ANNEXATION AND ZONING
Notice is hereby given of a public hearing to be held before the Milliken Town Board of Trustees
at 7:00p.m, Wednesday, July 14, 2004, Milliken Community Complex, Community Room, 1101
Broad Street, Milliken, Weld County, Colorado. For the of determining and finding whether the
areas proposed to be annexed meets the applicable requirement of section C.R.S. 31-12-104 and
31-12-105 and is considered eligible for annexation. The proposed annexation legal description
is as follows:
A tract of land located in the West IA of the Southwest 'A of Section 14,Township 4 North,
Range 67 West of the 6th Principal Meridian, County of Weld, State of Colorado being more
particularly described as follows:
Considering the East line of the West 'A of the Southwest ''A as bearing South 00E1345"East and
with all bearings contained herein relative thereto:
Beginning at the Center West 1/6's corner of said Section 14, said point being the POINT OF

for
LETTNER ANNEXATION

Forward:
This "annexation impact report" has been prepared pursuant to Section 31-12-108.5 Colorado
Revised Statutes, 1986 Repl. Vol. Contained in Exhibits "A", "B", and "C" are maps depicting
the existing and proposed public services to the property, the existing and proposed land use for
the property, and the proposed annexations.
I. Project Description:
The property proposed for annexation contains a total of 75.495±acres and is surrounded by
Milliken Town limits. Thus, this annexation meets the 1/6 contiguity requirement.
The land proposed to be annexed is owned by Monika Lettner, 5104 East Highway 14, Fort
Collins, CO 80524.
The landowner proposes to develop 323 units.
Zoning of Property to be Annexed
The existing zoning around the Lettner Annexation is Agricultural Estate directly to the West and Planned
Unit Development on the remaining sides.
1. The Leaner Annexation proposal is needed by the Town for several reasons. The property is currently
a county enclave, surrounded by property already annexed into the Town. By annexing the subject
property, the Town will be closer to implementing several of their master plans goals for future growth.
Some of the infrastructure needed by the Town, such as sewer line expansion and extension can take
place. Also the existing waterline in WCR 21 will need to be upgraded to properly provide for water
service for the southwestern portion of the Town's growth.The soon to be needed improvements of WCR
21 will become extremely important to the Town for the major north south traffic movement within the
Town. The project will also expand the choices and options for the existing and future residents of the
Town in housing choices.The project will expand the tax base for the Town in several ways. First is
simply in property tax on future residential lots and proposed commercial lots and secondly on sales
taxes generated from the commercial operations. With the annexation of this property, the Town moves
closer to realizing the necessary expansion of infrastructure, economics, and control over the properties
located within their growth boundaries.
2. After researching the adjacent PUD, evidence shows the proposal of Centennial Master Plan including
mixed-use, residential, commercial,open space and preservation. The proposed subdivision
developments abutting the Lettner Annexation are as follows:
North-Low Density Residential, Loop Trail Connection
East-Low Density Residential, Golf Course, High Density, Medium Density, and Low Density
Residential, Elementary School,Senior Living
South-Open Space,Golf Course/Low Density Residential
West-High Density, Medium Density, Low Density Residential, Open Space& Loop Trail Connection
The property to the south is proposed Golf Course Community with Low Density Residential. A loop trail
connection provides pedestrian circulation around the proposed PUD. WCR 21 and WCR 44 are to be
enhanced arterial.
3. The property has direct route to the Town Center from WCR 21 (S. Quentine Ave). The adjacent
major roads are WCR 21 and WCR 44, traffic will increase due to this proposed zoning.

Shrubs shall be encouraged as accents and to define spaces near sidewalks and driveways and shall be
planted around the base of each house so that no irrigated sod is within 4'of the foundation.
Homeowners shall be responsible for trimming any shrubs that encroach on sidewalks and trees shall be
pruned so limbs are at least 72"above the walk.
Wood and rock mulch shall be used in shrub beds but shall be limited to no more than 25% of the area
that can be landscaped. The homeowner shall not be allowed to install more than 25%of the front yard
in mulch or rock alone. Xeriscaping shall be encouraged whenever possible, but xeriscaped yards will be
considered and approved by the HOA.
Fencing shall be allowed in the side and rear yards of a lot but may not extend forward past the corner of
the house closest to the front yard setback. No fence shall be installed within 25'of the front yard lotline,
except on corner lots. Wood privacy fences are allowed, but other types of fencing that provide a more
open feel are encouraged. Using landscape materials, such as low hedges, are strongly encouraged. All
fencing materials shall be approved at the discretion of the HOA. Fences shall not detract from the
aesthetics of the neighborhood or encroach on required site lines at intersections.
Landscaping and Development Standards adopted by Town of Milliken shall be followed throughout the
process, as well as those standards adopted by the HOA. Exceptions to the HOA standards may be
grated by a vote of the Board, but exceptions to the standards of the Town of Milliken will need to get a
variance from the Town.

Street Maintenance Town of Milliken
Financing the municipal services within the area to be annexed is addressed in an annexation
agreement between the applicant and the Town of Milliken. The annexation agreement is
currently under negotiation and is not available at this time.

RESOLUTION NO. 04-15
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF MILLIKEN, WELD
COUNTY, COLORADO THAT:
1 . At the regular meeting of the Board of Trustees on May 26, 2004, the
annexation petition for Lettner Annexation was submitted to the Board of
Trustees by the Clerk as a communication pursuant to Section 31 -12-107(1)(f),
C.R.S. The location of the property is described on Exhibit "A" attached hereto
and incorporated herein by reference.
2. The Board of Trustees has reviewed the petition and finds that the
requirements set forth in Section 31 -12-107(1 )(f), C.R.S. have been substantially
complied with.
3. Pursuant to Section 31 -12-108(1), C.R.S., the Board of Trustees hereby
sets the date for the hearing on the annexation petition for July 14, 2004 at
P.M. in the Town of Milliken Board Room located at 1101 Broad Street,
Milliken, Colorado. Notice of this hearing is to be published.
4. The purpose of this hearing shall be to determine whether the area
proposed to be annexed meets the applicable requirements of Sections 31-12-
104 and 31 -12-105, C.R.S. and is eligible for annexation.
5. In the event the Board of Trustees finds that the statutory
prerequisites for annexation have been met the Board will hold a public hearing
on the ordinance annexing this property.
This resolution was passed by a vote of 7 in favor and 0 opposed at the
meeting of the Board of Trustees on the May 26, 2004.
