HomeMy WebLinkAbout20040191.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST RANDALL DUNCAN AND RON RAINEY FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Randall Duncan and Ron Rainey,VI#9900193, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 13th day of January, 2004, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Randall Duncan, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until April 13, 2004, to allow adequate time for the property owners to submit a Recorded Exemption and subsequent appropriate permits or remove the mobile home to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. This violation was is in place as a result of the continued placement of an illegal mobile home. On August 27, 2001 a hearing was conducted before the Board of County Commissioners to determine the status of ZPMH-2239 for an Accessory mobile home. At that hearing, the Board of County Commissioners denied ZPMH-2239. Therefore, this Recorded Exemption application was submitted. As soon as the Recorded Exemption has been completed and the plat recorded, a Zoning Permit for a Mobile Home(ZPMH)to be utilized as a Principle Dwelling Unit and a Building Permit shall be obtained. As soon as all of these applications have been completed, the Violation will be closed. Since the purpose of a Recorded Exemption is to split off property, the re-justification of ZPMH-2274 will be required. Upon a visual inspection conducted on November 13, 2003, in hopes of closing your violation, it was instead noted that the mobile home in question had never been removed.
