Earl and Barbara Sowers desire to purchase additional land from Ms. Stamp to add to their existing 2. 01 acre parcel. The legal descriptions of the parcels to be exempted from the definitions of "subdivision" and "subdivided land" are as follows: Tract A of recorded exemption No. 1207-31-2- RE99, recorded December 21, 1973, in book 705 as Reception No. 1627135; A tract of land 2 . 011 acres more or less situated in the Southwest Quarter of the Northwest Quar- ter of Section 31, Township 3 North, Range 68 West of the 6th P.M. , Weld County, Colo- rado. COLORADO March 4, 1981 Board of County Commissioners Weld County, Colorado 915 10th Street Greeley, CO 80631 RE: Subdivision Exemption #131 Dear Commissioners: The attached application and related materials are in reference to a request by Ms. Leneita Stamp for a subdivision exemption. The parcel of land as described at Pt. NWa Section 31, T3N, R68W of the 6th P.M. , Weld County, Colorado. This property is located on the west side of Union Reservoir. The property contains approximately 35. 12 acres of Class I and II irrigated soils. The Sowers desire to purchase additional land from Ms. Leneita Stamp to add to their existing 2.01 acre parcel created by Recorded Exemp- tion #99 in December of 1973. The additional property consists of approximately 12 acres including feet on the north boundary of their property line and extending east Union Reservoir. Based upon the information submitted and the adopted policies in the County, the Deaprtment of Planning Services Staff recommends this request be denied for the following reasons: 1. The subdivison exemption request is not in conformance with the intent clause of the Agricultural Zone District (Section 3.3 A. of the Weld County Zoning Resolution) which states: "Intent - The intent in establishing the A-Agricultural Zone District is to allow all agricultural and related uses in those areas in which agriculture is and should continue to be the predominant land use. This district is intended to discourage encroachment of incompatible uses upon the agricultural land in the district, to encourage agricultural uses as the highest and best use of the land in the district as compared with other uses in conflict therewith, and to provide for the orderly expansion of urban growth in conformance with the Weld County Comprehensive Plan. " Board of County Commissioners Page 2 March 4, 1981 The request would not be encouraging agricultural uses as the highest and best uses, would not be providing for the orderly expansion of urban growth and it would be promoting the con- tinued division of agricultural land into smaller, less economic parcel sizes. 2. It is a basic premise of the Weld County Comprehensive Plan that the County should not encourage the break up of large blocks of agricultural land resulting in the eventual loss of agricultural lands to urban pressures, but work towards preserving agricultural resources, promoting the agricultural economy and reducing conflicts between urban and rural uses in an agricultural area. The division of the 35 acre parcel not only creates the potential for further subdivison of the 14 acre and 22 acre parcels but also sets a precedent for subdivison of other 35 acre parcels in the immediate area. In December of 1973, the 115 acre parcel was divided into two 35 acre parcels and one 45 acre parcel . 3. The continued subdivison of parcels in the immediate area by exemption methods may create the potential for inefficient development of the land in the future. The creation of smaller parcels through exemption procedures may serve to evade the intent and purpose of the Subdivison Regulations. Should the Commissioners approve this request, the Department of Planning Services Staff recommends that the approval be conditional upon the Stamps applying for an amended recorded exemption to pro- perly complete the change in the parcel boundaries. Stamp be withdrawn and in lieu thereof, the enclosed re-application be filed. The reason for this is that the prior application did not clearly identify the nature of the request and significant developments have since occurred which may change the preliminary staff recom- mendations. After discussing this matter, it appears as though the intentions of the parties may have been previously misunder- stood. This is not a routine application wherein the applicant is attempting to obtain a subdivision exemption for the purposes of permitting additional residential structures to be constructed. Rather, this application is only for the purpose of changing the boundary lines between two existing parcels . As has been outlined in the application, this request is not to create a new and separate parcel, but rather to change the boundary lines between two existing parcels thereby increasing the size of one parcel and obviously diminishing the size of the adjacent parcel. Both before and after, the use of the property will remain agricultural. Whether or not the efficiency of the agricultural operations will increase or decrease is purely a matter of speculation. One important circumstance though is that Mr. Sowers owns and operates an irrigation pump which has adequate capacity to irrigate all of the property he plans on acquiring. Neither parcel is of sufficient size at the present time to permit a large scale agricultural operation and likely, no more inefficiency would occur. It should also be specifically noted that this application will not result in encroachment on agricultural property nor an increase in residential or urban development. Before Mr. Sowers would be able to again subdivide the property to permit addi- tional buildings, he would have to apply to the County for such exemption which would logically be denied. This question may, however, become somewhat moot by the site selection of Hewlett Packard. The impact of this site selection impacts the general area to such an extent that the mere change of boundary lines by this application becomes of minimal significance. In any event, it is submitted that this application does not violate the Weld County Zoning or Subdivision Regulations, nor the Intent Clause of the Agricultural Zoning District in that granting the application does not create additional residential structures or urbanization of agricultural lands nor does it change the agricultural use. Stamp, the present owner of the property, we are the real parties in interest in that we have a contract to purchase the exempted parcel , if granted. We live on a two-plus acre tract located adjacent to and surrounded on the east and south side by the parcel which is the subject of this applica- tion. The reasons for the request for exemption are as follows : (a) We own an irrigation well which is apparently located on the existing division line between our property and that owned by Mrs . Stamp. No immediate problems have been encountered regarding ownership of the well, but in the event of a change of owner- ship, a dispute could arise. Acquisition of additional property by us would alleviate this potential problem. (b) The northerly boundary of our property is sufficiently close to the existing improvements that it makes it difficult to install a boundary line fence and establish a windbreak, all of which we would like to do and could do with an increase in the size of our property. (c) Because of recent developments in the area, we would like to preserve permanent access to Union Reservoir and permanently preserve our lake view. (d) We own an irrigation well with adequate water to irrigate the acreage we propose to purchase . In the past, the irrigation well was utilized for the purpose of keeping the water table sufficiently low that it did not interfere with our residence occupancy. With the increased land, we would have the privilege of applying the irrigation well water to a beneficial use , whereas in the past merely gone to waste. Board of County Commissioners January 28, 1981 Page Two As the Board may or may not know, Hewlett Packard recently acquired an option to purchase approximately 300 acres across County Highway 1 from this property. The Hewlett Packard site is located in Boulder County, but will have a substantial effect on all surrounding property. We anticipate a flurry of land speculation in this general area because of the Hewlett Packard option, and we would like to acquire additional property for our protection. So long as we own the property, which we anticipate to be a substantial time, the property that we acquire will remain agricultural property. Additionally, granting of this application by the County will not result in increased residential or urban development. If the Board would like further information, please advise us .
