WHEREAS, Section 21. 6. 2 of the Weld County Zoning Ordinance provides standards for review of such a Change of Zone, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, has studied the re- quest of the applicant and the recommendations of the Weld County Planning Commission, and having been fully informed finds as follows : 1. The request is in conformance with Section 21. 5.1. 1 of the Weld County Zoning Ordinance, as follows : a) The change to agricultural zoning is consistent with the Weld County Comprehensive Plan in that the area is not designated for urban activities and therefore, should remain agriculturally zoned. b) The Comprehensive Plan addresses commercial develop- ment in Chapter 3, Resource Management Policies, Section B, Urban Development, states on Page 60 that: (1) Commercial development in the unincorporated area of Weld County has not been extensive thus far. However, almost all of this development has occurred along the major highways , I-25, U.S. 34 and U.S. 85. This trend should not be allowed to continue, for such commercial development works against the movement of large volumes of traffic. Land along major arterials cannot be used for commercial use without disrupting the controlled access, which is such an essential aspect of the proper function- ing of arterials. The following statement from the State De- partment of Highways recommendation dated August 11, 1978 , emphasizes further concern about this issue. - The Colorado Division of Highways has reviewed the James D. Klein application for a change of zone from Agricultural District to Commercial District, and we have the following comments. If this zone change is granted, there may be an increase in traffic due to expansion of Centennial Ag Supply. The potential for accidents will also increase due to left- turn and deceleration movements into this business. The existing sixty (60) feet of right-of-way does not provide adequate room for highway improvements such as deceleration left-turn lanes which would be desirable to help alleviate these potential problems. c) On page 61 of the adopted Weld County Comprehensive Plan it is stated that: (1) Commercial development should be restricted to the incorporated areas of municipalities unless neces- sary to provide absolutely essential highway ser- vices. Gasoline stations, restaurants, motels and other auto-oriented services should be located with care at areas where problems of access and traffic conflict can be minimized. Location of commercial use outside of existing municipalities will encourage dispersed growth and will be of little aid to the economic well being of the municipalities. The public has a right to control development along these major transportation routes, for it is the investment of public treasure in these roads which makes them attractive for commercial use. Commer- cial land use in the County should be limited pri- marily to those agri-business functions that cannot be located in a municipality. When Mr. Klein' s application was originally considered the agri- cultural aspects of this operation was emphasized as a needed service to the surrounding farming community. A letter from the Mayor of Kersey, dated June 27, 1978, offers further support of this fact. The letter states : "The town of Kersey was recently approached by Mr. James Klein the president of Centennial Ag Supply and advised us of his need to rezone the acreage where his business is located, commercial, so that he can continue to carry on his agri-based business. Please be informed that the town of Kersey is not in opposition to the present location of Centennial Ag Supply and is in fact, supportive of the re- zoning efforts of Mr. Klein so that his business can continue to operate. This business does provide a needed service in the Kersey are to our farming community and the town of Kersey recognized the fact that it would be impractical if not impossible for Mr. Klein to relocate his business within the presently commercially zoned areas within the town of Kersey. " The Change of Zone from "A" (Agriculture) to "C" (Commerical) was originally approved on November 29, 1978 . At the time the appli- cation was approved the Use by Special Review mechanism was not available. The Centennial Ag Supply operation and present busi- nesses on this property are considered to be agri-business in nature, thus fitting the Use by Special Review Category. Other facts that are important to this Change of Zone proposal are: 1. The subject site is located almost one (1) mile outside of Kersey' s Comprehensive Plan for future land use development. Areas proposed for possible future commercial and industrial development are a mile away and south of U.S. Highway 34. 2. This commercial property exists in an area that is intended for agriculture now and in the future according to the Kersey Plan. 3. To this date, no other commercial development has occurred on properties surrounding this site. However, the Planning staff feels that because of the traffic on U.S. Highway 34 and the existing spot of commercial zoning, the poten- tial for further development exists. This would increase the potential for less efficient use of Highway 34 . It would encourage dispersed growth and offer little aid to the economic well being of the existing, nearby municipality. 4 . The operation on the property could continue as they are today with a Use by Special Review Permit. The Department of Planning Services has discussed future operations that may naturally develop from the parent operation. It is felt that the type of business growth can, for the most part, occur under the Use by Special Review Permit. 5. The County would not lose or gain any tax base by approving this application because the use is taxed and not the zoning. The uses permitted on the site will be consistent with surrounding agricultural uses. In addition to the request herein the County is proposing a Use by Special Review for the presently conducted agri-business activity. The Zoning Ordinance permits agri-business activities in the Agricultural District. a) Water, sewer, and street facilities are presently serving the existing businesses located on the premises. b) No soil, mineral deposit or overlay district is known to affect the site.
