RE: APPROVE AMENDED RESUBDIVISION,AMRS#612, FOR LOT LINE ADJUSTMENT-
DONALD AND JOANN BROWN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 8th day of
November, 2004,at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing
the application of Donald and JoAnn Brown, 2154 Bluebell Avenue, Greeley, Colorado 80631,for
Amended Resubdivision,AMRS#612, for a Lot Line Adjustment, on the following described real
estate, to-wit:
Lots 1 and 2 of Resubdivision, S#612, of Etherton's
Subdivision, being part of the NE1/4 of Section 16,
Township 5 North, Range 65 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, the applicants, Donald and JoAnn Brown, were present at said hearing, and
WHEREAS,Section 24-5-30 of the Weld County Code provides standards for review of said
Amended Resubdivision, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present,studied the request of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented in this matter and,having been
fully informed, finds that this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 24-5-30.B of the Weld County Code.
2. It is the opinion of the Board of County Commissioners that the applicant has shown
compliance with Section 24-5-30.C.3 of the Weld County Code, including
specifically:
a. The lot line revision complies with the approved recorded final plat. On
March 8, 2002, the Board of County Commissioners approved a
Resubdivision for the vacation of Bluebell Avenue at this location. Upon
vacation of the road right-of-way,the property was divided equally between
the adjoining properties. The applicant is requesting that the former road
right-of-way be combined with Lot 2. This change will not affect access to
the lots or existing easements.
b. The application complies with the adopted rules,regulations,and ordinances
currently in force and affecting the subdivision. All pertinent regulations have
been addressed through the Resubdivision process.

NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that the application of Donald and JoAnn Brown for a Resubdivision fora Lot Line
Adjustment,AMRS#612, on the hereinabove described parcel of land be, and hereby is,granted
subject to the following conditions:
1. Prior to Recording the Resubdivision Plat:
A. All sheets of the plat shall be labeled AMRS-612,Amended Resubdivision of
Etherton's Subdivision.
B. The works "Preliminary Plat, Etherton's Subdivision Filing No. 3" shall be
removed from the heading.
C. The 30-foot wide utility easement in the western portion of Lot 2, which is
currently labeled"30-foot utility easement(per Etherton Sub. ReplatA)"shall
be re-labeled "30-foot exclusive water and sanitary sewer easement."
D. The last sentence of note number 7 shall read ". . . but not rebuild any
surface improvements."
E. in accordance with Appendix 24-G of the Weld County Code,the notary block
shall be removed from the Board of County Commissioners Certificate of
Approval.
F. Prior to the applicants signature blocks,the words"Executed this day
of , 2004" shall be removed.
G. If necessary, the lot line shall be adjusted to ensure that the well and septic
remain on the same lot as the home which they service.
2. Upon completion of items#1.A through 1.E,the applicant shall submit two(2)paper
copies of the plat for preliminary approval to the Weld County Department of
Planning Services. Upon approval of the paper copies,the applicant shall submit a
Mylar plat and a digital file of all drawings associated with the amended
Resubdivision application. Acceptable CAD formats are .dwg, .dxf, and .dgn
(Microstation); acceptable GIS formats are.shp (Shape Files),Arclnfo Coverages
and Arclnfo Export files format type is .e00. The preferred format for Images is .tif
(Group 4) ... (Group 6 is not acceptable). The Mylar plast shall be recorded in the
office of the Weld County Clerk and Recorder by the Department of Planning
Services. The Mylar plat and any additional requirements shall be submitted within
thirty(30)days from the date of the Board of County Commissioners approval. The
applicant shall be responsible for paying the recording fee.

THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 24-5-30.B of
the Weld County Code.
2. It is the opinion of the Department of Planning Services'Staff that the application has shown compliance
with Section 24-5-30.C of the Weld County Code, as follows:

vacation of Bluebell Avenue at this location. Upon vacation of the road right-of-way,the property

easements.
B. Section 24-5-30.C.3.b--That the application complies with the adopted rules, regulations and
ordinances currently in force and affecting the subdivision.

This recommendation is based,in part,upon a review of the application materials submitted by the applicant,
other relevant information regarding the request, and responses from referral agencies.
The Department of Planning Services'Staff recommendation for approval is conditional upon the following:

A. The Plat shall be amended as follows:
1. All sheets of the plat shall be labeled AMRS-612 Amended Resubdivision of

R. E:Manor Resubdivision of Etherton Subdivision;to relocate the lot line between a parcel owned by
Michael&Rose Vetrone and a parcel owned by Donald G.&Joann L. Sown.
The reasons for this request are as follows:
The current location of the lot ire was established when the southern end of Bluebell Ave.was vacated in
2002. Prior to this Mr.Vetrone had built a S drain ink fence arouxt the perimeter of his properly. A strip
of land 132.4'by 30'on the eastern extremity of his property is now out side of the fenced area. Mr.
Vetrone did not ward to has the expense and labor involved to move that section of his fence. Because
it was very icawenient for Mr.Vetrone to maintain and the fact that this was men iatiy an extension of
Illi etr the Browns
the front yard of Mr.&Mrs.Brown,with the approval and agreertsd of Mr.&Mrs.Vane
under took landscaping the entire area that had been vacated.
Recently the Vetrones have decided to sell the`property. This makes it timely that action be taken to
daily the property boundaries to more correctly reflect the current circumstances.
There are also some easements that need to be dearly irxflcated on the Wits:
One of these is for maintenance purposes of inigatiorn latnal#39(previously#47)that crosses the
Vetrone property. This portion of the lateral is underground. This easement would be 10'wide(5'each
side of the cenlarine).
A second is for gamma to the open section of lateral#39 that parallels the southern side of the Vetrone
property by water users down stream to monitor the water Sow and to dean the ditch. This easement
would be 5'wide and would be educed to the fence along the wedern extremity of the Brown property
from the ditch easement to the southwest comer of the Brown properly.
The 30'uWiity easement as currently platted would remain unchanged.
• This request does not involve any other properly owners or existing rubs,regulations and enhances
curacy in fare.
