March 31, 2004 Board of County Commissioners 915 10"' Street, First Floor Greeley, CO 80631 Dear Board of County Commissioners & Duke Energy Field Services: My father recently passed away and I have been in the process of picking up where he left off. One of his concerns was the development and construction of any vertical structures that might be part of this Mineral Resource Development Facility Plan. I have had our Consulting Engineer, Mr. Charles Ellis, take a look at these plans (see attached letter) and I have interviewed Mr. Joe Kuchinski of Duke Energy Field Services and confirmed that there is going to be a structure that might interfere. Duke Energy Field Services is planning to erect a 110 foot, steel, cylindrical tower, about 525 feet from KFKA/BROADCAST MEDIA, LLC's current broadcast towers. Being that KFKA/BROADCAST MEDIA, LLC is licensed by the Federal Communication Commission (FCC), we are required to maintain exact signal parameters, so as not to effect other radio stations at the 1310khz frequency. A steel tower of this height could very well effect our licensed parameters. Failure of KFKA/BROADCAST MEDIA, LLC to maintain these parameters would result in fines upward of $250,000 and a mandate that immediate corrections be made. KFKA/BROADCAST MEDIA, LLC does have ways to monitor its current signal output and will take field measurements before, during and after the construction of the Duke Energy Field Services tower. If these measurements are outside our legally mandated parameters, once the tower is constructed, it could cost at least $60,000 to have an engineer correct these parameters. It is our suggestion that Duke Energy Field Services include, in its bid for construction of this tower, a detuning system. Company's that construct these towers on a regular basis should be well aware of these devices and I can provide some references from my Engineer for detuning devices. IR.;T March 30, 2004 Mr. Justin Sasso General manager, ICFICA-AM 820 11th Avenue Greeley, CO 80631 Dear Mr. Sasso: Any change in structures near an existing AM antenna system can cause distortion in the field of the radiated radio frequency energy. In the case of commercial broadcast facilities, that change may affect the ability of listeners to receive the station adequately. In addition, when the AM facility broadcasts directionally as is the case with KFKA at night, the change in the field may cause the facility to no longer meet the Federal Communications Commission's requirement for interference protection to other AM facilities or the station's requirement to provide coverage to populated areas. Duke Energy Field Services desires to modify their existing Mineral Resource Development Facility. That modification will include a steel tower, 110 feet tall near the KFKA directional facility. While unlikely, those structures could affect the radiation pattern and coverage of KFKA. At a minimum, several field point sample values should be taken on the daytime and nighttime KFKA AM arrays before construction. After construction, the same points could be sampled to determine if the construction of the Duke Energy facility has influenced the radiation pattern. An AM antenna array, especially a directional one, can be costly to correct once a pattern becomes out of tolerance. A clear understanding of the economic responsibilities of all parties is very helpful before issues occur. Sincerely, Charles F.
