WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home n

WHEREAS, a public hearing was held on the 7th day of Sep-

tember, 1983, at 2 : 00 o' clock p.m. for the purpose of hearing the

Lupton, Colorado 80621, requesting a Change of Zone from A (Ag-

ricultural District) to I-1 (Industrial One District) for the

following described parcel of land, to-wit:

North, Range 67 West of the 6th P .M. , Weld t] in
County, Colorado • o

WHEREAS , the petitioner was present, and
WHEREAS, Section 21. 6 . 2 of the Weld County Zoning Ordinance

provides standards for review of such a Change of Zone, and n o

WHEREAS , the Board of County Commissioners heard all the
testimony and statements of those present, has studied the re-
quest of the applicant and the recommendations of the Weld County
Planning Commission, and
WHEREAS, the petitioner has failed to show that the exist-
ing zoning was faulty or that changing conditions in the area
warrant a Change of Zone, and
WHEREAS , the Board of County Commissioners hereby finds that
the petitioner has not met her burden of proof in fulfilling the
requirements of the Weld County Zoning Ordinance for a Change of
Zone.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the petition of Freda
L. Dreiling for a Change of Zone from A (Agricultural District)
to I-1 (Industrial One District) on the hereinabove described
parcel of land be, and hereby is, denied. /

A public hearing was conducted on September 7 , 1983 at 2:00 P. M. , with
the following present:
Chuck Carlson Chairman - Excused

Gene Brantner Commissioner
Norman Carlson Commissioner
Jacqueline Johnson Commissioner
Also present: _
Acting Clerk to the Board, Ibmmie Antuna
Assistant County Attorney, R. Russell Anson
Planning Department Representative, Rod Allison
The following business was transacted:
I hereby certify that pursuant to a notice dated July 20, 1983, and duly
published July 21, 1983, and August 11, 1983, in the La Salle Leader, a public
hearing was held for the purpose of considering the application of Freda L.
Dreiling for a Change of Zone from A (Agriculture) to I-1 (Industrial) . Russ
Anson, Assistant County Attorney, read this proposal into the record. Mr. Anson
stated that this matter had been continued from August 24, 1983. Rod Allison,
representing the Planning Department, read into the record the criteria the
Board should consider concerning this proposal. There was no new testimony
offered at this time. David Pehr, representing his parents, came forward to
offer closing comments regarding their opposition to this proposal. Mr. Gerald
Dreiling, representing the applicant, also came forward and gave comments.
Mr. Dreiling again explained the reasons for this request. After further
TAPE discussion, Commissioner Johnson moved to deny this Change of Zone proposal.
CHANGE Commissioner Johnson stated her reasons for this notion to deny. Commissioner
#83-97 . Brantner seconded the motion and also stated his reasons. The motion carried
by the following vote: Commissioners Johnson, Brantner and N. Carlson voted
aye. Commissioner Martin abstained.
