When I first interviewed Ruben Rodriguez for the Fort Lupton Press, in January 2002, he said he was planning a fine dining establishment, and indeed, the petition that he presented to the commissioners from citizens in the community addressed the need for such a facility. He didn't ask if they wanted a bar and nightclub, he asked if they were in favor of a restaurant. Thus far, he has done little that he promised. He was going to have a sign that abides by code, it doesn't. He was going to put in a culvert at the entrance, he didn't. He was going to petition the city for annexation, he hasn't. He was going to put up a wall to separate minors from adults, I have been told it is a rope. He was not going to serve minors; my friend went there last December after his 20 year-old son called to tell him he had been served as an adult and couldn't drive home. He was not going to allow intoxicated drivers to leave; in January I went on a ride along with a state trooper. In the early morning hours, there was a call for a man walking in the middle of the road on Highway 85 near County Road 16. The trooper found that he was, indeed, intoxicated. Soon, a truck drove up, it was the man's wife, they had had a fight and he was walking home, albeit the wrong direction. The trooper ordered her out of the truck and she, too, was intoxicated. They said they had been partying with relatives at La Maravilla. La Maravilla was going to have landscaping; if dead grass and dying trees, that have not been pruned of dead branches are landscaping, then there is landscaping. I have friends who opened their restaurant under much scrutiny from the health department. Everything had to be just right before it could be opened, including the fact they were not allowed to put in extra tables in an area that certainly could have accommodated them. The owner made note that he had not been given the same treatment as Ruben Rodriguez. I do not see your conditions to La Maravilla as discriminatory, I see them as an attempt to have Ruben Rodriguez follow the same standard everyone else. EXHI The day after the April, 2004 hearing for La Maravilla,l receive 2004-2266 phone message from Ruben Rodriguez, asking me to call him back. I did, with David Norcross sitting across the desk, listening. Ruben Rodriguez said that he wanted me to "write something nice about his business because he didn't want it to hurt his business." On April 17, I received a message on my answering machine from him. "Ah yeah, this is Ruben Rodriguez and I just read the article you put in to the Maravilla and i think this is a bunch of bullshit. I'm going to talk on Monday on this on and this is not going to be a good thing for you. I'll talk to you on Monday." I don't know what you consider that to be, but I considered it a threat and took the tape to Chief of Police Jerry Gardner. Doesn't the owner of a liquor license have to demonstrate good character? The ironic thing about this is that I didn't put in his Weld County Health review, with its report of lack of sanitation, in the article. I did, however, write that he told the commissioners he thought he was being discriminated against. I am sure you have read the police report Norma Taylor attached to her packet, showing how Mr. Rodriguez has men videotaping sheriff's and Fort Lupton Police officers. And if you haven't please do. On Monday, Mr. Norcross and I stopped by the side of Weld County Road 16 and the frontage road, where took photos of the sign and the drainage situation. A man came out from La Maravilla and asked if he could 'help me." I wasn't trespassing, I was on public right of way, on the outside of his deplaidated fence. I perceive this not as an offer to help but an attempt to intimidate me, especially as he was dialing is cell phone at the same time! I don't take kindly to being threatened, and I don't like it when one citizen considers him or herself above the law that is supposed to be applied equally to everyone. My opposition to La Maravilla is simply this, he hasn't done what he said he would do in the past, so why do you believe he will in the future? The review was conducted in accordance with Article 2.1.5 of the Colorado Primary Drinking Water Regulations and the State of Colorado Design Criteria for Potable Water Systems. The components of the review included: • Existing 51-foot deep well(Well Permit Number 041698-F) • Hypochlorination disinfection system ' • 600 gallons of potable water storage, consisting of two, 300-gallon tanks in series • Water filtration system, consisting of three Aqua-Pure AP12T housings,with Parker 39R10A wound filter cartridges, in parallel. A condition of this approval involves the completion of a microscopic particulate analysis (MPA) if well depth is less than 100 feet. As your well is less than 100 feet deep,you are required to perform a MPA immediately and transmit the results to this office. Following completion of the required MPA,if your water is classified as ground water under the influence of surface water, you will need to maintain the water filtration system in conformance with the State of Colorado's requirements, and daily turbidity and chlorine residual measurements will need to be reported. Regardless of the outcome of the MPA,you will be required to continue to disinfect the water. Mr. Ruben 3. As your well is less than 100 feet deep, and since you have not performed the initial microscopic particulate analysis, you must provide treantent•consisting of both filtration and disinfection. The disinfection and filtration treatment systems must be approved by the Water Quality Control Division. Following completion of the required microscopic particulate analysis, if your water source is classified as ground water under the influence of surface water,you will need to maintain the treatment system. • Implementation of sufficient water storage capacity to meet chlorine contact requirements. The State of Colorado Design Criteria for Potable Water Systems requires a minimum of 30 minutes of contact time at peak flow rate. Based upon information available,a minimum of 450 gallons of storage is required for your system. • Submittal of the"Inventory Form"previously delivered to you by the Weld County Department of Public Health and Environment and originally required as part of the"Plans Review" submittal process. • Once your water system is established as a public water system,you will be required to monitor your system in accordance with the requirements of the Water Quality Control Division's Compliance Assurance and Data Management Unit. (CHURCH) has prepared this supplemental letter to the previous assessment of the existing onsite wastewater systems(OWS). CHURCH prepared the previous assessment as presented in our Letter dated October 14,2003. This supplemental includes updated water use records and OWS recommendations for the subject site.This supplemental is based on the water use data provided by you.The physical condition of the existing OWS or characteristics of wastewater at the subject site were not evaluated by CHURCH. This supplemental also presents recommendations that address concerns presented in the letter to you from the Weld County Department of Public Health and Environment dated April 13, 2004. A copy of this letter is presented in Appendix A. Site Conditions and Current Operations: CHURCH was informed by you the existing OWS has still functioned adequately and no surfacing of effluent oT backups of the sewer line have occurred. in addition, site conditions and operations of the restaurant/lounge/dance hall have not changed since our previous assessment was performed. Proposed Expansion: It is understood that you wish to increase the capacity of the Dance Hall from its current permitted capacity of 350 people per night. It is understood that Weld County is may allow you to increase the capacity to 450 people per night,and then possibly to 550 people per day after a period of about three months pending review of water usage. The local fire district limits you to a maximum capacity of 752 people, Water Usage: You have monitored water usage during May and June of 2004. The water use data is presented in Appendix B. Based on the data provided, peak usage is during the periods when both the restaurant and dance hall are in operation, particularly during the weekends. The water usage for the restaurant is typically less than 95D gallons per day when the lounge/dance hall is not in operation. The water usage when both the restaurant and lounge/dance hall were in operation ranged from about 1005 to 1315 gallons per day (gpd) with an average of 1270 gpd. This 1270-gpd average is 73%of the average daily sewage loading capacity of 1727 gpd for the OWS. You informed CHURCH that the water usage during peak periods is for an average of 350 people per day using the lounge/dance hall. This results in an average daily water usage of 3.6 gallons per person per day. These water use records indicate an increase in water usage from the data presented in the origi- nal assessment. The number of meals served was not provided for this supplement, but we wcrc informed that the number of meals per day served is currently similar to that indicated in our previous assessment. Conclusions: Based on this information it appears that the existing OWS drain field is being utilized (on average) at 73% of its average daily loading capacity of 1727 gpd. Therefore, it may be possible to increase the capacity of the dance hall provided the meals served remains at the current level. Consider- ing that on average approximately 450 gallons of additional sewage could be produced to achieve the maximum average daily flow of 1727 GPD, the lounge capacity could be increased. Based on 3.6 gallons/person/day for the dance hall, the capacity of the dance hall could be increased to by 125 people to 475 pcople/day. Therefore, it appears that the increase from 350 to 450 people per day, as proposed by Weld County,is feasible. The number of meals permitted per day should be reduced to 80 as indicated in the previous assessment. Recommendations: In order to comply with the County requirements for increasing the oxygen transfer to the effluent in the chain field,the following are recommended: 1. Remove the existing asphalt in the drain field area and scarify the upper soils above the dispersal gravel layer. Pot holing should be performed to assess the depth to the gravel layer and dispersal pipes prior to excavation.Lightweight tracked equipment should be used. 2. Install two vent pipes at opposite ends of the drain field and attach these pipes to the existing dispersal piping system.Install an observation pipe at one end of the drain field. 3. The drain field area should be protected from traffic with fencing or other suitable devices. Drainage should be diverted around the drain field area as necessary. The surface of the field should he seeded after installation of the system.We suggest using a seed mix such as"Foothills, Pasture, or Prairie"mixes,or sod. These mixes do not require irrigation and develop a growth 10 to 15 inches high.Automatic sprinkler systems should not be installed over the fields. Limitations: The conclusions developed for this supplemental are based on the recent water use data provided by you, and information presented in the original assessment mentioned above. These assess- ments should not he considered as an evaluation of the condition of the existing OWS or as an estimate on the performance life of the existing drain field. Excavations into the drain field would be required to assess its current condition and for the presence of biomat material. We would require the following: • A description of the proposed secondary treatment unit for the septic system. The secondary treatment unit(s)should be designed to provide increased oxygen transfer. In accordance with the Weld County Code,any proposed secondary treatment unit should be reviewed and designed by a Registered Professional Ergineer.
