The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center,
Greeley, Colorado, June 14, 2004, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were
present, constituting a quorum of the members thereof:
Commissioner Robert D. Masden, Chair

MINUTES: Commissioner Long moved to approve the minutes of the Board of County Commissioners
meeting of June 7,2004,as printed. CommissionerJerke seconded the motion,and it carried unanimously.
AMENDMENTS TO AGENDA:Chair Masden added item#13-Consider Cancellation of Board of County
Commissioners Meeting Scheduled for June 30, 2004
PUBLIC INPUT: No public input was given.
CONSENT AGENDA: Commissioner Long moved to approve the consent agenda as printed.
Commissioner Geile seconded the motion, and it carried unanimously.
PRESENTATIONS:
ROCKY MOUNTAIN STAMPEDE PROCLAMATION FOR 2004(RESCHEDULED FROM 06/07/04): No
one was present from the Stampede to present this proclamation.
WARRANTS: Donald Warden, Director of Finance and Administration, presented the following warrants
for approval by the Board:
All Funds $647,035.52
Commissioner Long moved to approve the warrants as presented by Mr. Warden. Commissioner Geile
seconded the motion, which carried unanimously.

NEW BUSINESS:
CONSIDER EXPENDITURE AUTHORIZATION MODIFICATION#1 RESCINDING FISCAL YEAR 2004
ADULT AND DISLOCATED WORKER FUNDS AND AUTHORIZE CHAIR TO SIGN: Walt Speckman,
Director of Human Services, stated this modification is to close out the Adult and Dislocated Worker
Programs for 2004, and the amounts listed in his memorandum will be returned. Commissioner Geile
moved to approve said modification and authorize the Chair to sign. Seconded by Commissioner Long,
the motion carried unanimously.
CONSIDER EXPENDITURE AUTHORIZATION FOR WIA 25 PERCENT DISLOCATED WORKER
ENHANCEMENT FUNDS AND AUTHORIZE CHAIR TO SIGN: Mr.Speckman stated grant, in the amount
of $50,734, will be used to deliver core, intensive, and training services to dislocated workers.
Commissioner Geile moved to approve said authorization and authorize the Chair to sign. Seconded by
Commissioner Long, the motion carried unanimously.
CONSIDER TWO EXPENDITURE AUTHORIZATION MODIFICATIONS #2 FOR TRANSFER OF
WORKFORCE INVESTMENT ACT FUNDS AND AUTHORIZE CHAIR TO SIGN: Mr. Speckman stated
these two modifications transfer Dislocated Worker funds and corresponding administrative funds to the
Workforce Investment Act Adult Program. Commissioner Long moved to approve said modifications and
authorize the Chair to sign. Seconded by Commissioner Geile, the motion carried unanimously.
CONSIDER AGREEMENT FOR SERVICES FOR COLORADO STATE PARKS PROJECT AND
AUTHORIZE CHAIR TO SIGN-COLORADO YOUTH CORPS ASSOCIATION: Mr.Speckman stated this
agreement is to allow the Weld County Youth Conservation Corps to work on projects through the Colorado
State Parks Project for a project at the Saint Vrain Park. He stated the amount funded is $10,450 for a
period of May 24, 2004, through June 30, 2005. Responding to Commissioner Geile, Mr. Speckman
described the previous project of landscaping near Frederick,where the youth planted 400 to 500 trees in
the park. He stated this project is the Saint Vrain Park near Barbour Ponds. Commissioner Geile moved
to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Jerke,the motion
carried unanimously.
CONSIDER TWO CONSULTANT AGREEMENTS FOR SPECIAL EDUCATION AND OCCUPATIONAL
THERAPY SERVICES AND AUTHORIZE CHAIR TO SIGN-LEANNA NOONAN:Mr.Speckman stated there
are two agreements with Leanna Noonan to provide special education services and occupational therapy
services to children with disabilities. Commissioner Long moved to approve said agreements and authorize
the Chair to sign. Seconded by Commissioner Geile, the motion carried unanimously.
CONSIDER STATEMENT OF GRANT AWARD FORA.F.I.S.WORK STATION AND AUTHORIZE CHAIR
TO SIGN:With no one present from the Sheriffs Department,Commissioner Geile moved to continue this
matter to June 16, 2004, at 9:00 a.m. The motion,which was seconded by Commissioner Jerke, carried
unanimously.
CONSIDER NONEXCLUSIVE LICENSE AGREEMENT FOR UPGRADE AND MAINTENANCE OF WCR
16 RIGHT-OF-WAY AND AUTHORIZE CHAIR TO SIGN -GARY AND MHARI PESCHEL: Don Carroll,
Department of Public Works,stated this agreement is a requirement for approval of Recorded Exemption
#3791. He stated the agreement covers Weld County Road 16 for a distance of 1/2 mile east of Weld
County Road 37. Mr. Carroll explained this is a three-lot Recorded Exemption, with an existing home on
Lot C,which will have public access blocked to it through the creation of Lots A and B. Mr. Carroll stated
the applicants have contacted the adjacent property owners,with no negative comments. Responding to
Commissioner Jerke, Mr.Carroll stated the Recorded Exemption has not been approved,pending approval
of this agreement, and Lots A and C both have existing homes. Commissioner Jerke moved to approve

said agreement and authorize the Chair to sign. Seconded by Commissioner Long, the motion carried
unanimously.
CONSIDER NONEXCLUSIVE LICENSE AGREEMENT FOR UPGRADE AND MAINTENANCE OF
WCR 51 RIGHT-OF-WAY AND AUTHORIZE CHAIR TO SIGN-ROY AND JACQUELINE NELSON: Mr.
Carroll stated this agreement is a requirement of Recorded Exemption#3808, and it covers Weld County
Road 51, for a distance of 1/2 mile south of Weld County Road 40. He stated the access will be from the
section line, and there was no opposition expressed by adjacent property owners. Commissioner Geile
moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Long,the
motion carried unanimously. Responding to Chair Long, Commissioner Jerke stated Weld County Road
40 has been gated in response to numerous complaints from property owners in the area,after consultation
with the Department of Public Works. He stated keys were given to tenants and oil companies, and it was
suggested by staff that the owners install the gate to avoid dumping problems which were frequently
occurring.
CONSIDER NONEXCLUSIVE LICENSE AGREEMENT FOR UPGRADE AND MAINTENANCE OF WCR 63
RIGHT-OF-WAYANDAUTHORIZE CHAIR TO SIGN-CAROL AND CHRIS THOMPSON:Mr.Carroll stated
this agreement is a requirement of Recorded Exemption#3730,and it covers Weld County Road 63 north
approximately 3/4 miles from Weld County Road 78, then west approximately 1/2 mile. He stated this is
the best solution to accommodate access for Lots A and B, since there are no roads to the north or west
of the parcel. Bruce Johnson, representative of Carol and Chris Thompson, stated it is a requirement of
approval of the Recorded Exemption; however,he noted although Weld County Road 63 is not maintained,
its appearance is the same as other maintained roads in the area. Mr.Johnson stated there are a few other
homes in the area. Responding to Chair Masden, Mr. Carroll stated our records indicate there is 60 feet
of right-of-way; however, a title search has not been done, therefore, his recommendation states the
right-of-way"appears"to be 60 feet. Keith Meyer, Department of Public Works, stated certification of the
right-of-way is not readily available;however,staff does completely research all County records. However,
because a title search is not completed,certification of the right-of-way is not always available. Mr.Johnson
stated,from his experience with other properties in the area,there is right-of-way on the west side of Weld
County Road 63, when the property was deeded for a previous sale. Commissioner Long moved to
approve said agreement and authorize the Chair to sign. Seconded by Commissioner Geile, the motion
carried unanimously.
CONSIDER TEMPORARY CONSTRUCTION EASEMENT ON WCR 47 AND AUTHORIZE CHAIR TO
SIGN-DIANE INDORF: Mr. Meyer stated this is the first of thirty-one parcels which will be brought before
the Board for the Weld County Road 47 Project. Mr. Meyer stated the easement is approximately 1/4 mile,
and the reimbursement is$500.00. Commissioner Long moved to approve said easement and authorize
the Chair to sign. Seconded by CommissionerJerke,the motion carried unanimously. (Changed to Tape
#2004-26.)
CONSIDER TEMPORARY CONSTRUCTION EASEMENT ON WCR 47 AND AUTHORIZE CHAIR TO
SIGN - BRENDA HARMS AND RANDELL ROBINSON: Mr. Meyer stated this is for the same project
discussed with the last item, and compensation is$350.00. Commissioner Long moved to approve said
easement and authorize the Chair to sign. Seconded by Commissioner Jerke, the motion carried
unanimously.
CONSIDER TEMPORARY CLOSURE OF WCR 25 BETWEEN WCRS 62 AND 64.50: Mr. Meyer stated
this closure is for construction of the crossing for the Poudre River Trail,which should be completed by the
end of the month. Responding to Commissioner Jerke, Mr. Meyer explained the project, and stated the
project is funded through Poudre River Trail funds. Commissioner Jerke moved to approve said closure.
The motion, which was seconded by Commissioner Long, carried unanimously.

CONSIDER CANCELLATION OF BOARD OF COUNTY COMMISSIONERS MEETING SCHEDULED FOR
JUNE 30, 2004: Commissioner Geile moved to approve said cancellation. The motion, which was
seconded by Commissioner Long, carried unanimously.
PLANNING:
CONSIDER VACATION OF USE BY SPECIAL REVIEW PERMIT, USR#204 -J. MOODY: Jacqueline
Hatch, Department of Planning Services,stated the current owner, J. Moody, has requested vacation as
a requirement of his Recorded Exemption #3775. She stated the feedlot is not currently operating.
Commissioner Geile moved to approve the vacation of said Use by Special Review Permit#204. The
motion, which was seconded by Commissioner Long, carried unanimously.
CONSIDER ZONING PERMIT FOR A MOBILE HOME, ZPMH#1165- EUGENIA AND DAVID HARRIS:
Wendy Inloes, Department of Planning Services,stated this case is the rejustification of an existing mobile
home which has been denied by staff. She stated the applicants are out of town and have requested
continuance to July 12,2004. Commissioner Geile moved to continue this matter to July 12,2004, at 9:00
a.m. The motion, which was seconded by Commissioner Jerke, carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
consent agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by
the Acting Clerk to the Board.
There being no further business, this meeting was adjourned at 9:50 a.m.
