Environmental Health Services has reviewed this proposal for a Kennel (25 dogs). We
have no objections to the proposal, however, if the applicant is required to meet the
requirements of Pet Animal Care Facilities Act (PACFA) and invited guests are allowed
to use the restroom, the existing residential septic system may be inadequate to meet
the hydraulic load and may need to be amended. The following synopsis is intended to
explain our concerns:
The applicant's has a permitted Individual Sewage Disposal System (ISDS) permit (SP-
, 0100130) for a 3 bedroom residence. It is the divisions understanding that invited
guests will be allowed to use the house restroom facilities. In addition, water and
sewerage usage may be increased if the kennel is required to meet the licensing
standards outlined by the Colorado Department of Agriculture, Pet Animal Care
Facilities Act (PACFA). For these reasons, it is EHS recommendation that the septic
system permit be evaluated by a Professional Engineer and that the septic permit be
amended for commercial use.
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence to the Department of Planning Services,
from the Colorado Division of Water Resources, demonstrating that the well is
appropriately permitted for the use.
2. The applicant shall provide written evidence to the Weld County Department of
Public Health and Environment that the applicant has contacted the Colorado
Department of Agriculture (CDA), Division of Animal Industry. This contact shall
determine if a license under the Pet Animal Care Facilities Act (PACFA), as
defined under C.R.S. 35-80-101 through 117. C.R.S. is required, or provide
evidence that the applicant is not subject to the PACFA requirements.

3. The septic system serving the home shall be reviewed by a Colorado Registered
Professional Engineer. The review shall consist of observation of the system and
a technical review describing the systems ability to handle the proposed
hydraulic load. The review shall be submitted to the Environmental Health
Services Division of the Weld County Department of Public Health and
Environment. In the event the system is found to be inadequately sized or
constructed, the system shall be brought into compliance with current
Regulations.
4. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. Animal and feed wastes, bedding, debris and other organic wastes shall be
disposed of so that vermin infestation, odors, disease hazards, and nuisances
are minimized. Such wastes shall be removed at least weekly from the facility
and disposed by a commercial hauler.
2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
3. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
4. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.

5. The applicant shall operate in accordance with the approved "waste handling
plan".
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
7. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S., as amended.
8. Adequate handwashing and toilet facilities shall be provided for invited guests of
the facility.
9. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
10.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
11.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
12.If applicable, the applicant shall operate in accordance with the requirements of
the Colorado Department of Agriculture, Division of Animal Industry.
13.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code,

As we discussed this morning I made a site visit to the Voshel property yesterday (9-20-04). The following
conditions ( numbering from my referral/memo dated 9-8-04) have been resolved or are not relevant.
Condition 1. The well is appropriately permitted as domestic, irrigation and watering of domestic animals. This is
not a commercial endeavor.
Condition 2. The PACFA License has been issued.
Condition 3. The Septic System Permit is adequate for the Modular home. The applicant has stated that his
operation is strictly for his own dogs.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our
comments and requirements are as follows:
COMMENTS:
WCR 17 is designated on the Weld County Road Classification Plan (FHU) as a local gravel road, which
requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23,
Article III, Section 23-3-50, the required setback is measured from the future right-of-way line.
'-REQUIREMENTS:
Access: The plat drawing is reflecting one access point from WCR 17. Utilize this access point for
residential/agricultural in the proposed USR.
Off-Street Parking and Circulation: The plat drawing is reflecting the driveway to the residence and the
kennel area with a turnaround. The access drive to both locations should have adequate gravel or the
equivalent to provide an all-weather access to the facility and should be graded to prevent drainage problems.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent property damage of the
type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned
ponding of storm run-off.
I am referring a portion of this site to the Department of Health and Environment as it deals with animal units.

A Site Specific Development Plan and special Review permit for a kennel (25 dogs) in the A (Agricultural)
Zone District.
1. A building permit shall be obtained prior to the construction of any new building or addition to the existing
building.
2. A plan review is required for each building for which a building permit is required. Plans shall include a floor
plan. Plans may be required to bear the wet stamp of a Colorado registered architect or engineer. Two complete
sets of plans are required when applying for each permit.
Buildings shall conform to the requirements of the various codes adopted at the time of permit application.
Currently the following has been adopted by Weld County: 2003 International Building Code; 2003 International
Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; and the 2002 National
Electrical Code and Chapter 29 of the Weld County Code.
4. The building use will probably be classified as B (kennel). Fire resistance of walls and openings, construction
requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and
offset distances shall be determined by the Zoning Ordinance.
5. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be
measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset
and setback requirements. Offset and setback requirements are measured to the farthest projection from the
building.
