RE: APPROVAL OF RECORDED EXEMPTION NO. 482 - ADA MAY GUARD
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held on
the 18th day of February, 1981 in the Chambers of the Board of
County Commissioners of Weld County, Colorado , that the division
into two parcels of land, as shown on the plat known as Recorded
Exemption No. 482 , being the property of Ada May Guard, described
as Part of the Southwest Quarter of Section 33 , Township 7 North,
Range 66 West of the 6th P.M. , Weld County, Colorado, being more
particularly described as follows , does not come within the
purview of the definition of the terms "subdivision" and "sub-
divided land, " pursuant to its authority under Section 30-28-101
(10) (d) , CRS 1973 , as amended:

A tract of land located in the Southwest
Quarter of Section 33 , Township 7 North,
Range 66 West of the 6th P.M. , of Weld
County, Colorado, being more particularly
described as follows:
Considering the West line of the Southwest
Quarter of said Section 33 as bearing South

tained herein relative thereto;

WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definitions of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended,
and Section 2-1A(3) of the Weld County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcels of land owned by Ada May Guard be, and hereby are, exempt
from the definition of the terms "subdivision" and "subdivided
land" pursuant to its authority under Section 30-28-101 (10) (d) ,
CRS 1973 , as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 18th day of
February, A.D. , 1981.

Dear Commissioners:
The attached application, plat, and related items are in reference to a
request from Ada May Guard for a recorded exemption. The parcel of
land on which this request has been made is described as part of the
SW4, Section 33, T7N, R66W of the 6th P.M. , Weld County, Colorado. The
property contains approximately 70.59 acres of Class II irrigated soils.
The request is to split the property into parcels of 1.9 acres and 68.69
acres.
On December 31, 1980, the Board of County Commissioners approved a
request from Ms. Ada May Guard for a lot size variance so that she
could make application for a recorded exemption. At the time they
made the decision on that request, the Department of Planning Services
Staff submitted a letter of recommendation to the Board. A copy of
that recommendation is included in the attached packet. Nothing has
been received by our office that would change our recommendation of
approval for this request as outlined in the letter to the Board of
County Commissioners dated December 31, 1980.
This request complies with the provisions of Section 9-4 A. of the
Weld County Subdivision Regulations.

I want to sell approximately 1 3/4 acres: of the approximately 70 acres
I own in the SW% of ectien 33, Township 7 North, Range 66 West of the
6th PM , Weld County.
A sketch of the property and a copy of my deed to it are attached.
I am not going to offer this land for sale publicly. If I am permitted
to sell, it will be sold to Ralph Prior. In our contract, Mr. Prior and I
will give each other the first right of refusal in case either of us decides
to sell at some future time.
The proposed sale would not change the use of any of the property. In
fact, this is an "attempt to stabilize and continue the situation which
now exists. I have leased this farm to Ralph Prior for the last six years.
This relationship has been satisfactory and profitable to us both. I want
to make this sale because I must - at 68 years of age - anticipate the time
when I cannot manage the property myself and the time when my children will
inherit this farm. This sale would increase the likelihood that Ralph Prior
would continue to lease the farm and would, when the need arises, take over
the management of it completely. On the other hand, Mr. Prior, altho-x a
successful tenant farmer, is unable to buy a place of his own at present
prices. For him, buying this small tract and getting the right of refusal
should the rest of the farm be for sale would give him the satisfaction
ofmaking a. step in the direction of his goal of land ownership.
The tenant house which is on the larger parcel is occupied by seasonal
workers.
I do not live on this property myself.

Dear Commissioners:
The attached letter and related materials are in reference to a request
for a lot size variance from Ada May Guard. The property on which this
request has been made is described as part of the SW4, Section 33, T7N
R66W of the 6th P.M., Weld County, Colorado. This property is located
3 miles east of Severance. The property under consideration contains
approximately 70 acres of class 11 irrigated soils. The request is to
obtain a variance from the minimum lot size requirement, Section 9-4 A.
(6) of the Weld County Subdivision Regulations, so that she may make ap-
plication for a recorded exemption.
If this lot size variance if granted Mrs. Guard will proceed with an ap-
plication for a recorded exemption to divide the property into two parcels.
She has submitted a detailed letter dated December I , 1980 which sets forth
her reasons why she is requesting the lot size variance.
Based upon the information submitted and the adopted policies in the County,
the Department of Planning Services staff recommends the request be approved
for the following reasons:
I . The request conforms with Section 9-2 of the Weld County
Subdivision Regulations ( intent clause of the recorded
exemption procedure, Section 3-3 A. of the Weld County
Zoning Resolution ( intent clause of the Agricultural Zoned
District) and the Weld County Comprehensive Plan in that
each proposed parcel does have an existing set of improve-
ments. The use will be compatible with surrounding agri-
cultural uses. The request will allow agricultural and
related uses to be the predominant land use. There will
be no reduction in the amount of land currently being used
for agricultrual production. Furthermore, this action will
not cause increased impacts from residential development on
the parcel in question or the surrounding area as residential
improvements exist on the proposed parcels.

2. This request complies with Section 9-4 A. (6) of the Weld
County Subdivision Regulations because in the opinion of
the Department of Planning Services Staff, the applicant
has shown good cause for the variance.
