On behalf of our client, SW Meadow, LLC, we would like to make a minor change to the
USR permit application for the proposed Heit Sand and Gravel mine.
The application currently states that mining will occur in two phases, with Phase 2
consisting of 7 acres to be wet mined. The Applicant has decided that mining of the
Phase 2 area is not financially feasible and would like to withdraw this portion of the
mine plan from the application.

INTRODUCTION
This Use By Special Review (Mining) application (USR) is being submitted to allow for
sand and gravel mining of the site in two phases. Phase 1 includes Mine Area 1 and
Phase 2 includes Mine Area 2. Mine Area 1 (approximately 61 acres) will be dry mined
and Mine Area 2 (approximately 7 acres) will be wet mined. The Applicant wishes to
mine the property for sand and gravel and process the material on-site. One concrete
batch plant and one asphalt batch plant will be located on-site. Overall mining rates will
be 500,000 tons per year (tons/yr). Approximately 300,000 tons/yr will be consumed on
site in asphalt and concrete. The remainder of materials will be shipped out. This
application has been prepared and submitted under the provisions of the Weld County
Zoning Ordinance.
The subject property consists of approximately 102 acres that will be covered under this
USR. The entire site is generally described as follows (for complete legal description
please refer to Section 1.1 on page 3):
Parts lying in the South 1/4 of the NE 1/4 of Section 13 and parts lying in the North 1/4 of the
SE '/< of Section 13, T 2N, R 67W of the 6th P.M., Parcel #131113001002, Weld County,
Colorado.
The Vicinity Map depicts the general location of the site. The site is located immediately
west of Weld County Road 25, adjacent to Weld County Road 20 1/4 on the south.
Existing zoning of the subject property and surrounding properties is predominantly
agricultural.
The property currently supports a private residence. The remaining acreage of the
property is agricultural.
The remainder of this application package discusses the proposal in detail and
addresses each of the requirements of the Weld County Zoning Ordinance.

1.0 APPLICATION REQUIREMENTS
1.1— Legal Description of the Property

County of Weld, State of Colorado; Platted as Lupton Meadows Land Co., Division No.

A strip of land 100 feet wide, being 50 feet wide on each side of the centerline of the
Denver, Laramie and Northwestern Railway Co. (formerly a Wyoming Corporation), as
originally located over, across and through the NW1/4 of the SE1/4 of Section 13,
Township 2 North, Range 67 West of the 6th P.M., County of Weld, State of Colorado,
said centerline being more fully described as follows:
Beginning at a point on the south line of said NW1/4 of SE1/4 of said Section 13, a

2.0 DETAILED DESCRIPTION OF PROPOSED OPERATION
Copies of the Mining and Reclamation Plans submitted to the Colorado Mined Land
Reclamation Board have been included as Attachments A and B, respectively.
2.1 —Types and Numbers of Operation and Processing Equipment
Operation and processing equipment will include loaders, scrapers, haul trucks,
conveyors, sorters, screens, crushers, 1 concrete batch plant and 1 asphalt batch plant.
Since the numbers of each type of equipment can vary according to product demand,
exact numbers cannot be given at this time.
2.2 — Number of Shifts to be Worked and Maximum Number of Employees
A maximum of 15 employees are expected to be present on the property at any given
time. Throughout the use of the property, only one shift per day is expected.
2.3 —Wet or Dry Pit
Mine Area 1 will be dry mined and Mine Area 2 will be wet mined. A slurry wall will be
installed around the perimeter of Mine Area 1, within the offset and along the mining
boundary, prior to mining.
2.4 — County Roads and Bridges Utilized
All haul trucks will exit the site via the existing access road directly onto Weld County
Road 25 (WCR 25) southbound. From WCR 25, the trucks will turn left onto WCR 18
and head east towards Hwy 85. Approximately 90% of the trucks will travel southbound
on Hwy 85 and 10% will travel northbound. A small bridge over the South Platte River
on WCR 18 will be utilized.
2.5 — Size of Area and Stages to be Worked at Any One Time
The Applicant proposes to dry mine Mine Area 1 and wet mine Mine Area 2. Dewatering
will occur during Phase 1 mining operations. See Extraction Plan Map for further details.

Mineral deposit to be mined in Mine Area 1 ranges in depth from 20 to 30 ft. In Mine
Area 2, the mineral deposit ranges in depth from 10 to 15 ft. Overburden to be removed
ranges in depth from 3 to 5 ft in both mining areas.
2.8 — Proposed Reclaimed Use and Explanation of Reclamation Process
In Mine Area 1, the proposed use of reclaimed lands is a lined water storage reservoir.
Mine Area 2 will be reclaimed to a wildlife habitat pond. See Reclamation Plan and map
provided as Attachment B.
2.9 —Source of Technical Advice

2.10 — Copy of Agreement with Mineral Owners
The owner of subsurface mineral rights is Heit Farm, LTD. Kerr-McGee Rocky Mountain
Corp. (KMRMC) has a leasehold interest in oil and gas. An agreement with KMRMC is
in progress and will be submitted to the County when finalized.
2.11 — Operation Policies
In addition to the minimum operation standards as outlined in Sections 23-4-290 and 23-
4-300 of the County Code, the Applicant will comply with the additional operation
standards described below.
1. Operating hours will be as follows, Monday thru Saturday:
5:30 am to 8:30 pm for mining and processing
6 am to 2 pm for maintenance and repairs
6 am to 5 pm for hauling

2. No permanent disposal of wastes shall be permitted at this site.
3. Waste materials shall be handled, stored and disposed of in a manner that
controls fugitive dust, blowing debris and other potential nuisance conditions.
4. The Applicant shall remove, handle and stockpile overburden, soil, and sand
and gravel from the facility in a manner that will prevent nuisance conditions.
5. Prior to placement of any processing equipment and scale house/office on
the property, an ISDS permit will be obtained and septic system installed for
employee use.
6. The facility shall at all times operate in accordance with a dust abatement
plan approved by the Colorado Department of Public Health and
Environment.
7. The site shall be maintained in compliance with the local fire protection
district, the U.S Fish and Wildlife Service, the U.S. Army Corps of Engineers,
and the Colorado Division of Minerals and Geology.
8. "No Trespassing" signs shall be posted and maintained on the perimeter to
clearly identify site boundaries.
9. The facility shall, at all times, operate in accordance with a Stormwater
Management Plan approved by the Colorado Department of Public Health
and Environment.
10. All construction on the property shall be in accordance with the Weld County
Building Code Ordinance.
11. Lighting provided for security and emergency night operation on the site shall
be designed so that the lighting will not adversely affect surrounding property
owners.
12. The sand and gravel operation will comply with operation policies identified in
Section 23 of the Weld County Zoning Ordinance, as articulated above.
13. The property owner or operator shall be responsible for complying with the
Operating Standards of Section 24.6 of the Weld County Zoning Ordinance,
as amended.
14. Personnel from the Weld County Health Department and Weld County
Planning Department shall be granted access to the property at any
reasonable time in order to ensure the activities carried out on the property
comply with the Development Standards stated herein and all applicable
Weld County regulations.
15. The scope of the Use by Special Review permit applied for herein shall be
limited to the plans shown herein and governed by the foregoing standards

and all applicable Weld County Regulations. Substantial changes from the
plans or Development Standards as shown or stated shall require the
approval of an amendment of the Permit by the Weld County Planning
Commission before such changes to the plans or Development Standards
are permitted. Any other changes shall be filed in the office of the
Department of Planning Services.
16. The property owner or operator shall be responsible for complying with all of
the foregoing Development Standards. Noncompliance with any of the
foregoing Development Standards may be reason for revocation of the Permit
by the Board of County Commissioners.

3.0 SUPPORTING DOCUMENTS
3.1 — Copies of Mining and Reclamation Plans Submitted to State of Colorado Mined

3.2 — Plans for Obtaining Water Supplies for Mining Operation
The irrigation well located in the southeastern corner of the property will be converted for
commercial use. Applicant will also obtain 101 shares of Lupton Meadows Ditch water
through the transaction that could be used for operations if needed. Please refer to the
Purchase Contract for proof of water supply.
Employee drinking water will be supplied by bottled water, until Mr. Heit leaves the
property. At this point, the domestic well will be converted for drinking water and a
change-in-use permit from the Office of the State Engineer, Division of Water
Resources, will be requested.

These design elements will be supplied to the County upon request.

4.0 OTHER REQUIREMENTS
4.1 - Statement of Consistency with Comprehensive Plan
The Applicant has compared this proposed use and has prepared this application
package to conform to all Mineral Resource Goals and Policies contained in the Weld
County Comprehensive Plan. The details of the proposal contained in this application
support all Goals and Policies of the Comprehensive Plan.
4.2 — Statement of Consistency with Intent of District
The subject property is located within the 'A' (Agricultural) Zoning District. The intent of
this district is to "provide areas for the conduct of agricultural activities and activities
related to agriculture and agricultural production without the interference of other,
incompatible land uses... (T)he 'A' District is also intended to provide areas for the
conduct of Uses by Special Review which have been determined to be more intense or
to have a potentially greater impact than Uses Allowed by Right." Mineral resource
development is one of the Uses by Special Review in the 'A' (Agricultural) District. This
application has been designed to meet the intent of the Zone District and the
requirements of the Use by Special Review.
4.3 — Statement of Adequate Provisions to Protect the Health, Safety and
Welfare
This application contains adequate provisions to protect the health, safety and welfare of
surrounding landowners and the County residents. The plan contained in this
application package addresses all of the major areas of potential pollution and nuisance
factors related to these issues such as noise, dust, water pollution, drainage, truck
traffic, etc.
4.4 — Statement of Compatibility with Existing Uses
Existing land uses immediately surrounding the property are typically agricultural in
nature. There is one permitted sand and gravel mine immediately south of the property
(Koenig Pit) and another located approximately 0.75 miles east of the property. The
proposed mining operation is considered a Use by Special Review according to the
zoning ordinance. The mining and reclamation plans have been designed to be
compatible with the surrounding land uses and contain provisions to ensure this.

4.5 — Statement of Compatibility with Future Uses
Future uses immediately surrounding the subject property will be agricultural in nature.
The development of the property upon reclamation will have little impact on the
surrounding uses and is consistent with the future anticipated uses of surrounding
properties. Conversion of Mine Area 2 into a wildlife habitat pond will enhance the
subject property, as well as surrounding properties, by increasing the variety of wildlife
that use the area.
4.6 — Statement Concerning Floodplain, Geologic Hazards and the Airport Overlay
District
The subject property falls within the 100-year floodplain boundaries. It does not occur
within a geologic hazard or airport overlay district. A Floodplain Permit will be submitted
to the County.

EXHIBIT D — MINING PLAN
Overview
The Applicant proposes to excavate a total of approximately 2.3 million cubic yards (3.7
million tons) of sand and gravel from the Heit property. The excavation operation will
start in 2003 and will last for approximately 7 years. Approximately 500,000 tons of sand
and gravel will be mined each year. The actual length of the operation is highly
dependant on market conditions.
The Applicant proposes to develop the site as a sand and gravel mining and processing
operation. Approximately 68 acres of the total permit area of approximately 102 acres is
proposed for excavation (see Extraction Plan Map). The property will be mined in two
phases. Phase1 includes Mine Area 1 and Phase 2 includes Mine Area 2. Mine Area 1
(approximately 61 acres) will be dry mined and Mine Area 2 (approximately 7 acres) will
be wet mined. The processing plants will be located in the center of Mine Area 1.
The post-mining land use of Mine Area 1 will be a lined water storage reservoir facility,
while Mine Area 2 will be reclaimed to enhance wildlife habitat opportunities in the area.
Phase 1 Mining Methods
The Applicant proposes to dry mine Phase 1. A slurry wall will be installed around the
perimeter of the mine area, within the offset along the mining boundary. Dewatering will
occur prior to mining. Backfill operations will be concurrent with mining operations.
Initial mining operations during Phase 1 will include topsoil and overburden stripping and
excavation of dewatering trenches, sedimentation ponds and sump areas. Following
topsoil and overburden stripping, raw materials will be excavated with trackhoes and
front-end loaders. Excavated materials may be loaded on a field conveyor and
transported to the processing plant. Most excavated materials will be removed with
scrapers or loaded into off-road haul trucks for transport to the plant site. Excavated
materials may also be pushed up with a bulldozer for subsequent handling by front-end
loaders.

Phase 2 Mining Methods
The Applicant proposes to wet mine during Phase 2. No dewatering will occur during
Phase 2 mining operations.
Initial mining operations during Phase 2 will include topsoil and overburden stripping.
Following topsoil and overburden stripping, raw materials will be removed with
excavators. Excavated materials will be loaded onto a field conveyor for transport to the
plants in Mine Area 1. Refer to Extraction Plan Map for further details.
Earthmoving Operations
Earthmoving operations will begin with the grubbing of existing vegetation. Stripped
topsoil and grubbed vegetation will be stockpiled for later use in reclamation. Berms will
be constructed and strategically located around the perimeter of the site and seeded
with the temporary mixes identified in Exhibit E. During subsequent stripping operations,
overburden from one area may be placed directly, to near final grade, in other areas
being concurrently reclaimed.
The average depth of topsoil and overburden is approximately 3 ft. In Mine Area 1,
approximately 23 ft of sand and gravel underlies the overburden for a total average
excavation depth of approximately 26 ft. In Mine Area 2, the depth of sand and gravel
ranges from 10 to 15 ft, for an average excavation depth of approximately 16 ft.
Water Diversions and Impoundments
The entire site will be graded to direct stormwater runoff towards ditches and dewatering
systems. A CDPS permit will be obtained from the Colorado Department of Public
Health and Environment (CDPHE) for the dewatering operations.
Aggregate processing water will be separate from the dewatering and stormwater
systems. With evaporation and product moisture losses, there should be no need to
discharge processing water. Moreover, some dewatering discharges will be diverted
back to the processing water system. During mining operations the sediment ponds will
be located along the western boundary of Mining Area 1. Sediment ponds will be
maintained below existing grades so that precipitation will be retained in these areas.

The slurry wall installed around the perimeter of Mine Area 1 will seal off the pit,
preventing further infiltration of groundwater into the mining area. During initial
excavation, dewatering quantities will be high. Once the mining area is pumped out,
continued dewatering will not be required.
The Applicant will obtain 101 shares of water from the Lupton Meadows Ditch Company,
which will deliver approximately 283 acre-ft of water for use in augmentation. The
existing irrigation well in the southeastern corner of the property will be used during
operations and be converted to commercial use prior to mining. These rights will
account for losses in the aggregate processing operations. A Temporary Substitute
Supply Plan (TSSP) and Gravel Well Permit will be obtained prior to any disturbance of
groundwater.
Operations Timetable
Mining and reclamation activities will occur concurrently throughout the life of the mine.
As areas are cleared, grubbed and stripped, mined slopes will receive backfill material to
establish the permanent design side slopes. Mining is estimated to be completed within
7 years from the date of start-up. Final reclamation of the mined slopes will be
completed within 1 year of the completion of mining.

Phase 1 Mining Sequence
The Applicant will locate the aggregate processing plant, asphalt batch plant, concrete
batch plant, maintenance building and office facilities as shown on the Extraction Plan
Map. A slurry wall will be installed within the 25-ft setback around the perimeter so that
the area can be efficiently dewatered, and also so the site can serve as a water storage
facility after mining. Prior to placement of processing facilities, the area beneath the
plant site will be stripped of overburden. Stripped overburden will be stockpiled for later

use in reclamation. The aggregate plant will be moved on site as soon as all appropriate
permits are obtained.
Mining will begin in the southeast portion of Mine Area 1 and proceed west then north,
and then around the plants located in the center of the mine area. The processing
plants will then be relocated to the southeastern corner of Mine Area 1, so that the area
beneath them can be mined.
Sand and gravel excavation in Mine Area 1 will occur at 0.5:1 slopes. Excavated
materials will be transported to the processing plant via off-road haul trucks or
conveyors. Stripping of other areas will allow for excavation of dewatering ditches,
sediment and sump areas and setting the pumping systems. Underground power lines
will be constructed to provide power for the electric dewatering pumps and plant
equipment. As soon as mining limits have been reached, reclamation of the pit edges
will begin. This will allow for concurrent backfilling of the pit perimeter with previously
stripped overburden.
Phase 2 Mining Sequence
Mining will occur from west to east. Sand and gravel excavation will occur in Mine Area
2 at approximate 5:1 slopes. The pit will be mined at the proposed reclamation slopes,
eliminating the need for backfilling during reclamation. Excavated materials from Phase
2 areas will be transported to the processing plant via conveyors.
Description of Overburden, Deposit and Underlying Stratum
It was assumed that the overburden thickness at the Heit property was similar to
surrounding sites, approximately 2 to 3 ft. Based on the site's previous use as an
agricultural crops farm, the soils are believed to be suitable for reclamation efforts.
Based on the exploratory boreholes, an average of approximately 23 ft of sand and
gravel is situated below the topsoil and overburden in Mine Area 1. In Mine Area 2,
there is an average of approximately 13 ft of sand and gravel.

EXHIBIT E — RECLAMATION PLAN
Mine Area 1
The primary post-mining land use for Mine Area 1 will be a lined water storage reservoir.
Revegetation will be accomplished using native seed mixes. Slope reclamation and
revegetation will be on-going as material is excavated. Following mining of the area
beneath the plants, final seeding and grading of this area will occur. Final reclamation
will be completed within 1 year of the end of mining.
Mine Area 2
The primary post-mining land use for Mine Area 2 will be wildlife habitat. Mine Area 2
will be converted into an unlined pond with approximate 5:1 side slopes, for easy
accessibility by wildlife. Shorelines created during mining will be undulating to give a
more natural appearance.
The Reclamation Plan assumes the cost for restoration of the mining areas as a lined
water storage reservoir and a wildlife habitat pond. Refer to Exhibit F — Reclamation
Plan Map for further details.
Reclamation Process
Land disturbance in the permit area will begin with grubbing of vegetation and removal
and stockpiling of overburden prior to mining (approximately 233,929 yd3 from both mine
areas). Stockpiled overburden will be used to backfill pit edges to the reclaimed slopes.
The total affected areas are shown on Exhibit F.
Topsoil Segregation, Preservation and Replacement
Temporary topsoil berms will provide visual screening over the life of the mine and will
be strategically located for easy access during reclamation. If topsoil stockpiles remain
longer than one growing season, they will be revegetated. Watering of stockpiles will
occur as needed for dust control.
Final Grades
Mine Area 1 pit edges will be backfilled at a 3:1/2:1 slope. The slopes will be 3:1 from
the top of the mine high wall to a point approximately 10 ft below expected water levels,

once the pits are allowed to refill. From this point to the pit floor, slopes will be at a 2:1
ratio. Mine Area 2 pit edges will be mined at a 5:1 slope, leaving the desired post-mining
slopes in place. No backfill will be needed in Mine Area 2. Water levels are expected to
be approximately 3 ft below existing grade on the site. Approximately 16 inches of
topsoil will be re-spread over all Phase 1 disturbed areas above water levels.
To reclaim the site, approximately 211,000 yd3 of material will be required to backfill the
Mine Area 1 pit edges to the proposed slopes. Then, approximately 3,400 yd3 of topsoil
will be re-spread over all disturbed land above water level (approximately 1.6 acres).
Additional material in the form of waste fines can be made available should additional fill
material be necessary. No imported material will be needed to complete reclamation.
Topsoil Replacement
After overburden replacement in Phase 1, approximately 16 inches of topsoil will be re-
spread over disturbed areas (above water levels) to provide a proper medium for
revegetation. Topsoil will not be re-spread when the ground is frozen, excessively wet
or otherwise unsuitable. Contour furrows will be established on shoreline slopes to
reduce erosion and encourage stable plant growth. Soils that are excessively
compacted will be chiseled or disced to break up compaction, then harrowed down.
Reveqetation
All surface areas above water levels (approximately 1.6 acres), disturbed by Phase 1
mining activities, will be topsoiled and drill-seeded for final reclamation with the seed
mixes shown in Tables E-1 and E-2. If use of a grass drill is not possible, seed
broadcasting will occur at double the seeding rate. These seed mixes have been
developed based on correspondence with the United States Department of Agriculture
(USDA), who identified these mixes for use on a similar site near this proposed project
area. The seed mix specified in Table E-2 is for use on topsoil storage berms and other
areas requiring a rapidly growing seed mix.
Maintenance
Mowing in Phase 1 will be performed for at least 2 years following seeding to help
establish regenerating stands of grasses and to control weed infestation. Seeded areas

will be mulched with straw or hay mulch. Fertilizer will be applied to areas of the site

The sale of the property to the Applicant is contingent on approval of all mining permits
at both the State and County levels. Once the sale is completed, the Applicant will have
obtained ownership of all irrigation and domestic wells on the property. This includes
one irrigation well and one domestic well, both permitted. The Applicant will also obtain
101 shares (approximately 283 acre-ft) of water in the Lupton Meadows Ditch Company.
Employee drinking water will be supplied by bottled water, until Mr. Heit leaves the
property. At this point, the domestic well will be converted for drinking water and a
change-in-use permit from the Office of the State Engineer, Division of Water
Resources, will be requested. Water for use in process operations will be supplied by
converting the irrigation well for commercial use.

The residence on the property will be occupied by Mr. Heit for approximately 2 to 3 years
after operations begin. A septic system currently exists and is in use at the main
residence. This home will be used as the site office once Mr. Heit vacates the home.
Until Mr. Heit leaves the property, a temporary construction trailer will serve as the office.
Portable toilets will provide sanitation. The Applicant will have the current septic system
inspected for adequacy to support the proposed use. If the existing septic system is
deemed inadequate, the Applicant will design, permit, and construct a new system to
Colorado and Weld County Department of Health and Environment standards.

Weld County Water Analysis for Heit Property
1. Analysis of Replacement Water Requirements
a. Mining Prior to Buildout
Phase One will be dry mined downward until the groundwater table is
approached. Once the mine depth is within approximately three feet of the
groundwater table, the entire phase area will be slurry walled to prevent
groundwater from entering or leaving the cell. After the area is slurry walled,
the area will be dewatered, with the dewatered water returned to the South
Platte River, and dry mining will continue until all of the aggregate is mined
from the phase area.
The water required for replacement to the South Platte River from the mining
itself will consist of evaporation loss from exposed water surfaces in each
phase area and other areas and the water contained in the aggregate which
will be hauled away from the mine.
Based on aggregate production rates of 500,000 tons per year, distributed
unevenly on a monthly basis, the replacement water required for aggregate
production will be 14.71 acre-feet per year, based on a 4% water content by
weight in the aggregate that will be hauled from the mine. Evaporative losses
at the site from exposed groundwater will be approximately 13.42 acre feet
per year.
The mine will also use two existing wells on the property to supply its needs
for domestic use for its employees, for batch concrete production, and for
dust suppression. According to the State Engineer's Office, a change in use
or new well permit for these wells will not be required because the wells are
close enough to the mining operation to be included in the overall
consumptive use analysis for the entire property, thereby not requiring
additional augmentation analysis.
As many as 25 employees will need water for drinking and sanitary uses.
Domestic use for the employees will be equal to 0.288 acre-feet per year,
based on a per employee use of 15 gallons per day for 250 working days per
year. A septic tank-leach field system will be used to treat the wastewater
resulting from domestic use, with 90% of the domestic use returning to the
groundwater system. Thus, the operation will need replacement water for the
consumptive domestic use of water in the amount of 0.03 acre-feet per year.
The mine will produce 150,000 cubic yards of concrete per year in its
batching operations. This production will require 16.08 acre-feet of water per
year of replacement water, based on 35 gallons required per cubic yard of
concrete.
Dust suppression will require 1.86 acre-feet of water per year.
Prior to completion of mining of each cell, total replacement water from
evaporation from exposed water surfaces, water lost in aggregate hauled
away from the mine, water consumptively used for employees' domestic use,
water used in the production of concrete, and water used for dust
suppression will be 46.10 acre-feet per year.
b. After Buildout
After the entire property has been completely mined, no replacement water
will be needed for the Phase One area, which will be a sealed water storage
reservoir. The Phase Two area will expose approximately 6.8 acres of
groundwater with a total consumption due to evaporation of 19 acre-feet per
year. Total replacement water required after build-out will be 19 acre-feet per
year.
2. Water Replacement
No surface rights will be used to offset depletions from mining. The Applicant
owns 2 non-tributary groundwater wells approximately 25 miles south of the site
along the South Platte River. Per the State Engineer's guidelines for gravel pit
replacement sources, non-tributary groundwater wells can be used for
replacement purposes without requiring additional augmentation. These wells
have a production rate of 1,072 gallons per minute and will be more than
sufficient to address the replacement needs for the Heit operation. These wells
will also likely be used as the long term augmentation of post-mining depletions
once Phase 2 of mining is completed.

RE: Heit Sand and Gravel Mine; Well Issues
Dear Mr. Gathman:
We are in receipt of your faxed copy of the referral letter from the Division of Water
Resources (dated August 22, 2003) regarding the Heit project. Through subsequent
conversations with the Office of the State Engineer (OSE) we have confirmed what you
and I discussed yesterday via telephone, that the Applicant will need to obtain a change
in use permit from the OSE for the wells on the property if they are to be used for
commercial uses. Per OSE rules and regulations, a change in use permit for the wells
cannot be obtained until the augmentation plan for the property has been approved. The
Applicant has submitted an augmentation plan for the site, in the form of a Temporary
Substitute Supply Plan (TSSP), to the OSE for review and subsequent approval. Once
approval is received, the Applicant commits to obtaining the necessary change in use
permits.
Further, in light of our conversation yesterday we are puzzled as to why the County feels
the need to require approval of a TSSP and change in use permit prior to scheduling a
hearing before the Board of County Commissioners. Our understanding of what the
County's position has been is that such requirement would be covered under Sec. 23-2-
260(E)(2) of the County Code which requires "Proof that a water supply will be available
which is adequate in terms of quantity, quality and dependability (e.g., a well permit of
letter from a water district)." While well permits are suggested as examples of what kind
of proof could be supplied, the language of the Code allows for other forms of proof We
believe that proof of meeting this requirement has been met through our submittal of
"Weld County Water Analysis for Heft Property" as part of the USR application for the
property. This analysis detailed that the Applicant has the quantity, quality and
dependability of water necessary to support the proposed uses. The only remaining
issues are: (1) whether or not the quantity of water needed for the operation will affect
other water users in the area, (2) whether or not the Applicant has enough water to
augment those potential impacts, and (3) whether or not the water usage is properly
classified. These determinations rest solely within the jurisdiction of the OSE and are
covered under the TSSP application, which has been submitted to that office, and the
change-in-use permit that will be applied for subsequent to TSSP approval. If the
proposed use will have adverse impacts for which the Applicant cannot provide
augmentation, the proposed use cannot commence regardless of the County's decision
relating to land use. If an operator were to commence an operation approved by the
County without the necessary permits from the OSE, the operator would face

enforcement in the form of fines and/or cease and desist orders from the OSE. The
County is not the administrating or enforcing entity when it comes to water quantity,
quality or dependability.
Also, as we have often discussed in the past, a decision to require a change-in-use
permit approval from the OSE prior to scheduling a hearing date in front of the Board of
County Commissioners places the farmer and current landowner of the property in a
very precarious position. The County would be forcing the farmer to change the
permitted use of his agricultural and domestic wells to commercial use before a decision
on whether the commercial/industrial uses proposed for the land have even been
approved. If the County were to then deny the proposed Special Use for the property,
the farmer would be burdened with a well permitted for a use not allowed on the
property, thus rendering the well useless and greatly hindering the farmer's ability to use
his land for agricultural purposes should he choose to continue that use. Requiring a
change-in-use permit for the wells prior to a Board decision that would allow the use for
which the wells would support is unfair.
With the above discussion in mind, we respectfully request the County approve the
proposed use under the condition that an approved TSSP and change-in-use permit be
supplied to County Planning staff prior to land disturbance at the site.
