If you wish to approve this request, a hearing before the Board on May 12, 2004, will allow adequate time for advertising. 2004-1119 PL1715 • OCtit MEMORANDUM TO: Weld County Board of County Commissioners COLORADO DATE: March 29, 2004 FROM: Sheri Lockman, Planner II SUBJECT: USR-1471 Mr. Robin Thomas has applied for a Site Specific Development Plan and a Special Review Permit for three (3) radio communication transmission towers over seventy feet in height(183') in the A (Agricultural)Zone District. The applicant has until July 5'h, 2004 to build the towers before the construction permit through the Federal Communications Commission expires. The applicant has diligently pursued the permits required since they were offered the purchase of the associated radio station. Therefore, Planning Staff is recommending the applicant be allowed to be heard at the earliest feasible Board of County Commissioners hearing following the May 4, 2004 Planning Commission hearing. 2004-1119 REQUEST FOR EARLY COMMISSIONS MEETING AND EARLY BUILDING PERMITS Radio Frontier Broadcasting, LLC. ("RFB") respectfully requests an early Commissioners meeting in regards to its special review land use request filed in Weld County dated March 17, 2004. RFB is seeking to construct three new 183 foot radio towers to be utilized in the transmission of a new AM radio station, KJMP, to be licensed to Peirce, Colorado on 870 ICHz. RFB has recently acquired a construction permit to build KJMP Peirce. However, the authority to build this new station expires on July 5th, 2004. Figure one of this request, is a copy of the construction permit which show the expiration date. RFB has recently entered into a contract to purchase a certain 67.97 acre parcel located northeast of the community of Ault, Colorado, Lot B, recorded Exemption # 3313 located in the S. 'A of the NW 'A of Section 5, T 7 N, R 65 W. RFB seeks to construct the new transmission array for KJMP at this site. RFB is expecting to close on the purchase of this parcel on April 15th, 2004. RFB would like to begin construction of the new transmission facility for KJMP as soon as possible after the purchase of the property is complete. Construction of the new three 180 foot towers needed for the directional antenna system will take several weeks. Installation of electrical power to the transmitter building, transmission line trenching, installation of tuning networks, etc. will take several weeks to complete. After all of the physical construction is completed, field tuning of the directional array could take several weeks to complete. The construction and tuning must be completed prior to the construction permit expiration date of July 5th, 2004. A license application (FCC form 302) must be filed with the Federal Communications Commission before July 5th, 2004. This new AM station will be the first station licensed to the community of Peirce, Colorado. While this will be a commercial broadcast station, it will also serve as an important public service community communications outlet. It will linked to the new FCC's Emergency Alert System, which is utilized to notify local residents of many different emergency conditions such as severe weather, toxic spills, etc.. It also has recently been utilized for the new Colorado Amber alert system. This system is utilized to help assist with child abduction cases, etc.. The FCC no longer grants extensions to complete station build outs of construction permits. While this construction permit was granted in July of 2001, the original owner of the construction permit, Jo-Mor Communications, Inc of Denver, ran into financial difficulties is was un-able to construct the facilities in a timely manner. RFB has purchased this construction permit on March 5th, 2004 is now diligently working to build out this construction permit before the expiration date. RFB respectfully requests the WELD county zoning board and the WELD county commissioners expedited processing of its special land use request so that construction of the new transmitting facility for KJMP can begin as soon as possible. See Section 73.3598. Equipment and program tests shall be conducted only pursuant to Sections 73.1610 and 73.1620 of the Commission's Rules.
