SUBJECT: Greeley-Weld County Airport 1,2,3,and 4 Annexations
The Greeley City Council received petitions for annexation of property located generally east of
Cherry Avenue,west of WCR 47,south of WCR 64' and either side of SH 263,known as the
Greeley-Weld County Airport 1,2,3,and 4 Annexations.
Your taxing jurisdiction/district is listed as being one of which the territory proposed for
annexation is a part. A public hearing will beheld on Tuesday,October 19,2004,to determine
whether these properties are eligible for annexation.
A copy of the notice of public hearing, a copy of the resolution which sets the public hearing,
and a copy of the petition(s) as filed are attached. As indicated in the notice and resolution,the
public hearing will beheld:

NOTICE
Notice is hereby given that the City Council of Greeley, Colorado, will hold a public hearing on
proposed annexations of territory to the City of Greeley. The hearings shall be held on October
19, 2004, in the City Council Chambers of the Public Safety Building, 919 7th Street, in the City
of Greeley, Colorado, beginning at 6:30 p.m. or as soon thereafter as the matter can be heard by
the City Council on that date. The purpose of the hearings is to determine whether said
properties are eligible for annexation under Colorado law. Persons wishing to examine the
annexation petitions, resolutions, and any exhibits thereto, may do so at the office of the City
Clerk during business hours. These territories are described in annexation petitions which have
been filed with the City Clerk as:
• The "Greeley-Weld Airport First Annexation", located generally east of Cherry Avenue,
West of WCR 47, South of WCR 64 %2 and either side of SH 263
• The "Greeley-Weld Airport Second Annexation", located generally east of Cherry
Avenue, West of WCR 47, South of WCR 64 '/2 and either side of SH 263
• The "Greeley-Weld Airport Third Annexation", located generally east of Cherry Avenue,
West of WCR 47, South of WCR 64 'h and either side of SH 263;

A RESOLUTION FOR THE GREELEY-WELD AIRPORT FIRST ANNEXATION
PETITION FINDING SUBSTANTIAL COMPLIANCE WITH STATE
ANNEXATION LAWS AND SETTING A HEARING FOR CONSIDERATION OF
AN ANNEXATION
WHEREAS, Greeley-Weld County Airport Authority, submitted an annexation petition
to the City of Greeley for annexation of property at 600 Airport Road, located generally east of
Cherry Avenue, West of WCR 47, South of WCR 64 %z and either side of SH 263;
SEE ATTACHED LEGAL FOR GREELEY-WELD AIRPORT FIRST ANNEXATION
WHEREAS, the City of Greeley staff has found substantial compliance of the
annexation petition in conformance with C.R.S. § 31-12-101, et seq.; and
WHEREAS, C.R.S. § 31-12-108 requires that the City Council establish a date, time,
and place to hold a hearing to determine if the proposed annexation complies with C.R.S.
§§ 31-12-104 and 31-12-105, or such parts thereof, to establish eligibility for annexation
to the City of Greeley; and
WHEREAS, the City Clerk shall deliver notice and publish the date, time, and place
for said hearing.
NOW THEREFORE, BE IT RESOLVED BY THE GREELEY CITY COUNCIL OF
THE CITY OF GREELEY, COLORADO.
1. The annexation petition is found to substantially comply with C.R.S. §§ 31-12-
104 and 31-12-105.
2. The public hearing for consideration of the proposed annexation petition is hereby
set for October 19, 2004, at the Greeley City Council Chambers, 919 7"' Street,
Greeley, Colorado, during a regular City Council meeting beginning at 6:30 p.m..
3. The City Clerk is hereby authorized to publish and notify required parties
pursuant to C.R.S. § 31-12-108(2).
4. This resolution shall become effective immediately upon its passage.

CONSIDERATION OF AN ANNEXATION
WHEREAS, Greeley-Weld County Airport Authority, submitted an annexation
petition to the City of Greeley for annexation of property at 600 Airport Road, located
generally east of Cherry Avenue, West of WCR 47, South of WCR 64 %2 and either side
of SH 263;
SEE ATTACHED LEGAL FOR GREELEY-WELD AIRPORT FOURTH ANNEXATION
WHEREAS, the City of Greeley staff has found substantial compliance of the
annexation petition in conformance with C.R.S. § 31-12-101, et seq.; and
WHEREAS, C.R.S. § 31-12-108 requires that the City Council establish a date, time,
and place to hold a hearing to determine if the proposed annexation complies with C.R.S.
§§ 31-12-104 and 31-12-105, or such parts thereof, to establish eligibility for annexation
to the City of Greeley; and
WHEREAS,the City Clerk shall deliver notice and publish the date, time, and place
for said hearing.
NOW THEREFORE, BE IT RESOLVED BY THE GREELEY CITY COUNCIL OF
THE CITY OF GREELEY, COLORADO.
1. The annexation petition is found to substantially comply with C.R.S. §§ 31-12-
104 and 31-12-105.
2. The public hearing for consideration of the proposed annexation petition is hereby
set for October 19, 2004, at the Greeley City Council Chambers, 919 7th Street,
Greeley, Colorado, during a regular City Council meeting beginning at 6:30 p.m..
3. The City Clerk is hereby authorized to publish and notify required parties

TO THE HONORABLE MAYOR AND CITY COUNCIL OF THE CITY OF GREELEY,
COLORADO:
The undersigned, in accordance with Title 31, Article 12, Chapters 101 et. seq., Colorado
Revised Statutes, 1973, as amended, hereby petition the City Council of the City of Greeley
for annexation to the City of GicreleLojythciLeigtost described herein and described and
shown on the map designated, Airport First Annexation Annexation."
The applicable number of said map (at least your) are submitted herewith and by this reference
are incorporated herein. The description of the territory hereby petitioned for annexation to the
City of Greeley is set forth in Exhibit A attached hereto and incorporated herein by reference.
In support of this petition, the Petitioner(s) allege(s) that:
1. It is desirable and necessary that the above-described territory be annexed to the City of
Greeley.
2. The requirements of Section 31-12-104 and 31-12-105 of the Colorado Revised Statutes
exist or have been met in that:
A. Not less than one-sixth (1/6) of the perimeter of the area proposed to be
annexed is contiguous with the City of Greeley.
B. A community of interest exists between the territory proposed to be annexed
and the City of Greeley.
C. The territory sought to be annexed is urban or will be urbanized in the near
future.
D. The territory sought to be annexed is integrated or is capable of being integrated
with the City of Greeley.
3. In establishing the boundaries of the territory proposed to be annexed, no land held in
identical ownership, whether consisting of one tract or parcel of real estate or two or
more contiguous tracts or parcels of real estate, has/have been divided into separate
parts or parcels of real estate without the written consent of the land owner or land
owners thereof, except and unless where such tracts or parcels are already separated by
a dedicated street, road, or other public way.
4. In establishing the boundaries of the territory proposed to be annexed, no land held in
identical ownership, whether consisting of one tract or parcel of real estate or two or
more contiguous tracts or parcels of real estate comprising twenty (20) acres or more
which, together with the buildings and improvements situated thereon have an assessed
valuation in excess of$200,000 for ad valorem tax purposes for the year next
preceding the filing of the written petition for annexation, has/have been included
within the territory proposed to be annexed without the written consent of the land
owner or land owners.
5. The territory proposed to be annexed does not include any area which is the same or
substantially the same area in which an election for an annexation to the City of
Greeley was held within the twelve months preceding the filing of this petition.
6. The territory proposed to be annexed does not include any area included in another
annexation proceeding involving a city other than the City of Greeley.
7. The territory proposed to be annexed is not presently a part of any incorporated city,
city and county, or town.
8. The property owned by each petitioner is described on each separate signature sheet
and, when needed, described more fully in the exhibits attached hereto and
incorporated herein by reference.
9. The signer(s) of this petition comprise(s) more than fifty percent (50%) of the land
owners and owning more than fifty percent (50%) of the property, excluding public
streets and alleys, and any land owned by the annexing municipality, and are, in fact,
owners of one hundred percent (100%) of the property set forth in Exhibit A attached
hereto and incorporated herein by reference.
Accompanying this petition are the original and four copies of an annexation plat map
containing the following information:
A. A written legal description of the boundaries of the area proposed to be
annexed.
B. A map showing the boundary of the area proposed to be annexed.
C. Within the annexation boundary map, an identification of the location of each
ownership tract in unplatted land and, if part or all of the area is platted, the
boundaries and the plat numbers of plots or of lots and blocks. Also within the
boundary map, identification of any special districts the area proposed to be
annexed may be part of.
D. Next to the boundary of the area proposed to be annexed, a drawing of the
contiguous boundary of the annexing municipality and the contiguous boundary
of any other municipality abutting the area proposed to be annexed.
E. A surveyor's certificate prepared by a registered land surveyor that attests to the
preparation of the map and certifies at least one-sixth (1/6) contiguity to the
City of Greeley.
F. Acceptance block describing the acceptance action of the City of Greeley in
form and substance as provided in Appendix A of the Subdivision Regulations
of the City of Greeley and providing for the effective date and City Clerk and
Mayor attest signatures.
10. Except as otherwise provided, no part of the territory sought to be annexed is more
than three miles from a point on the municipal boundary, as such was established more
than one year before this annexation will become effective.
11. As an expressed condition of annexation, land owner(s) consent(s) to inclusion into the
Northern Colorado Water Conservancy District and the municipal subdistrict pursuant
to Section 37-45-136 (3.6) C.R.S. Land owner(s) acknowledge(s) that, upon inclusion
into the district and subdistrict, land owner's(s') property will be subject to the same
mill levies and special assessments as are levied or will be levied on other similarly
situated property in the district and subdistrict at the time of inclusion of land
owner's(s') lands. Land owner(s) agree(s) to waive any right to an election which may
exist to require an election pursuant to Article X, Section 20, of the Colorado
Constitution before the district and subdistrict can impose such mill levies and special
assessments as it has the authority to impose. Land owner(s) also agree(s) to waive,
upon inclusion, any right which may exist to a refund pursuant to Article X, Section

NARRATIVE
The following Narrative is provided in conjunction with the Petitions For Annexation for the
Greeley-Weld County Airport.
A. Annexation criteria provided at Section 18.26.050.A.1-5 of the Development Code
including conformance with the City's Comprehensive Plan:
The proposed annexation meets the criteria of the above noted Section as follows:
1. The proposed annexation is in conformance with the City of Greeley
Comprehensive Plan. Paragraphs TR7.4 through TR7.7 of the City of
Greeley 2020 Comprehensive Plan outline the future plans and goals of the
City in terms of annexation of the balance of airport property into the City,the
expansion of aviation educational programs to advance economic
development objectives, recognition of the U.S. Highway 85 and E. 81h Street
corridor between the airport and downtown as a community entryway, and
using the Airport Master Plan for guidance in locating compatible land uses
near the airport.
2. The proposed annexation promotes geographical balance of the City's land
use pattern. This proposal will significantly expand the small area of property
located on and adjacent to the airport which is already located within the City
limits.
3. Adequate services are or will be available to support the development
expected to result from the proposed annexation. Two phases of new utility
infrastructure improvements have already been completed to serve the
property, with plans for further expansion as needed. Other existing utilities
adequately serve the property. Other services such as police and fire
protection are already provided to the property by the City. This proposal will
permit the City to collect the sales tax use taxes necessary to financially
support these services.
4. The proposed annexation provides for a continual and rational boundary.
The area included in the annexation is rational in that in encompasses all of
the property within the boundary limits of the airport.
5. The proposed annexation is needed to accommodate future land use
requirements. The Greeley-Weld County Airport,while already substantially
developed, plans to see even more substantial development in the future.
The success of the airport's marketing and development strategies rely upon
the access to City infrastructure and services, which are needed to
accommodate this growth.
B. Intent to include the property in the Northern Colorado Water Conservancy District
and Subdistrict:
The property to be annexed is already entirely within the Northern Colorado Water
Conservancy District. The owner intends to include the property in any appropriate
Subdistrict that may be applicable.
C. Information on ecological or land use conditions which may be hazardous including
oil and gas operations, steep slopes, wetlands, irrigation ditches, bodies of water
and flood areas:
The property to be annexed has several oil and gas producing wells located upon
it. Additionally, several irrigation ditches exist upon the property, some of which
have been enclosed in underground pipe and run beneath aeronautical facilities on
the property. Lastly, the Flood Plain, as identified on the current FEMA Firm Maps
crosses the property in a narrow channel from north to south along Sand Creek.
Since the last Firm Map updates, a 98" concrete arched culvert was installed to
divert the flood plain from those areas of the property to be developed. FEMA has
not updated the flood plain maps however.
The following additional information is provided to aid in the review of this
submittal:
D. Existing and anticipated land use patterns and zoning:
The general concept of the development and land uses on the property are or will
be consistent with that of a public general aviation airport facility, including light to
heavy commercial and industrial uses related to aviation. Land will be used for the
accommodation of aircraft hangars,apron areas, parking lots, and other associated
aviation support buildings and infrastructure. Existing zoning under Weld County
zoning requirements is C-3 through 1-3.
E. Size of existing or anticipated commercial and industrial facilities:
Existing and anticipated sizes of facilities on the property vary substantially. Aircraft
hangars and buildings as small as 2,500 square feet exist, as do facilities in excess

TO THE HONORABLE MAYOR AND CITY COUNCIL OF THE CITY OF GREELEY,
COLORADO:
The undersigned, in accordance with Tide 31, Article 12, Chapters 101 et. seq., Colorado
Revised Statutes, 1973, as amended, hereby petition the City Council of the City of Greeley
for annexation to the City of Greeley of the territory described herein and described and

City of Greeley is set forth in Exhibit A attached hereto and incorporated herein by reference.
In support of this petition, the Petitioner(s) allege(s) that:
1. It is desirable and necessary that the above-described territory be annexed to the City of
Greeley.
2. The requirements of Section 31-12-104 and 31-12-105 of the Colorado Revised Statutes
exist or have been met in that:
A. Not less than one-sixth (1/6) of the perimeter of the area proposed to be
annexed is contiguous with the City of Greeley.
B. A community of interest exists between the territory proposed to be annexed
and the City of Greeley.
C. The territory sought to be annexed is urban or will be urbanized in the near
future.
D. The territory sought to be annexed is integrated or is capable of being integrated
with the City of Greeley.
3. In establishing the boundaries of the territory proposed to be annexed, no land held in
identical ownership, whether consisting of one tract or parcel of real estate or two or
more contiguous tracts or parcels of real estate, has/have been divided into separate
parts or parcels of real estate without the written consent of the land owner or land
owners thereof, except and unless where such tracts or parcels are already separated by
a dedicated street, road, or other public way.
4. In establishing the boundaries of the territory proposed to be annexed, no land held in
identical ownership, whether consisting of one tract or parcel of real estate or two or
more contiguous tracts or parcels of real estate comprising twenty (20) acres or more
which, together with the buildings and improvements situated thereon have an assessed
valuation in excess of$200,000 for ad valorem tax purposes for the year next
preceding the filing of the written petition for annexation, has/have been included
within the territory proposed to be annexed without the written consent of the land
owner or land owners.
5. The territory proposed to be annexed does not include any area which is the same or
substantially the same area in which an election for an annexation to the City of
Greeley was held within the twelve months preceding the filing of this petition.
6. The territory proposed to be annexed does not include any area included in another
annexation proceeding involving a city other than the City of Greeley.
7. The territory proposed to be annexed is not presently a part of any incorporated city,
city and county, or town.
8. The property owned by each petitioner is described on each separate signature sheet
and, when needed, described more fully in the exhibits attached hereto and
incorporated herein by reference.
9. The signer(s) of this petition comprise(s) more than fifty percent (50%) of the land
owners and owning more than fifty percent (50%) of the property, excluding public
streets and alleys, and any land owned by the annexing municipality, and are, in fact,
owners of one hundred percent (100%) of the property set forth in Exhibit A attached
hereto and incorporated herein by reference.
Accompanying this petition are the original and four copies of an annexation plat map
containing the following information:
A. A written legal description of the boundaries of the area proposed to be
annexed.
B. A map showing the boundary of the area proposed to be annexed.
C. Within the annexation boundary map, an identification of the location of each
ownership tract in unplatted land and, if part or all of the area is platted, the
boundaries and the plat numbers of plots or of lots and blocks. Also within the
boundary map, identification of any special districts the area proposed to be
annexed may be part of.
D. Next to the boundary of the area proposed to be annexed, a drawing of the
contiguous boundary of the annexing municipality and the contiguous boundary
of any other municipality abutting the area proposed to be annexed.
E. A surveyor's certificate prepared by a registered land surveyor that attests to the
preparation of the map and certifies at least one-sixth (1/6) contiguity to the
City of Greeley.
F. Acceptance block describing the acceptance action of the City of Greeley in
form and substance as provided in Appendix A of the Subdivision Regulations
of the City of Greeley and providing for the effective date and City Clerk and
Mayor attest signatures.
10. Except as otherwise provided, no part of the territory sought to be annexed is more
than three miles from a point on the municipal boundary, as such was established more
than one year before this annexation will become effective.
11. As an expressed condition of annexation, land owner(s) consent(s) to inclusion into the
Northern Colorado Water Conservancy District and the municipal subdistrict pursuant
to Section 37-45-136 (3.6) C.R.S. Land owner(s) acknowledge(s) that, upon inclusion
into the district and subdistrict, land owner's(s') property will be subject to the same
mill levies and special assessments as are levied or will be levied on other similarly
situated property in the district and subdistrict at the time of inclusion of land
owner's(s') lands. Land owner(s) agree(s) to waive any right to an election which may
exist to require an election pursuant to Article X, Section 20, of the Colorado
Constitution before the district and subdistrict can impose such mill levies and special
assessments as it has the authority to impose. Land owner(s) also agree(s) to waive,
upon inclusion, any right which may exist to a refund pursuant to Article X, Section
20, of the Colorado Constitution.
THEREFORE, the undersigned respectfully petition(s) and requests the City Council of the

All of the property included in the Petitions for Annexation for the Greeley-Weld County
Airport Authority are wholly owned by the Greeley-Weld County Airport Authority, which is
a Political Subdivision of the State of Colorado, and which exists under the rules of the
Public Airport Authority Law as provided in CRS 41-3. The Greeley-Weld County Airport
Authority is a tax exempt entity.
All parcels contained in the Petitions for Annexation are located within the following Special
Districts. Only a portion of Parcel 4 however is located within the Eaton Fire Protection

NARRATIVE
The following Narrative is provided in conjunction with the Petitions For Annexation for the
Greeley-Weld County Airport.
A. Annexation criteria provided at Section 18.26.050.A.1-5 of the Development Code
including conformance with the City's Comprehensive Plan:
The proposed annexation meets the criteria of the above noted Section as follows:
1. The proposed annexation is in conformance with the City of Greeley
Comprehensive Plan. Paragraphs TR7.4 through TR7.7 of the City of
Greeley 2020 Comprehensive Plan outline the future plans and goals of the
City in terms of annexation of the balance of airport property into the City,the
expansion of aviation educational programs to advance economic
development objectives, recognition of the U.S. Highway 85 and E. 8th Street
corridor between the airport and downtown as a community entryway, and
using the Airport Master Plan for guidance in locating compatible land uses
near the airport.
2. The proposed annexation promotes geographical balance of the City's land
use pattern. This proposal will significantly expand the small area of property
located on and adjacent to the airport which is already located within the City
limits.
3. Adequate services are or will be available to support the development
expected to result from the proposed annexation. Two phases of new utility
infrastructure improvements have already been completed to serve the
property, with plans for further expansion as needed. Other existing utilities
adequately serve the property. Other services such as police and fire
protection are already provided to the property by the City. This proposal will
permit the City to collect the sales tax use taxes necessary to financially
support these services.
4. The proposed annexation provides for a continual and rational boundary.
The area included in the annexation is rational in that in encompasses all of
the property within the boundary limits of the airport.
5. The proposed annexation is needed to accommodate future land use
requirements. The Greeley-Weld County Airport,while already substantially
developed, plans to see even more substantial development in the future.
The success of the airport's marketing and development strategies rely upon
the access to City infrastructure and services, which are needed to
accommodate this growth.
B. Intent to include the property in the Northern Colorado Water Conservancy District
and Subdistrict:
The property to be annexed is already entirely within the Northern Colorado Water
Conservancy District. The owner intends to include the property in any appropriate
Subdistrict that may be applicable.
C. Information on ecological or land use conditions which may be hazardous including
oil and gas operations, steep slopes, wetlands, irrigation ditches, bodies of water
and flood areas:
The property to be annexed has several oil and gas producing wells located upon
it. Additionally, several irrigation ditches exist upon the property, some of which
have been enclosed in underground pipe and run beneath aeronautical facilities on
the property. Lastly, the Flood Plain, as identified on the current FEMA Firm Maps
crosses the property in a narrow channel from north to south along Sand Creek.
Since the last Firm Map updates, a 98" concrete arched culvert was installed to
divert the flood plain from those areas of the property to be developed. FEMA has
not updated the flood plain maps however.
The following additional information is provided to aid in the review of this
submittal:
D. Existing and anticipated land use patterns and zoning:
The general concept of the development and land uses on the property are or will
be consistent with that of a public general aviation airport facility, including light to
heavy commercial and industrial uses related to aviation. Land will be used for the
accommodation of aircraft hangars, apron areas, parking lots, and other associated
aviation support buildings and infrastructure. Existing zoning under Weld County
zoning requirements is C-3 through 1-3.
E. Size of existing or anticipated commercial and industrial facilities:
Existing and anticipated sizes of facilities on the property vary substantially. Aircraft
hangars and buildings as small as 2,500 square feet exist, as do facilities in excess
of 25,000 square feet. Additionally, the potential exists for large warehouse or
assembly buildings, up to or exceeding 100,000 square feet, which are anticipated
in the future. Each of these facilities would be directly related to either private,
corporate, commercial, or industrial aviation uses.

PETITION FOR ANNEXATION

TO THE HONORABLE MAYOR AND uiTY COUNCIL OF THE CITY OF GREELEY,
COLORADO:
The undersigned, in accordance with Title 31, Article 12, Chapters 101 et. seq., Colorado
Revised Statutes, 1973, as amended, hereby petition the City Council of the City of Greeley
for annexation to the City of Greeley of the territory described herein and described and
shown on the map designated, reeiey-Welri County

The applicable number of said map (at least fou.) .submitted herewith and by this reference
are incorporated herein. The description of the territory hereby petitioned for annexation to the
City of Greeley is set forth in Exhibit A attached hereto and incorporated herein by reference.
In support of this petition, the Petitioner(s) allege(s) that:
1. It is desirable and necessary that the above-described territory be annexed to the City of
Greeley.
2. The requirements of Section 31-12-104 and 31-12-105 of the Colorado Revised Statutes
exist or have been met in that:
A. Not less than one-sixth (1/6) of the perimeter of the area proposed to be
annexed is contiguous with the City of Greeley.
B. A community of interest exists between the territory proposed to be annexed
and the City of Greeley.
C. The territory sought to be annexed is urban or will be urbanized in the near
future.
D. The territory sought to be annexed is integrated or is capable of being integrated
with the City of Greeley.
3. In establishing the boundaries of the territory proposed to be annexed, no land held in
identical ownership, whether consisting of one tract or parcel of real estate or two or
more contiguous tracts or parcels of real estate, has/have been divided into separate
parts or parcels of real estate without the written consent of the land owner or land
owners thereof, except and unless where such tracts or parcels are already separated by
a dedicated street, road, or other public way.
4. In establishing the boundaries of the territory proposed to be annexed, no land held in
identical ownership, whether consisting of one tract or parcel of real estate or two or
more contiguous tracts or parcels of real estate comprising twenty (20) acres or more
which, together with the buildings and improvements situated thereon have an assessed
valuation in excess of$200,000 for ad valorem tax purposes for the year next
preceding the filing of the written petition for annexation, has/have been included
within the territory proposed to be annexed without the written consent of the land
owner or land owners.
5. The territory proposed to be annexed does not include any area which is the same or
substantially the same area in which an election for an annexation to the City of
Greeley was held within the twelve months preceding the filing of this petition.
6. The territory proposed to be annexed does not include any area included in another
annexation proceeding involving a city other than the City of Greeley.
7. The territory proposed to be annexed is not presently a part of any incorporated city,
city and county, or town.
8. The property owned by each petitioner is described on each separate signature sheet
and, when needed, described more fully in the exhibits attached hereto and
incorporated herein by reference.
9. The signer(s) of this petition comprise(s) more than fifty percent (50%) of the land
owners and owning more than fifty percent (50%) of the property, excluding public
streets and alleys, and any land owned by the annexing municipality, and are, in fact,
owners of one hundred percent (100%) of the property set forth in Exhibit A attached
hereto and incorporated herein by reference.
Accompanying this petition are the original and four copies of an annexation plat map
containing the following information:
A. A written legal description of the boundaries of the area proposed to be
annexed.
B. A map showing the boundary of the area proposed to be annexed.
C. Within the annexation boundary map, an identification of the location of each
ownership tract in unplatted land and, if part or all of the area is platted, the
boundaries and the plat numbers of plots or of lots and blocks. Also within the
boundary map, identification of any special districts the area proposed to be
annexed may be part of.
D. Next to the boundary of the area proposed to be annexed, a drawing of the
contiguous boundary of the annexing municipality and the contiguous boundary
of any other municipality abutting the area proposed to be annexed.
E. A surveyor's certificate prepared by a registered land surveyor that attests to the
preparation of the map and certifies at least one-sixth (1/6) contiguity to the
City of Greeley.
F. Acceptance block describing the acceptance action of the City of Greeley in
form and substance as provided in Appendix A of the Subdivision Regulations
of the City of Greeley and providing for the effective date and City Clerk and
Mayor attest signatures.
10. Except as otherwise provided, no part of the territory sought to be annexed is more
than three miles from a point on the municipal boundary, as such was established more
than one year before this annexation will become effective.
11. As an expressed condition of annexation, land owner(s) consent(s) to inclusion into the
Northern Colorado Water Conservancy District and the municipal subdistrict pursuant
to Section 37-45-136 (3.6) C.R.S. Land owner(s) acknowledge(s) that, upon inclusion
into the district and subdistrict, land owner's(s') property will be subject to the same
mill levies and special assessments as are levied or will be levied on other similarly
situated property in the district and subdistrict at the time of inclusion of land
owner's(s') lands. Land owner(s) agree(s) to waive any right to an election which may
exist to require an election pursuant to Article X, Section 20, of the Colorado
Constitution before the district and subdistrict can impose such mill levies and special
assessments as it has the authority to impose. Land owner(s) also agree(s) to waive,
upon inclusion, any right which may exist to a refund pursuant to Article X, Section
20, of the Colorado Constitution.

SPECIAL DISTRICTS
All of the property included in the Petitions for Annexation for the Greeley-Weld County
Airport Authority are wholly owned by the Greeley-Weld County Airport Authority, which is
a Political Subdivision of the State of Colorado, and which exists under the rules of the
Public Airport Authority Law as provided in CRS 41-3. The Greeley-Weld County Airport
Authority is a tax exempt entity.
All parcels contained in the Petitions for Annexation are located within the following Special
Districts. Only a portion of Parcel 4 however is located within the Eaton Fire Protection
District.

NARRATIVE
The following Narrative is provided in conjunction with the Petitions For Annexation for the
Greeley-Weld County Airport.
A. Annexation criteria provided at Section 18.26.050.A.1-5 of the Development Code
including conformance with the City's Comprehensive Plan:
The proposed annexation meets the criteria of the above noted Section as follows:
1. The proposed annexation is in conformance with the City of Greeley
Comprehensive Plan. Paragraphs TR7.4 through TR7.7 of the City of
Greeley 2020 Comprehensive Plan outline the future plans and goals of the
City in terms of annexation of the balance of airport property into the City,the
expansion of aviation educational programs to advance economic
development objectives, recognition of the U.S. Highway 85 and E. 8`"Street
corridor between the airport and downtown as a community entryway, and
using the Airport Master Plan for guidance in locating compatible land uses
near the airport.
2. The proposed annexation promotes geographical balance of the City's land
use pattern. This proposal will significantly expand the small area of property
located on and adjacent to the airport which is already located within the City
limits.
3. Adequate services are or will be available to support the development
expected to result from the proposed annexation. Two phases of new utility
infrastructure improvements have already been completed to serve the
property, with plans for further expansion as needed. Other existing utilities
adequately serve the property. Other services such as police and fire
protection are already provided to the property by the City. This proposal will
permit the City to collect the sales tax use taxes necessary to financially
support these services.
4. The proposed annexation provides for a continual and rational boundary.
The area included in the annexation is rational in that in encompasses all of
the property within the boundary limits of the airport.
5. The proposed annexation is needed to accommodate future land use
requirements. The Greeley-Weld County Airport,while already substantially
developed, plans to see even more substantial development in the future.
The success of the airport's marketing and development strategies rely upon
the access to City infrastructure and services, which are needed to
accommodate this growth.
B. Intent to include the property in the Northern Colorado Water Conservancy District
and Subdistrict:
The property to be annexed is already entirely within the Northern Colorado Water
Conservancy District. The owner intends to include the property in any appropriate
Subdistrict that may be applicable.
C. Information on ecological or land use conditions which may be hazardous including
oil and gas operations, steep slopes, wetlands, irrigation ditches, bodies of water
and flood areas:
The property to be annexed has several oil and gas producing wells located upon
it. Additionally, several irrigation ditches exist upon the property, some of which
have been enclosed in underground pipe and run beneath aeronautical facilities on
the property. Lastly, the Flood Plain, as identified on the current FEMA Firm Maps
crosses the property in a narrow channel from north to south along Sand Creek.
Since the last Firm Map updates, a 98" concrete arched culvert was installed to
divert the flood plain from those areas of the property to be developed. FEMA has
not updated the flood plain maps however.
The following additional information is provided to aid in the review of this
submittal:
D. Existing and anticipated land use patterns and zoning:
The general concept of the development and land uses on the property are or will
be consistent with that of a public general aviation airport facility, including light to
heavy commercial and industrial uses related to aviation. Land will be used for the
accommodation of aircraft hangars, apron areas, parking lots, and other associated
aviation support buildings and infrastructure. Existing zoning under Weld County
zoning requirements is C-3 through 1-3.
E. Size of existing or anticipated commercial and industrial facilities:
Existing and anticipated sizes of facilities on the property vary substantially. Aircraft
hangars and buildings as small as 2,500 square feet exist, as do facilities in excess
of 25,000 square feet. Additionally, the potential exists for large warehouse or
assembly buildings, up to or exceeding 100,000 square feet, which are anticipated
in the future. Each of these facilities would be directly related to either private,
corporate, commercial, or industrial aviation uses.
F. Estimated number of dwelling units:
None. A single residential unit exists upon the property as of the date of this
annexation, which is owned by the applicant. This structure is eventually scheduled
to be permanently removed from the property to accommodate commercial or
industrial development on its current site.
G. Estimated number of school students generated by the proposed annexation and
the anticipated zoning:
None. Development on the property will be limited strictly to commercial and
industrial uses and will generate no residential uses.

a Political Subdivision of the State of Colorado, and which exists under the rules of the
Public Airport Authority Law as provided in CRS 41-3. The Greeley-Weld County Airport
Authority is a tax exempt entity.
All parcels contained in the Petitions for Annexation are located within the following Special
Districts. Only a portion of Parcel 4 however is located within the Eaton Fire Protection

NARRATIVE
The following Narrative is provided in conjunction with the Petitions For Annexation for the
Greeley-Weld County Airport.
A. Annexation criteria provided at Section 18.26.050.A.1-5 of the Development Code
including conformance with the City's Comprehensive Plan:
The proposed annexation meets the criteria of the above noted Section as follows:
1. The proposed annexation is in conformance with the City of Greeley
Comprehensive Plan. Paragraphs TR7.4 through TR7.7 of the City of
Greeley 2020 Comprehensive Plan outline the future plans and goals of the
City in terms of annexation of the balance of airport property into the City,the
expansion of aviation educational programs to advance economic
development objectives, recognition of the U.S. Highway 85 and E. 8`h Street
corridor between the airport and downtown as a community entryway, and
using the Airport Master Plan for guidance in locating compatible land uses
near the airport.
2. The proposed annexation promotes geographical balance of the City's land
use pattern. This proposal will significantly expand the small area of property
located on and adjacent to the airport which is already located within the City
limits.
3. Adequate services are or will be available to support the development
expected to result from the proposed annexation. Two phases of new utility
infrastructure improvements have already been completed to serve the
property, with plans for further expansion as needed. Other existing utilities
adequately serve the property. Other services such as police and fire
protection are already provided to the property by the City. This proposal will
permit the City to collect the sales tax use taxes necessary to financially
support these services.
4. The proposed annexation provides for a continual and rational boundary.
The area included in the annexation is rational in that in encompasses all of
the property within the boundary limits of the airport.
5. The proposed annexation is needed to accommodate future land use
requirements. The Greeley-Weld County Airport,while already substantially
developed, plans to see even more substantial development in the future.
The success of the airport's marketing and development strategies rely upon
the access to City infrastructure and services, which are needed to
accommodate this growth.
B. Intent to include the property in the Northern Colorado Water Conservancy District
and Subdistrict:
The property to be annexed is already entirely within the Northern Colorado Water
Conservancy District. The owner intends to include the property in any appropriate
Subdistrict that may be applicable.
C. Information on ecological or land use conditions which may be hazardous including
oil and gas operations, steep slopes, wetlands, irrigation ditches, bodies of water
and flood areas:
The property to be annexed has several oil and gas producing wells located upon
it. Additionally, several irrigation ditches exist upon the property, some of which
have been enclosed in underground pipe and run beneath aeronautical facilities on
the property. Lastly, the Flood Plain, as identified on the current FEMA Firm Maps
crosses the property in a narrow channel from north to south along Sand Creek.
Since the last Firm Map updates, a 98" concrete arched culvert was installed to
divert the flood plain from those areas of the property to be developed. FEMA has
not updated the flood plain maps however.
The following additional information is provided to aid in the review of this
submittal:
D. Existing and anticipated land use patterns and zoning:
The general concept of the development and land uses on the property are or will
be consistent with that of a public general aviation airport facility, including light to
heavy commercial and industrial uses related to aviation. Land will be used for the
accommodation of aircraft hangars, apron areas, parking lots, and other associated
aviation support buildings and infrastructure. Existing zoning under Weld County
zoning requirements is C-3 through 1-3.
E. Size of existing or anticipated commercial and industrial facilities:
Existing and anticipated sizes of facilities on the property vary substantially. Aircraft
hangars and buildings as small as 2,500 square feet exist, as do facilities in excess
of 25,000 square feet. Additionally, the potential exists for large warehouse or
assembly buildings, up to or exceeding 100,000 square feet,which are anticipated
in the future. Each of these facilities would be directly related to either private,
corporate, commercial, or industrial aviation uses.
F. Estimated number of dwelling units:
None. A single residential unit exists upon the property as of the date of this
annexation,which is owned by the applicant. This structure is eventually scheduled
to be permanently removed from the property to accommodate commercial or
industrial development on its current site.
G. Estimated number of school students generated by the proposed annexation and
the anticipated zoning:
None. Development on the property will be limited strictly to commercial and
industrial uses and will generate no residential uses.

COMPREHENSIVE PLAN: The site is within the Long-Range
Expected Growth Area (LREGA) and the
Mid Range Expected Service Area
(MRESA). This means the properties are
expected to be developed in the City in
the next five years. The site is outside the
Municipal Service Suitability Area
(MSSA). This means that full urban
services are not available to the entire
site at this time.
The annexation complies with
Comprehensive Plan policy TR7.4 which
provides for the annexation of the
airport. The City of Greeley and the
Greeley-Weld County Airport Authority
has entered into an agreement regarding
annexation and addressing issues of
common concern.
ANALYSIS: The areas of annexation comply with
Colorado Revised Statute 31-12-104 and
31-12-105 and include: (1) Not less than
one-sixth (1/6) of the perimeter of the
area proposed to be annexed is
contiguous with the City of Greeley, (2)
A community of interest exists between
the territory proposed to be annexed and
the City of Greeley, (3) The territory
sought to be annexed is urban or will be
urbanized in the near future, (4) The
territory sought to be annexed is
integrated or is capable of being
integrated with the City of Greeley.

The annexations will help balance the
physical growth of the City.
City water and sewer service are
currently available to the site. The
property is serviced by the Union Colony
Fire/Rescue Protection District. Dry
utilities are also available to the property.
This annexation will not impact to the
local school district. The properties do
not contain residential dwelling units nor
students and the future development of
homes on the property is unlikely given
the incompatible impacts associated with
the airport use.
The annexation of this site into the City
would be consistent with present growth
patterns and Comprehensive Plan
policies. There is clear evidence that this
site shares a common interest with the
City's future. The requirements of State
statutes and City of Greeley guidelines
for annexation appear to have been met
by this annexation.

ANNEXATION AGREEMENT
This Annexation Agreement,hereinafter known as the"Agreement,"is made this day
of "Sc./ , 2002, by and between the CITY OF GREELEY, COLORADO, A
Municipal Cdrporation,hereinafter called"City,"and the GREELEY-WELD COUNTY AIRPORT
AUTHORITY, a Body Corporate and Politic of the State of Colorado, hereinafter known as
"Authority."
Background of Agreement. The following background statements are made to aid in the
understanding and interpretation of this Agreement:
A. The Authority was established by the City and Weld County pursuant to Colorado
Revised Statutes, §41-3-101, et seq., hereinafter known as the "Public Airport
Authority Law."
B. The Authority, pursuant to the Public Airport Authority Law, has ownership and
control over the property shown on"Exhibit A,"and the said property is hereinafter
known as the"Airport Property."
C. Pursuant to the Public Airport Authority Law, the Authority is responsible for
administering the affairs of the Greeley-Weld County Airport, including but not
limited to,promoting the growth and responding to the needs of all aspects of general
aviation.
D. The City has previously annexed a portion of the Airport Property and,pursuant to
the terms and conditions of this Agreement, the Authority agrees to petition for
annexation of the remainder of the Airport Property to the City.
NOW,THEREFORE,in consideration of the mutual promises of the parties,it is agreed as
follows:
1. Annexation of Airport Property. Upon signature of both parties to this Agreement,
the Authority agrees to execute a petition requesting annexation to the City of all of
the Airport Property which has not been previously annexed to the City, a copy of
said Airport Property which is attached hereto and incorporated herein as "Exhibit
B."
2. Recognition of Authority as Independent Body. The City hereby recognizes the
Authority to be an independent legal governing authority for the Greeley-Weld
County Airport, and affirmatively states that it has no present intention of voting to
dissolve the Authority pursuant to Colorado Revised Statutes §41-3-104(6).
3. Appropriation of Funds. The Authority depends upon the City and Weld County to
provide revenue for matching funds to obtain Federal Aviation Administration
grants, as well as additional revenue for development of the Airport generally. The
City and Weld County intend to continue to provide reasonable and necessary
revenue appropriation to the Authority in the future. It is the intention of both the
City and the Authority to make the Greeley-Weld County Airport successful and,as
such,the parties recognize that the Airport will need funding to meet its future needs.
The City therefore,expresses its good faith intent to annually appropriate such funds
consistent with its obligations to the Authority.
4. Sales,Use and Ad Valorem Taxes. The parties recognize that the Authority is a tax-
exempt entity under State law,and the Authority shall neither be required to pay any
City Sales Tax on purchases for the Authority,nor Ad Valorem Taxes on its property
in accordance with law. All persons using, occupying,visiting,providing services,
supplies,improvementsand/ormaterials to any non-exempt entity,person,company
and/or corporation shall be required to assess, collect and pay all sales,use and Ad
Valorem Taxes as required by law. Taxes shall be assessed and collected on real
property,personal property and improvements on which a non-exempt person and/or
entity holds an applicable"possessory interest," as that term is defined by law, and
interpreted by County of Weld.
5. • Compliance with Building Codes. The City and Authority agree that existing
buildings on the Airport Property which were lawfully in compliance with Building
Codes when built, whether owned by Authority or its tenants, shall be allowed to
continue to exist in accordance with City of Greeley ordinances, including any
applicable "nonconforming use" provisions of the City of Greeley Development
Code.
6. Compliance with Zoning Code. The City and Authority agree that existing buildings
and uses of property that are in compliance with Weld County Zoning Ordinances at
the time of annexation will be allowed to continue their present uses in accordance
with the"nonconforming use"provision of the City of Greeley Development Code.
The parties expressly understand and agree that the Airport Property must be zoned
to City a zoning classification within 90 days of annexation.
7. Raw Water Dedication for New Development. Upon the annexation of the Airport
Property to the City of Greeley,no water rights need to be transferred to the City for
new development on the Airport Property until such development occurs, in
accordance with the provisions of Greeley Ordinance 14.24.130 and applicable Water
and Sewer resolutions,regulations and rules, including but not limited to,"cash-in-
lieu" raw water payments. Except as modified by paragraphs 7 and 8 of this
Agreement,the Authority agrees that it will meet all water requirements required by
Greeley's rules,regulations and Ordinances, as may be amended from time to time.
The parties agree that all new development requiring water service must connect to
City water service.

8. No Required Transfer to City Water Service Where Water Service Exists. Except
as required by State law and/or the Airport Master Plan,neither the Authority nor any
of its existing tenants presently connected to a non-City water system shall be
required to convert to the City's water system and may continue with the present
supplier of water. However, at Authority and/or tenant's option, Authority and/or
tenants presently on a third-party water system may convert to City water. Prior to
connecting to the City Water system, there shall be the obligation of the party
desiring connection to pay all the then existing fees,charges and/or raw water due to
the City at the time of connection for that portion of the Airport Property so served
by such connection. Except for existing tenants connected to a non-city water
system,the parties agree that all development requiring water service must connect
to City water service when such development occurs.
9. Construction and Maintenance of Paved Access Roads. The Authority agrees to
construct and maintain all streets and roads upon Airport Property, including snow
removal. All repairs, renovation and/or reconstruction of such roads shall be
performed by the Authority, at the Authority's sole cost and expense. The City
agrees that all roads and parking area upon Airport Property are private roads and
property of the Authority and not subject to City standards. As such,the Authority
agrees and asserts that all construction, maintenance, liability and judgments
resulting from third party claims for damages remain the sole responsibility of the
Authority. Nothing contained herein, expressly or implied,waives any regulations,
requirements, restrictions and/or immunities of the Colorado Governmental
Immunity Act§24-10-101,C.R.S. The parties hereto expressly reserve all provisions
of the Colorado Governmental Immunity Act unto themselves.
10. City Ordinance Exempting Installed Aircraft Parts. To the extent allowed bylaw,the
City will use its best efforts to promote the adoption of the City ordinance exempting
from sales and use tax the storage, use, or consumption of any tangible personal
property which is to be affixed or attached as a component part of an aircraft. The
proposed City ordinance shall provide the same exemptions as stated in C.R.S. §29-
26-114(1)(a)(XXIII) and C.R.S. §29-26-204(1)(cc).
11. Aviation Fuel Storage. The City acknowledges that the Airport will be using and
storing aviation fuel on the Airport property,either in above-ground or underground
bulk-storage facilities. All above-ground fuel storage facilities, existing at the time
of execution of this Agreement, shall be deemed legal "nonconforming uses"of the
City Development Code. However,all such facilities must be approved by the Union
Colony Fire/Rescue Authority.
12. Zoning of Property Surrounding Airport Property. The City has reviewed and,
concurs with the "Master Plan" for development of the Airport, as adopted by the
Authority. The Airport Master Plan is referenced in the City's 2020 Comprehensive

Plan. As future annexations occur on property surrounding the Airport,the City will
consider the impact of such development on the Airport in accordance with the
existing and future adopted Airport Master Plans, City Comprehensive Plans and
City Development Codes. Considerations will include, but not be limited to,
restricting residential development on areas immediately surrounding the Airport and
other appropriate controls to assure continuing compatibility of land uses. To the
extent allowed by law,the City will use its best efforts to promote the adoption of a
City ordinance regarding the imposition of height restrictions similar to Weld
County's Airport Overlay District, C.R.S. §23-5-30.
13. Existing Uses. The City does not contemplate any City-initiated change of Airport
Property to any uses not stated in the Airport Master Plan.
14. City Facilities of the Property. City owned and/or operated structures and facilities
for fire protection, police use and protection and other City services shall be
constructed by the City at no cost to the Authority unless required by federal or state
laws,rules and/or regulations. Fire,police and other City services shall be provided
to the Authority on the same basis as other areas of the City.
15. Sewer Service. The City shall not require upon annexation of the property that the
Airport or its tenants be required to connect to or be served by City Sewer, except as
required by State law and/or the Airport Master Plan. Any connection and/or
extension of City sewer lines to the Airport Property shall occur only upon the
Authority's request and then subject to and in accordance with City rules,regulations
and ordinances.
16. City Rules,Regulations and Ordinances to Apply. Unless specifically modified by
this Agreement, the parties agree that all City rules, regulations, procedures, taxes,
fees and Ordinances hereby apply to the Authority,its property,tenants,lessees,users
and invitees.
17. Miscellaneous Provisions.
(a) Neither party shall be bound by any requirement which is not specifically
stated in this Agreement.
(b) This Agreement constitutes the entire Agreement between the parties; no
practice, stipulation,understandings,or memoranda shall be construed as in
any way modifying, altering or amending the terms and conditions hereof.
(c) The parties agree that any rule of construction to the effect that ambiguities
are to be resolved against the drafting party shall not apply in the
interpretation of this Agreement.

(d) This Agreement is binding upon and for the benefit of the successors and
assigns of the parties to this Agreement.
(e) This Agreement may only be modified by the parties hereto in writing.
