NOTICE IS HEREBY GIVEN that a Petition for Annexation of territory hereinafter
described has been presented to the Board of Trustees of the Town of Eaton, Colorado and found
to be in apparent compliance with the applicable provisions of law and The Board has adopted a
Resolution to set a public hearing to be held at Eaton Town Hall on July 15, 2004 in the
Auditorium at 223 First Street in Eaton, Colorado to determine if the proposed annexations
complies with the applicable requirements of law.
The Resolution adopted by the Town Board for such purpose is in words, letters, and
figures as follows:
RESOLUTION NO. 2004-05
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF EATON:
1. That annexation proceedings be initiated upon a Petition for Annexation of the
following described territory to the Town of Eaton, which Petition appears to be in substantial
compliance with the applicable provisions of Chapter 31,Article 12, Colorado Revised Statutes.
Description of territory proposed for annexation:
Anderson Annexation: Approximately 27.3 acres with the
Hickman Industrial property on the west boundary and Weld
County Road 72 on the south boundary located south of the
Eaton Industrial Park.
2. Therefore, 7 o'clock p.m. on July 15, 2004, is hereby established as the time, and the
Town Hall at 223 First Street in Eaton, Colorado as the place, for a public hearing to be held
before the Town Board to determine if the proposed annexation complies with Sections 31-12-
104 and 31-12-105, C.R.S. or such parts thereof as may be required to establish eligibility under
Part 1 of Chapter 31, Article 12 of said statutes.

ANNEXATION IMPACT REPORT
ANDERSON ANNEXATION
The proposed Anderson Annexation consists of 27 acres, which according to the
Town of Eaton's Comprehensive Plan, is planned for commerciallindustrial uses. There
are no immediate plans for development of this property; so initial zoning would be
agriculture as defined by Town ordinance. Eventually this property would be a natural
extension of the Eaton Industrial Park.
As required by state law this impact report includes the following information:
1)The enclosed map, which shows the present and proposed Town boundaries.
There are presently no streets or major water and sewer lines owned by the Town on the
property. When the property is developed,a development agreement addressing these
issues and others will have to be approved by the Town. Weld County Road 72 borders
the property on the south side. The right-of-way is not included in this annexation
request.
2)An annexation agreement is not a part of this process since there are no
immediate plans for development.
3) When the property is developed an agreement on financing improvements by
the eventual developer,including raw water, will have to be reached before construction
can begin.
4)This property is included in the following districts:
a)North Weld County Water District
b)Eaton School District Re-2
c) Eaton Fire Protection District
d)Aims Community College
e) Weld County
f)Northern Colorado Water Conservancy District
5) With the commercial/industrial use of this parcel,the schools will not be
impacted by new students but will have the benefits of the increase in their tax base.

PETITION FOR ANNEXATION
The undersigned, in accordance with Article 12, Chapter 31, CRS, as amended,
hereby petition the Town Board of the Town of Eaton, Colorado, for annexation to the
Town of Eaton the unincorporated territory more particularly described below, to be
known as Anderson Annexation [NAME OF ADDITION], and in
support of said Petition, your petitioners allege that:
I) It is desirable and necessary that the following described territory as shown in
Attachment A, be annexed to the Town of Eaton;
2) Not less than one-sixth (1/6) of the perimeter of the area proposed to be annexed
is contiguous with the Town of Eaton, Colorado;
3) A community of interest exists between the territory proposed to be annexed and.
the Town of Eaton, Colorado;
4) The territory proposed to be annexed is urban or will be urbanized in the near
future,
5) The tenitory proposed to be annexed is integrated or is capable of being
integrated with the Town of Eaton, Colorado;
6) The signatures of the Petition comprise one hundred percent(100%)of the
landowners of the territory to be included in the area proposed to be annexed and
said landowners attesting to the facts and agreeing to the conditions herein
contained will negate the necessity of any annexation election;
7) No land held in identical ownership, whether consisting of one tract or parcel of
real estate or two or more contiguous tracts or parcels of real estate:
a, Is divided into separate parts or parcels without the written consent of the
landowner or landowners thereof, unless such tracts or parcels are separated
by a dedicated street, road or other public way;
b. Comprising twenty (20) acres or more and which, together with the buildings
and improvements situated thereon has an assessed value in excess of Two
Hundred Thousand Dollars ($200,000.00) for ad valorem tax purposes for
the year preceding the annexation, is included within the territory proposed
to be annexed without the written consent of the landowner or landowners;
8) No part of the area proposed to be annexed is more than three miles from a point
on the municipal boundary, as such was established one year before this
annexation will take place;
9) The area proposed to be annexed comprises:
Less than ten (10) acres
X Ten (10) or more acres (An Impact Report prepared by the Town is
required per Section 31-12-108.5, CRS, as amended)

11) The mailing address of each signer, the legal description of the land owned by
each signer and the date of signing of each signature are all shown on this
Petition;
12) Accompanying this Petition are twenty (20) prints of the annexation map
containing the following information:
a. A written legal description of the boundaries of the area proposed to be
annexed,
b. A map showing the boundary of the area proposed to be annexed, such map
prepared and containing the seal of a registered engineer or land surveyor;
c. Within the annexation boundary map there is shown the location of each
ownership tract in unplatted land, and if part or all of the area is to be platted,
then the boundaries and the plat number of plots or of lots and blocks are
shown.,
d. Next to the boundary of the area proposed to be annexed is drawn the
contiguous boundary of the Town of Eaton, and the contiguous boundary of
any other municipality abutting the area proposed to be annexed;
e. The dimensions of the contiguous boundaries are shown on the map.
13) The territory to be annexed is not presently a part of any incorporated city, city
and county, or town;
14) The undersigned agree to the following conditions, which shall be covenants
running with the land, and which shall, at the option of the Town, appear on the
annexation map:
a. Water rights shall be provided pursuant to Town ordinance and/or
annexation agreement;
b. The owners shall participate in providing drainage plans and improvements
and pay went of a unit drainage fee as may be required by the Town for the
area;
c. The undersigned hereby waive any and all "vested rights"previously created
pursuant to Section 24-68-103, CRS, as amended;

d. The undersigned and the Town may enter into a Pre-Annexation Agreement
prior to the effective date of this annexation, which agreement shall be
additional conditions as effectively as if set forth in this Petition.

specific development plan approved by Weld County, Colorado
A site specific development plan has been approved by Weld
County, Colorado, which has created a vested right.

Reference: Proposed Anderson Annexation, consisting of 27.278 acres located in the
Southeast Quarter of Section 6, Township 6 North, Range 65 West, Weld County
Colorado.
Dear Mr. Carsten:
Regarding the above captioned parcel of land, the following points indicate a few of the
reasons and potential benefits this Annexation would offer to The Town of Eaton.
• The property has direct access to Weld County Road #72 on the South and Weld
County Road #39 on the East. The property to the North has recently been
annexed, this would give the Town the opportunity to connect to WCR#72 and
WCR#39 directly, and possibly be able to provide a road from WCR#72 to the
Eaton Industrial Park. Annexing this property would also enhance the visibility
and access to previously annexed properties that are located between US HWY
85 and WCR #72 which in turn, enhances possible property profiles, as well as
potential future business exposure.
• This parcel of land has stand-alone value, as well as many beneficial elements that
may make the adjacent properties around it more desirable due to increasing
accessibility, visibility and would give the Town a greater acreage to develop a
better overall plan for the area that may be more
• The annexation of this property would have minimal annexation expenditures for
the Town of Eaton.
• The Weld County EDAP has indicated that this and the surrounding properties
would be a good location for new businesses wanting to move into the Eaton area.
• Annexing this property would give the Town of Eaton the opportunity' to create an
overall development plan for this area, which in turn, would enhance the
developments that are already in place in this area , mainly the Eaton Industrial
Park.
