RE: ACTION OF BOARD CONCERNING MOBILE HOME PERMIT, ZPMH #575 - DANIEL
OCHSNER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board of County Commissioners of Weld County,Colorado,on the 10th day
of November, 2003, considered the request of Daniel Ochsner, 18905 Weld County Road 394,
LaSalle, Colorado 80645, for a mobile home to continue to be used as a Temporary Accessory to
the Farm, and
WHEREAS, said mobile home is currently occupied in an A(Agricultural)Zone District on
a parcel of land being more particularly described as follows:
Part of the SE1/4 of Section 30, Township 5 North,
Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS,at said hearing before the Board on the 10th day of November,2003,and at the
request of the applicant,the Board deemed it advisable to continue said matter to November 24,
2003, and
WHEREAS,as said hearing on November 24,2003,with onlythree Commissioners present,
and at the request of the applicant, this matter was again continued to January 12, 2004, and
WHEREAS,at said hearing on January 12, 2004,the Board deemed it advisable to accept
the request for withdrawal from the applicant, Daniel Ochsner.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that the request of Daniel Ochsnerfor permission to retain a mobile home which
is currently being used as a Temporary Accessory to the Farm on the above described parcel of
land,which was found to be in compliance with Chapter23,Article IV,Division 3,of the Weld County
Code, be, and hereby is, withdrawn.

SUBJECT: ZPMH-575
On March 6, 2003 Daniel Ochsner was given a conditional approval by Planning Staff for RE-3502. A
Condition of Approval was included to re-justify ZPMH-575 as an accessory to the farm. In a memo
received September 2, 2003 planning staff was told that the mobile home permitted by ZPMH-575 was no
longer on the property. Staff conducted a field check on October 24, 2003 and found that the mobile home
is still located on the property. Staff has conducted field checks on two separate occasions. No animal
units were seen on the site, nor is any of the site actively farmed. Further, this temporary mobile home is
within the floodway.

Pursuant to the zoning laws of the State of Colorado and the Weld County Code, a public
hearing will be held in the Chambers of the Board of County Commissioners of Weld County,
Colorado,Weld County Centennial Center, 915 10th Street, First Floor, Greeley, Colorado, at the
time specified.

days prior of the hearing. The cost of engaging a court reporter shall be borne by the requesting

formation Report, South Platte River, Volume 1, by Corps. of Engineers, April,
1977, using Plate 125 and Table 9, interpolation between cross-section 59 and
60.
Finish floor elevation of exi3tirx3 mobile hnme on October 29, 1981 = 4554.7 ft.
100 year flood elevation of mobile home = 4651.2 ft.
The finish floor of mobile home is 3.5 ft. above the 100 year flood elevation
at its present location.
The elevation for the mobile home was transferred from a United States ;eologi-
cal Survey (USES) Bench Mark being 4650, Denver Datum 22, with an elevation of
4651.20.

No records exist as to the septic system mentioned in the
Moody request .
We recommend that an application be made to this office for
a arge-sized holding tank to serve the proposed part-time re-
sitencr. Water table and soils analyses from the Soil Conserve-
ticn Service's Soil Survey of Weld County, Colo. Southern part in- '..
dic,.te great potential for a very high water table, severe limit-
ations for septic system absorption fields , and the possibility
for brief flooding. Such conditions are not conducive • to the pro-
per functioning of individual sewage disposal systems .

Re: Moody zoning, ZPMH-575
Dear Mr. Allison:
We have received the above referenced proposal for a mobile home, zoning.
The application indicates water would be supplied from an existing well, how-
ever, no information is provided. The information presented indicates there
are currently 3 houses on this property.
Colorado Revised Statutes (1973) 37-92-602 sets criteria for exempt
wells. This statute provides that certain wells serving no more than three
single family dwellings may be considered exempt from administration. A well
serving more than three dwellings would not benefit from exempt status and
would be subject to curtailment unless supported by an augmentation plan.
Since it appears the mobile home would become the fourth dwelling to be
served by this well, we would not recommend approval.

This supercedes the memo of March 30 to Rod Allison. We ap
prove the use of the existing 1965 vintage septic systti% for the
mobile home . This system must only be used to serve the mobile
home and no other structure. This approval does not , in any
manner , certify that the system will function as intended . If
the system malfunctions , this department must be notified imme-
diately so that corrective measures can be taken.
