HomeMy WebLinkAbout20042379.tiff HEARING CERTIFICATION DOCKET NO. 2004-67 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SECOND AMENDED USE BY SPECIAL REVIEW PERMIT #552 FOR A MINERAL RESOURCE DEVELOPMENT FACILITY, INCLUDING A NATURAL GAS PROCESSING FACILITY, IN THE A (AGRICULTURAL) ZONE DISTRICT - DUKE ENERGY FIELD SERVICES A public hearing was conducted on August 4, 2004, at 10:00 a.m., with the following present: Commissioner Robert D. Masden, Chair Commissioner William H. Jerke, Pro-Tem Commissioner M. J. Geile Commissioner David E. Long Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Chris Gathman Health Department representative, Char Davis Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated July 16, 2004, and duly published July 21, 2004, in the Fort Lupton Press, a public hearing was conducted to consider the request of Duke Energy Field Services for a Site Specific Development Plan and Second Amended Use by Special Review Permit #552 for a Mineral Resource Development Facility, including a Natural Gas Processing Facility, in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Gathman stated the facility is located on 2.5 acres, and she gave a brief description of the location of the site and surrounding land uses. He stated the City of Greeley responded and stated although the subject site is outside of its 2020 Growth Area, it is suggested that landscaping be provided along both the south and east property boundaries to screen the facility. Mr. Gathman stated the original Use by Special Review was approved in 1983 and later amended in 1986. He stated this amendment addresses a new compressor building and upgrades as required by the Oil and Gas Commission for regulatory compliance. He further stated there will not be an increase in truck trips because the plant is at capacity. Mr. Gathman stated the site is serviced by the North Weld County Water District and an individual sewage disposal system. He stated the site is accessed from Weld County Roads 41 and 43, and the internal roads are gravel and graded. He further stated 12 referral agencies reviewed this proposal, and staff received two phone inquiries regarding the case. 2004-2379 PL0034 CO fL , Etc) ffL v8'-11-6(1 HEARING CERTIFICATION - DUKE ENERGY FIELD SERVICES (2ND AMUSR #552) PAGE 2 Char Davis, Department of Public Health and Environment, stated the existing septic system is was permitted in 1985. She stated the water is provided by the North Weld County Water District. Donald Carroll, Department of Public Works, stated the site is accessed from Weld County Road 43, which is a collector status road. He clarified there is no access from Weld County Road 41. He stated the average daily traffic count is 800 to 1600 vehicles; however, those figures are not current. Jacqueline Johnson of Witwer, Oldenburg, Barry and Johnson, LLP, represented the applicant. In response to Commissioner Geile, Mr. Gathman stated this amendment was required to address the new compressor building and various upgrades. He clarified the change in ownership alone did not require an amendment. Commissioner Geile suggested deleting the last sentence of reason of approval #2.a and the Board concurred. Ms. Johnson clarified there is no access from Weld County Road 41. Mr. Morrison stated Duke Energy purchased the facility and initiated this process to ensure the site met current regulations and was adequately permitted. No public testimony was offered concerning this matter. In response to Chair Masden, Ms. Johnson stated she and the applicant have reviewed and concur with the Conditions of Approval and Development Standards, as proposed. In response to Commissioner Vaad, Chair Masden explained this type of facility collects and processes natural gas. Responding to Commissioner Vaad, Richard Evans, Duke Energy representative, stated this facility was previously exempt from the Early Impact Company due to its age; however, the changes will be monitored. He further stated some of the other facilities are effected, but this is a processing plant. Chair Masden commented 500-horse-power engines must meet the new regulations. Mr. Evans stated they are monitoring their engines, as well. Responding further to Chair Masden, Mr. Evans stated he is uncertain of the number of truck trips generated at this site. Ms. Johnson stated the application materials indicate three truck trips. Commissioner Vaad moved to approve the request of Duke Energy Field Services for a Site Specific Development Plan and Second Amended Use by Special Review Permit#552 for a Mineral Resource Development Facility, including a Natural Gas Processing Facility, in the A(Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion also included deleting the last sentence of reason of approval#2.a. The motion was seconded by Commissioner Long, and it carried unanimously.
