Dear Michelle.
Under cover letter dated September 8, 2004, Patina Oil & Gas Corporation ("Patina")
expressed concerns over the Planned Unit Development and Change of Zone proposed under the
PZ-1050 for the captioned property (the "Property"). Unfortunately, the notice Patina received
from the P&A Turkey Farms(the"Applicant")and Weld County Department of Planning Services
did not show a vicinity map or sketch map that indicated the actual parcels of land on the Property
that would be affected by PZ-1050. An agent for the Applicant has subsequently provided Patina
with a plat prepared by King Surveyors dated July, 31, 2003 (the"Plat") that provides additional
detail of the individual parcels on the Property under consideration. According to the Plat, Lots A
& B of Recorded Exemption 2663 (containing approximately 23 acres and located approximately
Northwest of the Gilmore Canal) are not subject to PZ-1050. The only well Patina operates in the
NE/4 of Section 36 is located on the parcels that includes Lots A&B of RE 2663. Therefore, Patina
is no longer concerned about the impact that PZ-1050 will have on the Dome Farm State 36-2 well
and its associated operations.

Ladies and Gentlemen:
Patina Oil & Gas Corporation ("Patina") has been contacted by Weld County Department of Planning
Services regarding the proposed Planned Unit Development and Change of Zone for estate lots and
agricultural uses on portions of the captioned property ("Property"). Patina operates the Dome Farm State
36-2 oil and gas well (the "Well"), associated pipelines and production facilities located in the NW/4NE/4
of the Property. Patina is concerned about the impact the proposed development will have on Patina's
ability to produce, operate and maintain the Well, pipelines, access roads and production facilities located
on the Property. Patina has not had any direct discussions with P&A Turkey Farms (the "Owners") relative
to this proposal. Fo date, no agreement has been finalized and Patina has received no written confirmation
from the Owners that Patina's real property rights to use a reasonable portion of the surface for oil and gas
operations and development are being preserved.
Patina requests assurance from the Weld County Department of Planning Services that the proposed
development will not preclude Patina from producing. operating, drilling and maintaining its Well and
related facilities. Until this matter is resolved by agreement with the Owners, Patina is not waiving its rights
as a leasehold owner. Any approval of the proposed development should be conditioned upon the
preservation of Patina's real property rights that allow it to make reasonable use of the surface of the lands
for oil and gas development and operations. The proposed development must take into account and provide
adequate setbacks from Patina's current and future well sites, pipelines and production facilities as well as
continuous access to these facilities.
Patina requests that these comments be entered into the record for the proposed development and that we
continue to be provided with advance notice of all future hearings affecting the Property. If you have any

Dear Surrounding Property Owner:
P&A Turkey Farms has entered into a Conservation Easement with Colorado Open Lands for our
property located south of and adjacent to Weld County Road 52 and west of and adjacent to Weld County
Road 49. The Conservation Easement was placed upon 101 acres of our 122-acre property. This
Conservation Easement prohibits future development on this portion of the property.
The remaining 21 acres are under review by Weld County for a non-urban Planned Unit Development.
The general concept of the development is to create a non-urban scale residential subdivision including
nine single-family estate lots. These lots range in size from approximately 1.5 to 2.0 acres in size. The
lots have been clustered in the northeastern corner of the property in the vicinity of the existing residential
improvements.
Agricultural activities have been occurring on the site. Weld County's Right to Farm statement will be
placed on all recorded plats. By doing so, future residents of the subdivision will be aware of long-
standing agricultural practices in the area.
This letter has been mailed to all property owners within 1,000 feet as a courtesy. Weld County will
notify surrounding property owners within 500 feet of the Planning Commission and Board of County
Commissioners hearings regarding the Change of Zone for the Planned Unit Development. Todd Hodges
Design, LLC has been retained as the land use planning consultant regarding this application. Please feel
