shall enclose each tank battery cluster. Please consider this letter as a part of said application as it does address certain application requirements. The Use by Special Review Application concerns seven wells located in Sections 23, 25, and 26 of Township 6 North, Range 66 West of the 6th P .M. , Weld County, Colorado. As of this date five of the seven wells have been drilled and four of those five have directly associated oil and gas production facilities in place and in operation. The five wells were drilled by the above-mentioned three companies in the belief that the same were in an A zoned district , but , in fact the wells were drilled in an R-1 zoned district. This unintentional violation was noticed by Mr. Adams, the Weld County Zoning Administrator who then informed the oil companies of their violation of the County Zoning Ordinance. Immediately upon receipt of the violation notifi- cation, the companies halted operations and it was through the generous and kind consideration of the County Commissioners that the production facilities (tank batteries) were allowed to be constructed. It should be noted that the companies were informed by the Commissioners that the facilities would have to be removed in the event the special use permit were not approved. In relation to the consistency of the proposal with the Weld County Comprehensive Plan and the intent of the district in which the use is located, it should be pointed out that the Greeley Comprensive Plan only lists the east side Seeley Lake (no wells located here) as a residential area and the Weld County Comprehensive Plan shows the property to be outside of town growth and residential areas. It is unknown when this property was zoned as R-1 , but there has been and currently is no residential construction in the well { Weld Co. Planning Dept. November 18, 1983 Page 2 locations except for the east side of Seeley Lake. It should also be pointed out that oil and gas production facilities are allowed in an R-1 zoned area pursuant to the Weld County Zoning Ordinance. As previously stated, since the Comprehensive Plan of both Greeley and Weld County do not show the areas immediately west and south of Seeley Lake as being residential, this proposal is compatible with future development of the area, and the proposal is definitely compatible with existing surrounding land uses. The existing surrounding land uses, again except for the east side of Seeley Lake are all agricultural with extensive oil and gas development in the area. Additionally, the South Platte River and gravel pits are approximately one-half mile to the south which makes this proposal even more compatible with surrounding land uses. The proposed and existing sites for the wells and production facilities are not in an overlay district, and great care has been taken in siting the production facilities so as not to interfere with productive agricultural production currently taking place upon the property. The tank batteries have been sited with the utmost input and direction from landowners as well as tenant farmers and it is believed that the sites are advantageous for future agricultural use. Based upon operation standards, design standards, as well as state and county regulations, the health, safety and welfare of the neighborhood and county will be and is currently being met. The use of all seven existing and proposed sites are for the production and storage of gas and related hydrocarbons. All the storage facilities are designed to hold only the production from one or two wells and do not hold any production from wells not directly associated with the facilities. The general operation is a wellhead connected by underground line to a heater- treater and meter facility along with two or three holding tanks. The holding tanks receive the liquid hydrocarbons which are separated in the heating process from the gas and the liquid hydrocarbons are stored in the tank until removed by a tanker-type truck. The gas after leaving the heater plant are then pumped into existing gathering lines for delivery to other locations. There are no users, members, buyers, or employees on a regular basis except for an occasional maintenance and supervisory personnel as well as occasional crews to rework the drill site. The liquid hydrocarbons are picked up as needed which is on an average of once per week. Domestic sewage facilities, waste areas and removal of debris are not applicable to this application except as related to the initial drill site and construction operations and of course, all debris and waste is removed at that time. • Weld Co. November 18, 1983 Page 3 All of the facilities are located within a quarter to three-quarters of a mile of residential structures with most of the structures being located on the east side of Seeley Lake and most of the wells being located either west or south of Seeley Lake. There are two wells, (Gerry-Ball , one existing and one proposed) which are located east of Seeley Lake and are within a quarter mile of residential structures. The drilling operation and fracting operations take approximately two to four weeks for each well , and then production and storage facilities are constructed with their timetable being approximately one week. All of the production and storage facilities are fenced with high-security chain link fencing and are painted in earth color tones with the tank batteries being low profile to decrease their visibility and environmental impacts in the area. All the facilities are kept in an extremely neat and clean condition, and will be so taken care of in the future. There are no proposed landscaping plans. Additionally, all of the tanks are constructed with berms to hold a contem- plated or expected leak or seepage and it should also be stated that the Eaton Fire Protection District has had an opportunity to view the structures and learn of their operations for proper fire protection measures. The applicants are willing to cooperate at all times with fire protection personnel in reviewing and keeping the district updated of plans and specifications of the production and storage facilities._ As related to final reclamation , it is expected that the life of the wells will be between six and twelve years and at the time production termi- nates, the tank batteries and associated facilities can be removed with no damage to the surface thereby allowing continued agricultural production. Finally, it should be noted that while these facilities are located in an R-1 district, there is very little residential growth except for the east side of Seeley Lake and it should also be noted that the City of Greeley is allowing drilling and production facilities within the city limits, so long as the same are constructed and operated in accordance with proper city and state guidelines. The applicants state that their facilities will be operated to the highest standard and degree of care possible to avoid unnecessary problems and to insure the health, safety and welfare of the surrounding citizens. As this proposed use is consistent with orderly development of the County and is directly related to the expanding oil and gas industry in the County, we request that you approve this Special Use Permit. The Commission recommended no objections to those wells and tank batteries which meet the City of Greeley ordinances and recommended denial of the well and tank batteries which do not meet City of Greeley ordinances subject to each tank battery installation being effectively screened or buffered through the use of landscaping , berming and/or fencing from existing residential development as well as the potential residential development which could occur on the R-1 zoned areas . More specifically, the Commission recommended denial of one existing well (Kissler-Amen 1-26) , two existing tank battery installations (Kissler- Amen 1-26 and Eldridge 1-23) , and one proposed tank battery installation (Kissler-Amen 1-25) since that well and those tank batteries do not comply with City of Greeley ordinances for setbacks from public rights- of-way. For clarification , the City of Greeley ordinances require a 300 foot setback from public rights-of-way for the wellhead drilling site as well as the tank battery or other ancillary equipment installations . Additionally, please note that as a result of this and other recent referrals requesting approval for a use after that use has already been established , the Commission is conveying to you, under a separate memo , communication regarding that concern . Ehrlich : At its regular meeting of December 13 , 1983 , the Greeley Planning Commission reviewed a number of Weld County referrals dealing with oil and gas related uses . A number of issues were raised during this review including : --inconsistent standards for oil and gas development activity between the City and County and --being asked by the County to review oil and gas well sites and tank battery sites "after the fact . " The Greeley Planning Commission is quite concerned about Greeley' s potential to " inherit ," via annexation , any number of oil and gas developments which are inconsistent with city standards . Further , many of the County' s interpretations or distinctions between the impacts of various oil and gas development seem unclear . The Greeley Planning Commission will be conducting its own review of the City' s oil and gas ordinances and requirements within the next month . Following that review, the Commission members desire a joint meeting with the Weld County Planning Commission to address more fully the many issues associated with oil and gas development broached herein . It should be mentioned that the application is for an expansion of the existing plant, and the expansion is for the purpose of removing the excess liquids. It was the hope of Production Operators that the application would be reviewed by the Commissioners during November so that the plant would be on-line in December of 1983. Due to the threat of the shutdown, substantial amounts of income will be lost by oil companies as well as mineral interest owners throughout Weld County, and we would request that this matter be preadvertised and scheduled for your board meeting on December 28, 1983.
