The Weld County Public Works Department has reviewed this proposal; the project falls under
the purview of the Use by Special Review Standards. Weld County Code, Chapter 23, Article II,
Division 4, Section 23. Our comments and requirements are as follows:
COMMENTS:
WCR 21 is designated on the Weld County Road Classification Plan (FHU) as a local gravel
road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-
way. The road is maintained by Weld County. Pursuant to the definition of SETBACK in the
Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured
from the future right-of-way line.
Usually a plat drawing is on a 24" x 36" Mylar sheet that allows enough room for conditions or
developments standards, sign off block, etc. This sheet would also accommodate existing or
future road right-of-way, property lines, structures, and accesses associated with the proposed
USR in the existing site.
REQUIREMENTS:
Access: The applicant identified the existing access to both residential structures from WCR
21. Utilize this access point.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on
site in such a manner that it will reasonably preserve the natural character of the area and
prevent property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.

Environmental Health Services has reviewed this proposal for a single family dwelling
unit. The application proposes a well as its source of water. The applicant should be
made aware that while they may be able to obtain a well permit from the Office of the
State Engineer, Division of Water Resources, the quantity of water available for usage
may be limited to specific uses.
Also, the applicant should be made aware that groundwater may not meet all drinking
water standards as defined by the Colorado Department of Public Health and
Environment. We strongly encourage the applicant to test their drinking water prior to
consumption and periodically test it over time.
We have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence to the Department of Planning Services,
from the Colorado Division of Water Resources, demonstrating that the well is
appropriately permitted for the multi-family use.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S., as amended.
6. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
7. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.

PR-0030308 was issued for a 1352 square foot manufactured dwelling for use as a medical
hardship dwelling. This permit received final inspection approval.
1. This building may continue in its present use as a "dwelling unit"which is a " single unit
providing complete, independent living facilities for more than one or more persons, including
permanent facilities for living, sleeping, eating, cooking and sanitation." Use other than a R-3,
"single family dwelling" may require other code requirements as determined by the 2004
International Building Code.

Subject: USR-1463 Referral
Upon review of my computer and files, an active Zoning Violation was noted (VI-0200694). This violation was
initiated as a result of failure to re-justify the mobile home through ZPMH-2232 as a"Medical Hardship". This
case has not been presented to the Board of County Commissioners through the Violation Hearing process as
of yet.
In similar situations, the Recorded Exemption process would be strongly recommended; however, the
applicants indicated that they were not interested in this process. Therefore, if the Use by Special Review is
approved and once the plat has been recorded, the violation (VI-0200694)will be closed.
If the Use by Special Review application is denied by the Board of County Commissioners,a reasonable time
frame will be established prior to the continuance of the violation process.
