Our comments and requirements are as follows: COMMENTS: State Highway 119 is adjacent to the property access from the facility to utilize the state highway. Our most recent traffic count associated with State Highway 119 reflects 15,500 vehicles as an average daily traffic volume between WCR 1 (County Line Road) and WCR 1-25. REQUIREMENTS: cess: The Colorado Department of Transportation (CDOT) has jurisdiction over all access to the state Highways. Please contact Gloria Hess-Idler or Tess Jones at the Greeley office to verify the access permit or for any additional requirements that may be necessary to obtain or upgrade the permit. !Site Plan: The applicant should identify on the plat drawing the state highway right-of-way or future right-of-way that may be associated parallel to the proposed USR. Off-Street Parking and Circulation: The off-street parking and circulation including the access drive shall be surfaced with gravel, asphalt, concrete, or the equivalent and shall be graded to prevent drainage problems. The facility is located within the Mixed Use Development Area; therefore, all new development would be required to provide paved parking circulation throughout the proposed USR as the existing school and class rooms proposed to be on site. The minimum requirement to start is a gravel surface to accommodate parking and circulation at such time in the future funds are available to upgrade the facility with paved parking and a circulation pattern including the access drive. This would conform to the Mixed Use Development Standards. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. AmUSR-851 There is an existing building permit to construct a 2856 square foot building on an unfinished basement for the Youth School. This permit has had some, but not all, required inspections conducted and approved. 1. A building permit shall be obtained for the conversion of the Youth School into a dwelling. 2. A plan review is required. Details shall be submitted to the Building Inspection Department to explain all structural and life safety aspects of this conversion. A floor plan shall be submitted showing the proposed room arrangement. Two copies of these details and floor plans are required. 3. This building shall conform to the requirements of the codes adopted by Weld County at the time of permit application. Current adopted codes include the 1997 Uniform Building Code; 1998 International Mechanical Code; 1997 International Plumbing Code; 2002 National Electrical Code and Chapter 29 of the Weld County Code. Weld County intends to adopt the 2003 International Building, Residential, Mechanical, Plumbing and Fuel Gas Codes on or about March 1, 2004. 4. Building height, protection of walls and openings and the separation of buildings of mixed occupancy shall be in accordance with the Building Code. Setback and offset distances shall be determined by the Zoning Ordinance. 5. Building height shall be measured in accordance with the Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Section 23-3-250.A.1 addresses Stormwater Management. The application materials are unclear as to how this issue is addressed. The application shall contact the Department of Public Works (Don Carroll 970 356-4000 x 3750) to develop the site to handle to 100-year storm event, including the development of a retention facility, as applicable. Section 23-3-250.A.2 address Parking. "Sufficient screened, off-street, paved parking areas shall be provided in the Commercial Zone Districts to meet the requirements of employees, company vehicles, visitors and customers of the Uses Allowed by Right and accessory uses. " The plan has not delineated parking for this facility. Given that there are twenty employees and two school vans, the minimum parking for this facility shall be twenty-five spaces, one of which shall meet the requirements of the Americans with Disabilities Act for van accessible parking. The required parking will accommodate all staff and visitors utilizing the facility. Appendix 23-A of the County Code addresses the design requirements for off-street parking. Section 23-3-250.A.3 addresses Street Access. The applicant shall demonstrate a safe and approved access. Appropriate language shall be included on the plat delineating the access to this parcel. The applicant shall submit written evidence from the Colorado Department of Transportation to the Department of Planning Services stating that an approved access permit is in place for this facility. The internal circulation within the parcel is unclear and not delineated. The Department of Public Works (Don Carroll 970 356-4000 x 3750) and Mountain View Fire Protection District (LuAnn Penfold 303 772 0710) shall be contacted to verify that the internal circulation meets the appropriate code and standard. Section 23-3-250.A.4 address offset and setback of structures from adjacent property lines. The existing structures and all new structures shall be required to meet this standard. Should existing structures on site fail to meet the required setback and offsets a Non-Conforming Use of a Structure file will be established, as applicable. Section 23-3-250.A.5.a addresses Required Landscape Areas. "That portion of a Lot which abuts a public or private street right-of-way shall be landscaped for a distance of ten (10) feet, measured at a right angle from the Lot line towards the interior of the Lot. Driveways may pass through the required landscaped areas." The applicant states that the on-site landscape treatment exists in the form of mature vegetation, consisting of large deciduous trees and understory plant material. Given the use of the site and the location, a Landscape Plan is not required. The site shall conform to Section 23-3-250.6.7, Property Maintenance specific to noxious weeds and the height of all on-site grasses having a height of less than 12 inches. Section 23-3-250.A.6 address Trash Collection. "Areas used for storage or trash collection shall be screened from adjacent public rights-of-way and adjacent properties. These areas shall be designed and used in a manner that will prevent wind or animal scattered trash." The trash enclosure(s) shall be delineated on the plat and meet or exceed this standard. Section 23-3-250.A.7 addresses water supply and Section 23-3-250.A.8 address sewage disposal. The application materials state that water is provided by Left Hand Water District and that effluent flows are handled by St,. Vrain Sanitation District. Given the proposed additional structures to be placed on site, the applicant shall provide written evidence that an additional tap for each service is not required. Further, the applicant shall provide written evidence from the Mountain View Fire protection District stating that additional yard hydrants will not be required for this facility. Section 23-3-250.A.9 addresses outside storage. The application materials state that there will be no outside storage. Should outside storage be utilized, all outdoor storage of vehicles, equipment or materials when permitted shall be screened from public rights-of-way and all adjacent properties.. Section 23-3-250.6 addresses operation standards for this facility. The Department of Public Health and Environment shall address these elements. Section 23-3-250.B.6 addresses lighting. The applicant shall address the issue of on-site lighting, including security lighting in applicable. "... any lighting ... shall be designed, located and operated in such a manner as to meet the following standards: sources of light shall be shielded so that beams or rays of light will not shine directly onto adjacent properties...." The applicant shall provide evidence to the Department of Planning Services that this standard has been addressed and met. The applicant has not delineated any on-site sign. If an on-site sign is desired, the signs shall adhere to Section 23-4-90.A and .6 of the Weld County Code. The sheriff's office would however be willing to provide a program entitled Crime Prevention Through Environmental Design to the developer. This program reduces the likelihood of criminal activity at a specific location by"hardening" it to crime. The Sheriff's Office lacks the ability to absorb any additional service demand without the resources recommended in the multi-year plan provided to the Board of County Commissioners or as indicated by growth not considered at the time the plan was developed. The applicant proposes to house an additional 11 children on site and to add a modular building to be used as a school for the children living there. The AHY site, 145 State Highway 119 East, is a Weld County enclave surrounded by the City of Longmont. Under City Council's direction, Phil DelVecchio, Community Development Director, has had preliminary annexation discussions with Dave Lack of the AHY main office in Wheatridge and Jean Osborne, AHY Director. Ms. Osborne has expressed her support for being annexed as long as it would not preclude their future expansion plans. Accordingly, the following comments are offered. AHY submitted a Notice of Inquiry to the City in July that asked whether the City of Longmont wanted the site to develop within the City. The applicant acknowledged the potential of annexation and implied that the proposed application to Weld County was to expand the special use permit allowing a Residential Child Care Facility on the site and amend the site plan to acknowledge the removal of some buildings. No new buildings were proposed. The City supported the request to expand the child care facility and remove the buildings. The application that has been submitted includes the expansion of the special use permit as described above, but also includes a new modular building to be used as a school. While the City of Longmont doesn't oppose this use of the site, it would be preferable that long term development of the site be addressed. Specifically, it would be helpful to plan future pedestrian and vehicular access to the site. Although a traffic study was not submitted with the application, a study could analyze the impact of further site development on State Highway 119 as well as safe access to and from the site. Additionally, as community amenities develop around the site, it is expected that residents would be inclined to use them. Safe pedestrian access to these amenities should be planned and provided. This site has a scenic entryway designated along its southern edge. The Longmont Area Comprehensive Plan (LACP) recommends establishing, preserving, and enhancing scenic entryways along major highways entering the City(Policy P-3.5). Again, while this application does not need to address the scenic entryway, long term planning for it is encouraged. Finally, per the Intergovernmental Agreement between the City of Longmont and St. Vrain Sanitation District, this property will be provided sanitary sewer service by St. Vrain Sanitation District. Should this property be annexed, the property may be required to change water service providers from Lefthand Water District to the City of Longmont. The City recommends that the applicant install all required water taps through Lefthand, then complete a tap exchange between Lefthand and the City prior to the annexation process. The property named is within the boundaries of the Mountain View Fire Protection District and receives service from the District. The Fire District has the following comments regarding the development plan and special review: • The existing two-story building is currently being used as a childcare and has been for several years. An additional building (the Monarch House) was constructed in the fall of 2002 but the fire sprinkler system and fire alarm system has not been completed or inspected. Although the building is believed to be unoccupied at this time, it has not been inspected or approved by the Fire District for any type of use. • A final inspection of the Monarch House will be required by a member of the Fire District before that building may be occupied. • All additional buildings, whether constructed or installed, must be designed, and constructed in accordance with the provisions of the Uniform Fire Code, as ratified by the Weld County Commissioners. All plans for future construction or installation of buildings must be submitted to the Fire District for review and approval prior to the issuance of building permits. • Fire apparatus must be provided so that apparatus may reach within 150 feet of all portions of buildings as measured around the exterior of the building. • Water supply for fire protection must be provided for any new structures built or installed on the property.
