If a question does not pertain to your use, please respond with "not applicable", with an explanation as to why the question is not applicable. 1. Explain, in detail, the proposed use of the property. RESPONSE: The property has a Conditional Use Permit ("Current CUP" issued and approved April 6, 1977, and recorded April 7, 1977, in Weld County Clerk& Recorder records at Reception No. 1715763. The Current CUP permits up to 100 migrant farm laborer housing between May and September. The proposed amendment to the Current CUP would permit up to 60 migrant labor persons on the Property during May 1 through October 31 and 20 persons to occupy the Property the remainder of the year(November 1 through April 30). The amendment would reduce the number of persons on site during the summer months, while increasing the usefulness and functionality of the Property, but making it economically realistic to maintain and protect the Property for the full year. 2. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22 (Comprehensive Plan). RESPONSE: Section 22-2-60, Goal 1, A of the Comprehensive Plan indicates that it is the County's goal to "Preserve prime farmland for agricultural purposes which foster the economic health and continuance of agriculture." Providing housing to an economical source of labor is essential to accomplishing this goal. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. RESPONSE: Section 23-3-10 of the Weld County Code indicates"Agriculture in the COUNTY is considered a valuable resource which must be protected from adverse impacts resulting from uncontrolled and undirected business, industrial and residential land USES. The A(Agricultural) Zone District is established to maintain and promote agriculture as an essential feature of the COUNTY....The A(Agricultural)Zone District is also intended to provide areas for the conduct of USES by Special Review which have been determined to be more intense or to have a potentially greater impact than USES Allowed by Right." Specifically, Section 23-3-40 M. permits Uses by Special Review to be issued for the"MULTI-FAMILY DWELLINGS for persons PRINCIPALLY employed at or engaged in FARMING, RANCHING or GARDENING. The site has been used for migrant farm labor housing for approximately 26 years under the present Conditional Use Permit 4. What type of uses surround this site? Explain now the proposed use is consistent and compatible with surrounding land uses. 1 RESPONSE: The triangle shaped property is bordered on the north by the railroad and an I-76 frontage road, on the east by farm ground, and on the south by a Hudson City Park. The site has been used for migrant farm labor housing for approximately 26 years under the present Conditional Use Permit. 5. Describe, in detail, the following: a. How many people will use this site? RESPONSE: The Applicant requests that he be permitted to used the site to house up to 60 migrant farm laborers between May 1 and September 30th of each year and 20 migrant farm laborers between October 1 and April 30th of the following year. b. How many employees are proposed to be employed at this site? RESPONSE: As stated in the Conditional Use Permit, one person occupies the site full time for the purpose of maintenance and security. c. What are the hours of operation? RESPONSE: The site is occupied 24 hours per day seven days a week. d. What type and how many structures will be erected (built) on this site? RESPONSE: No new structures are being built. e. What type and how many animals, if any, will be on this site? RESPONSE: Two household pets. f. What kind (type, size, weight) of vehicles will access this site and how often? RESPONSE: There are 6— 8 cars accessing the property which are owned by the workers and used for their transportation to and from work. g. Who will provide fire protection to the site? RESPONSE: Hudson Fire Department, Hudson, Colorado, provides fire protection as reflected in the existing Conditional Use Permit. h. What is the water source on the property? (Both domestic and irrigation) RESPONSE: A domestic well under Permit No 21904-F and Public Water System No. 162360. 2 i. What is the sewage disposal system on the property? (Existing and proposed) RESPONSE: Septic tank system with 2000 gallon capacity. See Weld County Department of Public Health and Environment Statement of Existing Septic System submitted with application. j. If storage or warehousing is proposed, what type of items will be stored? RESPONSE: There is no storage or warehousing on the property. 6. Explain the proposed landscaping for the site. The landscaping shall be separately submitted as a landscape plan map as part of the application submittal. RESPONSE: There is no "formal" landscaping on the property. The property is kept neat and trash free. 7. Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. RESPONSE: None. 8. Explain how the storm water drainage will be handled on the site. RESPONSE: The property slopes toward the north. The storm water naturally drains toward the railroad. 9. Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin. RESPONSE: There is no new construction. 10. Explain where storage and/or stockpile of wastes will occur on this site. RESPONSE: There is no storage or stockpiling of waste on the site. All trash/waste is removed and the property is kept in a neat manner. 3 Hello
