Before the Holloway family moved in, the property in question contained a modular home, a barn, and was covered with vegetation. Since most of our winds come from the North, the vegetation on the property kept the dust from blowing to our residence. This is no longer the case as the entire 5 acres is a dirt parking lot with no vegetation to control erosion or dust. We also take issue with the noise and added traffic of the trucks coming and going. The Holloway's have used their property to dump liquids from their tank trucks. On occasion these liquids have contained a strong petroleum smell that is brought to our residence with the predominant Northern winds and breezes. This smell has been so strong at times that we had to turn off our cooler. Naturally we have health concerns over this dumping. To be fair, we have not had this odor for several months but are concerned about what caused it and if it will return. The property is unsightly and we are concerned about our property values. Who would want to move next door to a trucking business? Would the planners allow a trucking business to move in next door? We moved to an ag-zoned area to be in the cattle business. Because we live in a zone for agriculture we are prepared to deal with nuisances that are conducive to farming and livestock. We are not willing and do not want the added nuisances of a trucking business next door. Because of the reasons listed above I ask you to please deny the Holloway's application for a USR. In the event washing of vehicle will occur on site the applicant shall ensure that any vehicle washing area(s) shall capture all effluent and prevent discharges from the washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 2. In accordance with the Underground and Above Ground Storage Tank Regulations (7 CCR 1101-14) a spillage retention berm shall be constructed around the tank battery. The volume retained by the spillage berm should be greater than the volume of the largest tank inside the berm. Alternative protective measures may be allowed provided they comply with the Above Ground Storage Tank Regulations. The following requirements should be added into the permit as development standards: 1. Any vehicle washing area(s) shall capture all effluent and prevent discharges from the washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission,and the Environmental Protection Agency. 2. The applicant shall comply with all provisions of the Underground and Above Ground Storage Tank Regulations(7 CCR 1101-14). 3. All potentially hazardous chemicals must be stored and handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds(VOC's). 4. Any petroleum contaminated soils on the property shall be removed and disposed in accordance with all applicable rules and regulations. 5. The facility shall be constructed and operated to ensure that contamination of soils and groundwater does not occur. Hello
