RE: APPROVE QUIET TITLE DECREE AND AUTHORIZE COUNTY ATTORNEY TO
SIGN CONSENT - BIRT VERSUS ADDELMAN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been named as a party defendant in Birt v Addelman
04-CV-243, Weld District Court because it may claim an interest in land due to public roads and
road rights-of-way in the vicinity of Block 7 in the Town of Hereford, County of Weld, State of
Colorado, and
WHEREAS, the Department of Public Works has reviewed the proposed decree and
recommends accepting said description as consistent with the lines of possession of the Evans
Estate and not in conflict with Piper Street, as it was built and is currently maintained, nor in
conflict with the right-of-way for Broadway, and
WHEREAS, after review, the Board deems it advisable to accept said Decree Quieting
Title, a copy of which is attached hereto and incorporated herein by reference and authorize the
Office of the County Attorney to disclaim any interest in the parcel as described in the Decree on
behalf of the Board, except for the lien for ad valorem taxes or special assessments, if any.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the acceptance of said Decree Quieting Title, Birt v Addelman
04-CV-243, Weld District Court be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Office of the County Attorney is
authorized to disclaim any interest in the parcel as described in the Decree on behalf of the
Board, except for the lien for ad valorem taxes or special assessments, if any.

THIS COURT FINDS THAT:
1. Each Defendant herein has been properly served.
2. Anthony V. Mello, Attorney at Law, has been heretofore appointed and has appeared
for any and all Defendants who are in the military service, as defined by the Soldiers
and Sailors Relief Act of 1940, as amended.
3. This Court has personal and subject matter jurisdiction in this case.
4. The allegations of the Complaint are true.

monumented at each end by a W' steel pin in concrete, to bear North 38 31'45"East, and
with all bearings contained herein relative thereto;Beginning at the Easterly Range Point of
Block 7, from which the Southeast corner of said Section 27, being a'A"rebar with 3_1/4"
aluminum cap L.S. 22098, bears South 68 54'44"East, a distance of 2549.90 feet; Thence
North 51 28'18"West, along the Northeasterly Range Line of Block 7, a distance of 257.50
feet to a 5/8"x 30"rebar with red plastic cap stamped P.L.S. 27269; Thence South 38 31'45"
West, a distance of 286.68 feet to a point 10.00 feet Northeasterly of a witness corner,being
a 5/8"x 30" rebar with red plastic cap stamped P.L.S. 27269; Thence South 51 28'15"East,
a distance of 375.91 feet from which a witness corner being a 5/8"x 30" rebar with red
plastic cap stamped P.L.S. 27269 bears South 17 23' 22" West, a distance of 10.66 feet;
Thence North 17 23'22"East, a distance of 296.65 feet to a point on the Northeasterly Range
Line of Block 6 being monumented by a 5/8"x 30" rebar with red plastic cap stamped P.L.S.
27269; Thence North 51 28'18"West along said Range Line, a distance of 12.42 feet to the
True Point of Beginning. Containing 2.05 Acres, M/L.
All as shown on the plat recorded under reception No. Weld County
Records. ,
THAT FEE SIMPLE TITLE in and to said real property be and the same hereby is quieted in
the Plaintiff, and each of the Defendants has no right, title or interest in or to the said real
property or any part thereof, and that they are forever enjoined from asserting any claim, right,
title or interest in or to the said real property or any part thereof.
