Ladies and Gentlemen:
Anadarko E&P Company LP ("Anadarko E&P"), formerly known as Union
Pacific Resources Company, and Anadarko Land Corp. ("Anadarko Land"), formerly
known as Union Pacific Land Resources Corporation, have asked me to respond on their
behalf to a notice of a public hearing to be held on February 3, 2004 concerning an
application that has been filed by Duke Energy ("Duke") for a site specific development
plan and amendment to a special use permit for a mineral resources development facility
("Application") to be located on property described as a portion of the SW/4 of Section
35, Township 4 North, Range 66 West in Weld County ("Property").
The Anadarko entities own all of the minerals that underlie the Property.
Anadarko E&P owns all of the oil and gas that underlies the Property, and Anadarko
Land owns the minerals other than the oil and gas, as well as a reversionary interest in the
oil and gas. A predecessor company to Anadarko E&P has given an oil and gas lease that
includes the Property, interests in which have been assigned to Kerr-McGee Rocky

Mountain Corporation ("Kerr-McGee"). Kerr-McGee operates four producing wells in
the SW/4 of Section 35.
I understand that the purpose of the Application is for Duke to amend a special
use permit to allow it to expand the compression facility at its oil and gas processing
plant. I understand further that the footprint for the property included in the existing
special use permit is not being expanded by the Application.
Based on the understanding by the Anadarko entities that the purpose of the
Application is to expand a portion of a plant that has been previously constructed on the
Property and that no additional lands are included in the amendment to the Application,
the Anadarko entities have no objection to the Application.
