Sheri based on the original submittal Dated May 20, 2003 and the limited information in
that submittal the following was the Windsor-Severance Fire Protection Districts original
requirements. I have included additional requirements for this project as I have been
provided with a lot more detail as it relates to the entire site with this current submittal.
The first five conditions are the original requirements and the current requirements follow
the originals.
1. The lot shall have its own access; each access shall be designed to carry a
designed wheel load of 18000pounds (80000 pound gvw) (H2O loading).
2. The access shall be constructed of a permanent all weather road base.
3. Addresses shall be posted clearly on the road fronting the property.
4. Addresses shall be posted clearly on the structures.
5. If any structures are located more than 150' from an approved accessway there
shall be alternative fire protection requirements enforced.
6. This site shall be provided with a minimum of(2) two points of access designed
to our standards.
7. The internal circulation shall meet our standards. We utilize a B-40 turning
template for turning radi etc.
8. This site shall be provided with fire hydrants that are on a minimum of a 6" main
and this system shall be looped and capable of providing 1500 gpm at 20 psi with
a flow duration of 2hrs. Hydrant spacing shall be 300' apart and 150' from
structures.

SCH-25 A Review of a previously Denied Application for Land Use (Use by Special Review 1430 for a
landscaping Materials Yard) and request for Substantial Change.
1. All structures listed under the heading "Property Enhancements to Maintain High Quality Business
Standards" unless exempted by Weld County Code Section 28-2-20 will require a Building permit.
A. Change of use of the 30'x40' pole building from private storage to Group M ( Mercantile.) This includes
the 10'x 10' public bathroom. The building and bathrooms shall be accessible to persons with disabilities.
B. The 13' x 36' 3-sided pole building for storage of loaders /attachments and various hard goods.
C. The retaining walls.
D. The Kiosk
E. The deck that will be attached to the office.
2. A plan review is required for each building for which a building permit is required. Plans shall include a floor
plan. Two complete sets of plans are required when applying for each permit.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application.
Currently the following has been adopted by Weld County: 2003 Intemational Building Code; 2003 International
Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; and the 2002 National
Electrical Code and Chapter 29 of the Weld County Code.
4. Fire resistance of walls and openings, construction requirements, maximum building height and allowable
areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning
Ordinance.
5. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be
measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset
and setback requirements. Offset and setback requirements are measured to the farthest projection from the
building.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the Use
by Substantial Change Standards. Weld County Code, Chapter 2, Article III, Section 2-3-10. Our comments and
requirements are as follows:
COMMENTS:
Access: WCR 17 and 60 feet of right-of-way at this location has been annexed by the City of Greeley.
REQUIREMENTS:
Access: The applicant should verify with the City of Greeley that the 60-foot access easement is subject to
additional requirements that may be necessary to obtain or upgrade the access at this location.
Site access: The internal road shall enter on to the easement at a 90° angle for a minimum of one vehicle length to
--'rovide adequate sight distance in both directions.
Easement: The 60-foot access easement as per Book 648, Recording 1570019, should be identified on the plat
drawing. The applicant shall obtain signatures from the adjacent property owners utilizing the existing 60-foot
access easement notifying them that the use will be changing to accommodate heavy duty truck hauling of
landscaping materials and additional traffic. The signatures of the adjacent property owners shall be provided to
Planning Services and the Public works Department for verification.
The roadway narrows just past the entrance to Timberrock to a one-way lane across the drainage pattem. This is a
safety concern. There should be two lanes extended across the drainage pattern with a culvert extension.
The applicant shall apply dust suppression chemical (magnesium chloride or calcium chloride) on the haul road
between Weld County Road (WCR) 17 and the entrance to the site no less than twice a year or as determined by
the Department of Public Works.
Off-Street Parking: The off-street parking including the access drive shall be surfaced with gravel and dust control
or the equivalent and shall be graded to prevent drainage problems. Each parking space adjacent to the building
shall be equipped with wheel guards or curb stops where necessary to prevent vehicles from extending beyond the
boundaries of the space and from coming into contact with other vehicles, walls, fences, or planting.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent property damage of the type
generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of
storm run-off.

some of the landscaping material may deal with dyed or stained bark or tree products.

Subject: SCH-25 Referral
Upon review of my computer and files,an active Zoning and Building Violation was noted(VI-0300014). This
violation was initiated as a result of failure to obtain the necessary Zoning Permits prior to the operation of a
commercial business. This case was presented to the Board of County Commissioners through the Use by
Special Review application process. The Board of County Commissioners denied the application.
As a result, this case was forwarded to the County Attorney's Office for legal action. The property and
business has continued to grow and become further established. If this substantial change is approved,the
applicant will need to re-submit a new Use by Special Review application and proceed accordingly. There is
an approved Stipulation granting limited continuance of the business until October 15,2004;however,no new
material shall enter the site.

Subject: SCH-25 —Landscaping Materials Yard
Dear Ms. Lockman:
The City of Greeley has reviewed the information supplied to date for the proposed
substantial change of the landscape material yard located a few hundred feet west of
Greeley city limits and has the following comments.
1. It appears the use is already occurring on-site, without benefit of approval by the
County. It also appears the property owners have made investments in the site for a
particular use, despite not having approval for it.
2. The access location and amount of traffic that is anticipated to be generated by this
business use does not appear to fit with the City of Greeley Transportation Master
Plan. Since this site only has access directly to a City of Greeley street, this is a
significant issue.
3. Piles of material in an area designated by both Windsor and Greeley as an
employment corridor is not compatible with anticipated uses in this area. Putting up
extra tall fences to hide piles of material is also not compatible with Greeley's vision
for this corridor.
4. Having a future car lot immediately south of this site does not constitute a substantial
change from the City of Greeley's perspective.

Dear Ms. Lockman:
The Town of Windsor Planning Commission reviewed this referral at its regular meeting of July
21, 2004. The subject property is located within the Town's Growth Management Area (GMA)
and is depicted as High Density Estate Single Family Residential on the Town's Land Use Plan
Map. The Windsor Comprehensive Plan states that the High Density Estate Single Family
Residential land use depiction provides for, "...single-family residential detached homes at very
low densities at a minimum density of one dwelling unit per acre." This land use depiction is
consistent with the existing surrounding residential land uses to the north.
The adjacent property to the south is depicted as Employment Corridor on the Town's Land Use
Plan Map, which provides for, "...areas of targeted investment centered on gateway
development activities including significant new office, commercial and housing opportunities."
The Town is currently reviewing annexation and master plan applications for the property
immediately to the south of the subject site under the name of Southgate First, Second and Third
Annexations. The application materials indicate that the Southgate Third Annexation "...has
been approved by both [the] Windsor Planning Commission and the Windsor Town Board,"
however, this application has not yet been approved by the Town. The Town Board approved
Resolutions 2004-24, 2004-25 and 2004-26 indicating that the Town intends to annex the
Southgate properties, however, the annexations are currently in the Town's standard review
process and it is anticipated that they will be forwarded to the Planning Commission and Town
Board for action in the future. It should also be noted that, while the subject property does abut
the Southgate Annexation, the northern portion of that property is not anticipated to develop until
sanitary sewer is available to the site. The current plan is to develop that portion of the property
that is immediately adjacent to US 34 and WCR 17 (please see enclosed excerpt from the master
plan concept for Southgate Third Annexation).
With regard to the proposed use, the applicant should be advised that, in the event that contiguity
can be demonstrated and a petition to annex the subject property is submitted to the Town in the
future, the subject use would be required to meet the Town's standards. For example, additional
improvements that the Town typically would require include, but are not limited to: acquisition
and dedication of public right-of-way to the site; paving of the road to the site; paving of all
parking and circulation areas; etc. The Town would also require that all requirements of the
Windsor-Severance Fire Protection District (WSFPD) be satisfactorily addressed including, but
not limited to,the conditions contained in the enclosed July 1, 2004 memo from Mr. Mike Davis,
WSFPD.
The Town of Windsor Planning Commission hereby provides the aforementioned information to
the Weld County Department of Planning Services for consideration in order to determine
whether or not a substantial change has occurred.

The first five conditions are the original requirements and the current requirements follow
the originals.
1. The lot shall have its own access; each access shall be designed to carry a
designed wheel load of I8000pounds (80000 pound gvw) (H2O loading).
2. The access shall be constructed of a permanent all weather road base.
3. Addresses shall be posted clearly on the road fronting the property.
4. Addresses shall be posted clearly on the structures.
5. If any structures are located more than 150' from an approved accessway there
shall be alternative fire protection requirements enforced.
6. This site shall be provided with a minimum of(2) two points of access designed
to our standards.
7. The internal circulation shall meet our standards. We utilize a B-40 turning
template for turning radi etc.
8. This site shall be provided with fire hydrants that are on a minimum of a 6" main
and this system shall be looped and capable of providing 1500 gpm at 20 psi with
a flow duration of 2hrs. Hydrant spacing shall be 300' apart and 150' from
structures.
