The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance . 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows : a. The proposal is consistent with the Weld County Comprehensive Plan. b. The proposal is consistent with the intent of the Agricultural Zone District. c. The uses which would be permitted would be com- patible with the existing surrounding land uses and with future development of the surrounding area as permitted by the existing zoning. d. No overlay districts affect the site . e. Use by Special Review Operation and Design Stand- ards provide adequate protection of the health, safety and welfare of the neighborhood and County. The attached Standards for Use by Special Review be adopted and placed on the Use by Specail Review plat prior to recording. 2 . No building or electrical permits shall be issued for the Use by Special Review Permit area until the Stand- ards for the Use by Special Review have been placed on the Use by Specail Review plat and the plat has been delivered to the Department of Planning Services Office . 3. The final mylar plat shall be corrected to show an additional fifteen (15) foot road right-of-way south of the existing south right-of-way line on State Highway 60 . The permitted uses shall be a dairy operation for two thousand (2,000) cows and facilities as described in the submitted application materials on file in the Weld County Department of Planning Services office. 2. An additional fifteen (15) feet shall be reserved for future right-of-way south of the existing South right-of-way on State Highway 60. The total right-of-way south of the centerline of State Highway 60 shall be seventy-five (75) feet. 3. All stock pen run off shall be controlled and confined within the boundaries of the subject property and contiguous property owned by the applicant as identified in the submitted application materials. 4. The liquid waste lagoon as identified on the applicant's Use by Special Review Plat shall be approved by the Colorado Department of Health, Water Quality Control Division. A letter of approval shall be forwarded to the Department of Planning Services thirty (30) days after final approval of the Use by Special Review by the Board of County Commissioners. 5. The applicant shall comply with the Design Standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 6. The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq. , of the Weld County Zoning Ordinance. 7. Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated hereon and all applicable Weld County Regulations. 8. The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 9. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. Prior to this hearing, the Chairman Pro-Tem, John Martin, stated that the applicant could continue this hearing to another date since only 4 Commissioners were present. Russ Anson, Assistant County Attorney, read this request into the record. Mike Mullen, representing the Planning Department, read the favorable recommendation from the Planning Commission along with the nine Operation Standards. Glenn Billings, representing Andrew Veeman, stated that this is an existing dairy and the Veemans have made a new applica- tion to correct discrepancies between the existing facilities and the original permit. This application also increases the number of caws allowed. No objections to this application were voiced. Commissioner N. Carlson moved to approve this request for a Use by Special Review for a dairy operation for Andrew Veeman, to include the Operation Standards as rewiu:ended. Commissioner Brantner seconded the motion. Commissioner Brantner also commented that, on a previous inspection in the area, he had noted the work which had bccn done on the holding ponds at this location. The motion carried unanimously. Champlin is the owner of the oil and gas rights for the entire Property and Champlin has given a lease for a portion of the property to Amoco Production Company. On November 30, I spoke with both Lee Morrison of the Office of the County Attorney and Rod Allison of the County Planning Department and each assured me that the grant of a special review permit to the Veemans would not interfere with the rights of Champlin or Amoco to explore for and to produce oil and gas and that oil and gas operations and production would continue to be a use by right on the Property.
