HomeMy WebLinkAbout20043374.tiff RESOLUTION RE: APPROVE SECOND AMENDED RESUBDIVISION, 2ND AMRS#1033, FOR LOT LINE ADJUSTMENT-ROBERT SHELLENBERGER, JUDITH GREEN, CAROL LOWE, AND LARRY ARMFIELD WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board of County Commissioners held a public hearing on the 22nd day of November, 2004, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Robert Shellenberger and Judith Green, 20627 Catclaw Court, Johnstown, Colorado 80534, and Carol Lowe and LarryArmfield, 20645 Catclaw Court,Johnstown, Colorado 80534, for Second Amended Resubdivision, 2nd AMRS#1033, for a Lot Line Adjustment, on the following described real estate, to-wit: Lots 2, 3, and 4, Block 3, Northmoor Acres, 2nd Filing;being part of the W1/2 of Section 24,Township 4 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, the applicants, Robert Shellenberger and Judith Green were present at said hearing, and WHEREAS,Section 24-5-30 of the Weld County Code provides standards for review of said 2nd Amended Resubdivision, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present,studied the request of the applicant and the recommendation of the Weld County Department of Planning Services and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24-5-30.B of the Weld County Code. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24-5-30.C.3 of the Weld County Code, including specifically: a. Section 24-5-30.C.3.a -- The lot line revision complies with the approved recorded final plat. The Resubdivision will create two lots out of the three that are existing. The change will not adversely affect existing utility easements, building setbacks, access or drainage. Planning staff concurs that the proposal will have little, if any, affect to the surrounding properties. b. Section 24-5-30.C.3.b -- The application complies with the adopted rules, regulations, and ordinances currently in force and affecting the subdivision. Prior to Recording the Resubdivision Plat: A. All sheets of the plat shall be labeled 2nd RS-1033, Resubdivision of Northmoor Acres. B. As required by the Weld County Utilities Coordinating Advisory Committee, the plat shall be amended to include a fifteen (15) foot front lot utility easement, twenty(20)foot back lot utility easement, and a twenty(20)foot interior lot utility easement. The interior easement shall be indicated as ten (10) feet on each side of the property line. C. The vicinity map shall be amended to show only the properties included in the Resubdivision at a scale of 1"= 2000'. D. The notes regarding Sewer,Gas and Water, Power,and Telephone shall be deleted. E. In accordance with Section 24-4-40 D.6.j of the Weld County Code, a utility service statement block shall be placed on the plat. F. The applicant shall submit a paper copy of the plat for preliminary approval to the Weld County Department of Planning Services. H. The applicant shall create a digital file of all drawings associated with the Resubdivision application. Acceptable CAD formats are.dwg, .dxf, and .dgn (Microstation); acceptable GIS formats are .shp (Shape Files), Arclnfo Coverages and Arclnfo Export files format type is.e00. The preferred format for Images is .tif(Group 4) ... (Group 6 is not acceptable). A copy shall be submitted to the Weld County Department of Planning Services at the time of Mylar plat submittal. 2. Upon completion of items Conditions of Approval#1.A through#1.G, the applicant shall submit a Mylar plat, along with all other documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by the Department of Planning Services. The plat shall be prepared in accordance with the requirements of Sections 24-4-40.D.6 through D.11 of the Weld County Code. The proposed change incorporates portions of Lots 2 and 3 into Lot 4, as shown on the redrawn plat. Through this change, Lot 4 becomes 2.46 acres and Lots 2 and 3 are combined into one lot of 1.63 acre. The proposed lot line changes greatly enhance both lots, and will preserve the open space and stunning view of the mountains that the lots provide. We are extremely pleased to make these changes, which are mutually beneficial. At the suggestion of Chris Gathman, planner for Weld County Planning and Zoning, we investigated possible restrictions on these lot line changes and find that there are none in the original subdivision plan of 1972, nor in the covenants of Northmoor Acres. We also contacted Bruce Napella , the regional right-of-way manager who informed us that the proposed lot line changes have no impact on the utility easements or access to the greenbelt area adjacent to these lots. In addition, as a courtesy and following the practice of Northmoor Acres, we have informed our neighbors of these changes, and have obtained their approval (please see attached statement). The Department of Planning Services is recommending approval of the application. The proposal is to change the configuration of lot one and the open space area. The applicant will be required to obtain a sign off from the applicable service providers prior to recording the plat. Don Carroll, Public Works, asked if there will be any adjacent lots associated with this or is this the buildible lot? Chris Gathman indicated this is the buildable lot that was originally platted. The intent is to bring more retail to the area. Mr. Carroll asked if the lot could be split into smaller parcels to accommodate multiple users. Mr. Gathman stated the only way would be to amend the final plat to add lots. Don Carroll asked if the Utility Board viewed this as an individual lot therefore, a 10 foot utility easement or larger lot with perimeter easements. Mr. Adams stated he would look at this as a perimeter style easement which is 20 feet. Jerry Atmos asked Mr. Gathman if there was any concern changing the outside easement to the standard 20 feet? Mr. Gathman clarified that it would be along the outsides of lot 1 with 10 foot along the inside and 10 foot on the outside. There is an existing 15 foot easement on the perimeter of the open space area. Mr. Carroll added the outside parcels does not belong to the applicant. The 20 foot would need to be on the inside of the parcel. Don Somer, Qwest, asked for clarification on the open space and if an easement goes through the pond. Mr. Gathman stated the area was a low area and it appears the easement goes through this. Mr. Carroll added there are two ponds on the property, one at the top of the property and one south of the road in the open space. Mr. Carroll added that the applicant needs to include CR 7 1/2 to the west and dedicate the right of way needed as required per the Mixed Use District Transportation map Jerry Adams asked about the 10 foot easement down the center and if it is 10 feet on both sides. Mr. Carroll stated it normally is 10 foot on both sides. Mr. Adams indicated there would need to be an additional 10 feet on the south side in the open space area. The Department of Planning Services is recommending approval of the application. This proposal is to move the lot lines between Lots 1 and 2 of Petersburg Minor Subdivision and the community ditch. There is no current access from the east side of lot 2 to the west side. This will enable them to access the west side of the ditch from lot 1. There will be a condition for a utility sign off. The site already has existing utilities. The existing 15 foot easement would remain. Don Carroll, Public Works, added there is 60 feet of right of way on CR 10. The 60 foot runs to the north to the cul de sac. The road is 12-16 feet in width as well as the right of way. There is adequate easements to accommodate any improvements. This is a lot line adjustment, everything is already built out. Mr. Gathman stated the easements can be moved with the lot line that will be moved. This would keep this consistent. If there are utilities in those easements it will be indicated on the required sign off. Mr. Carroll recommended the sign off from utilities rather than relocating the utility easement. LOCATION: West of and adjacent to Catclaw Court and north of and adjacent to Northmoor Drive Sheri Lockman, Department of Planning Services, presented Case 2n°RS-1033, reading the recommendation and comments into the record. The Department of Planning Services is recommending approval of the application. The line adjustment will make two lots out of what was three lots. There was only one issue regarding notes on the plat indicating Qwest not being totally in the rear easement and revision of that easement would be required. The actual meaning is unclear to staff and the applicant. Don Carroll indicated it seemed as though the easement ran through the open space. Ms. Lockman indicated the applicant is showing the easements on the plat. Mr. Somer asked what the 50 foot easement was for in the corner. Ms. Lockman indicated the applicant was not aware of its use. Mr. Schellenberger indicated the open space was all green belt. There is nothing located in this open space and never has been. Mr. Carroll added that if the open space is an easement there may be a note allowing utility companies to cross for access purposes. Don Carroll clarified that the applicant is taking lot lines between lot 3 and lot 4, sliding the line down to make two lots out of lot 3. Ms. Lockman indicated that was correct. Mr. Carroll asked if there were any structures that encroached upon the 50 foot utility easement. Mr. Schellenberger indicated there were not structures. Ms. Lockman stated the applicant will need to get a sign off from the utility providers as a condition of approval. Mr. Carroll asked if there were structures on both lots as of this time. Ms. Lockman provided an aerial photo indicating the locations of the homes on the lots. Mr. Carroll asked if lot 2 was affected by the shift of lot lines. Ms. Lockman provided clarification to the members of what the old lines looked like as compared to the new lines. Ms. Lockman indicated that if the utility providers signatures will be enough they will continue with that condition. If there is a concern for the Qwest line there could be a locate for those lines. Mr. Adams indicated that if there was a signature block with all the effected utility companies that would be enough. Jerry Adams asked Ms. Lockman if it would save some time if the easements that are standard were asked for. Ms. Lockman stated that if the Board felt they were needed, but if they are not necessary it would not need to be done. Mr. Adams indicated his concern was if the utility companies that need to sign off will not sign because the easements are not there. Mr. Adams asked the applicant if it would cause any undue stress if the easements were requested. Mr. Schellenberger indicated that would be fine with him since there was no intentions of adding to the site. Mr. Schellenberger added the neighbors may have a fence that would be in conflict. Mr. Carroll added that this would supply an easement to the 50 foot location. Mr.Adams added his intent was to make it smoother for the applicant in obtaining signatures from the utility companies. Don Somer, Qwest, asked about the line in the easement and which lot it affected. Ms. Lockman indicated staff was unsure of what the surveyor was referring to. Mr. Schellenberger indicated that on lot 2 at the corner there is a telephone box and on lot 3 near the road is another telephone box. Mr. Schellenberger added there has never been anything on the 50 foot space. Mr. Carroll indicated the 50 foot could have been an original easement for access from lot 2 to lot 3 or lot 4. It could be dedicated space to gain access to the open space. Ms. Lockman found some information on the original Northmoor plats that indicated the easements were for pedestrian/equestrian uses. Ms. Lockman added if a utility easement was put in the intent would not be for pedestrian/equestrian but can be limited to utility only. Don Carroll indicated the only thing the Board is asking for is additional back line utility easement which would be 20 feet. Mr. Adams asked whether the 15 foot front lot utility easement was needed. Mr. Somers indicated that if all the easements were placed on the lot it would really serve no purpose since it does not connect any further than the existing lots. Ms. Lockman agreed, they will not be contiguous. Mr. Adams added that wherever there is easement next to county road right of way they can always be used. Don Somer moved to approve the case with the additional easements that would bring the lot up to standard. Brent Shafranek seconded motion. Motion carried.
