The first one we are going to take is the Gil- 11 crest Sanitation District because we have a reporter here and 12 she needs to carry on after this is over, so Docket No. 81-16 . 13 MR. ANSON: This is Docket 81-16. This is a hearing 14 for the purpose of considering the service plan for an addition 15 to the Gilcrest Sanitation District . The notice and hearing is 16 pursuant to Section 31-1-201, et seq. , CRS 1973, as amended. 17 Notice has been published on March 26, April 2, and April 9, 18 1981 in the Johnstown Breeze . In accordance with Section 32-1- 19 205, the Board of County Commissioners shall approve the ser- 20 vice plan unless it finds one of the following: There is in- 21 sufficient existing and projected need for organized service 22 in the area to be serviced by the proposed district; or The 23 existing area in the area to be served by the proposed district 24 is adequate for present and projected needs ; or Adequate ser- 25 vice is, or will be, available to the area through municipal MABEL BROYLES CERTIFIED SHORTHAND REPORTER 258 South 12th — Brighton. Colorado 659-1130 3 1 annexation by other existing municipal or quasi municipal 2 corporations within a reasonable time and on a comparable 3 basis ; or The proposed special district is incapable of pro- 4 viding economical and sufficient service to the area within 5 its proposed boundaries; or The area to be included in the 6 proposed district does not have , or will not have, the finan- 7 cial ability to discharge the proposed indebtedness on a 8 reasonable basis ; or The facility and service standards of 9 the proposed district are incompatible with the facility and 10 service standards of adjacent municipalities and special dis- 11 tricts . The last criteria was if the proposal was not in 12 substantial compliance with the master plan, so basically the 13 Board shall approve the plan unless it finds one of the items 14 that I just mentioned. 15 CHAIRMAN CARLSON: Do you have anything to respond? 16 MR. HONN: Yes , Mr. Chairman, it' s moved by Betty 17 Kountz at the regular meeting Planning Commission that the 18 following resolution be introduced for passage by the Planning 19 Commission: "Be it resolved by the Planning Commission the 20 following be adopted by the Board of County Commissioners . 21 It is the opinion of the Planning Commission that the proposal 22 for an addition to the Gilcrest Sanitation District will 23 formalize the acceptance of services which already exist for 24 the proposed addition. The district is already collecting and 25 treating the waste water from the area of the proposed district. MABEL BROYLES CERTIFIED SHORTHAND REPORTER 258 South 12th — Brighton, Colorado 659-1130 4 1 The addition of this area to the sanitation district will not 2 result in any expansion or construction of new treatment 3 facilities . Therefore, it is the opinion of the Planning 4 Commission the proposal meets the criteria of Section 32-1-205 5 of the Colorado Revised Statutes ." It ' s to be recommended 6 favorably to the Board of County Commissioners for the follow- 7 ing reasons and that it did meet the criteria that I have out- 8 lined in the Colorado Revised Statutes . The motion was se- 9 conded by Jerry Kiefer. The vote for passage was Bob Ehrlich, 10 Don Billings, Jack Holman, Jerry Kiefer, Betty Kountz, Wilbur 11 Wafel, Fred Otis . This action was taken on April 7, 1981, the 12 Planning Commission meeting. 13 CHAIRMAN CARLSON: Do you have a report? 14 MR. WARDEN: No, I will be later in the agenda. 15 MR. HOFF: My name is Don Hoff. I am the attorney 16 for the Gilcrest Sanitation District . Basically, what has 17 occurred here is there is an area that is a new area to the 18 Town of Gilcrest to the north of the old area of town that has 19 been developed, I guess, within the last eight or-- eight years 20 or so, six or eight years . The main area at the time of Gil- 21 crest has always been within the Gilcrest Sanitation District . 22 They have had almost exactly the same boundaries . The town 23 expanded north of its original boundaries into this area that 24 is a new area north of Gilcrest and there is a map in the back 25 of the plan if you want to refer to that. Colorado 659-1130 5 1 developed, as I said, in the last eight years and was either 2 inadvertently or for some reason was not included within the 3 sanitation district before it was developed and it is necessary 4 or at least certainly is desirable for the district to have 5 that area within the sanitation district so that we can pro- 6 vide better services to those people and so that we can arrange 7 for more orderly collection of revenues for servicing that 8 area as far as sanitation service is concerned. So, what we 9 are doing is including that developed area just north of Gil- 10 crest within the sanitation district and as it has already beer 11 explained briefly in your staff' s report, the entire area is 12 developed. There is not going to be any new construction in 13 this area. There is some construction going on or some en- 14 largement going on at the sewer plant or some changes going on 15 in the sewer plant itself, but that does not have anything to 16 do with this particular expansion. What we are doing is ex- 17 panding only the boundaries of the district here and in order 18 for us to do that we have to have approval from the County 19 Commissioners . After we have approval from the County Commis- 20 sioners we can go to the District Court and they, of course, 21 then grant us-- they even chartered that area within the 22 district. 23 If you have any specific questions about the plan, 24 I can certainly try to answer them. If not, I don' t see any 25 need to go through the entire plan again. If you want me to MABEL BROYLES CERTIFIED SHORTHAND REPORTER 258 South 12th — Brighton, Colorado 659-1130 6 1 go through, I will be glad to go through it, but basically 2 what it sets forth is the criteria that the statute requires 3 that we supply to you; that is, the financial survey and we 4 supply the copy of the sanitation district budget for the 1981 5 year. It requires that we show you the proposed boundaries, 6 the proposed new boundaries, and that map, of course, shows 7 you what new area is going to be included. I believe the area 8 that is going to be included is in a solid line and the old 9 area is in the broken line, so the area that is surrounded by 10 the solid line is going to be the area that-- or the area that 11 we are talking about that we want included within the district. 12 Further, the statute asks for an estimate of the population. 13 Well, it actually asks what estimate of the population that 14 would be there . Well, they are already all there so we have 15 told you that. I am not exactly sure what the number is, but 16 in any event, approximately five hundred and fifty persons are 17 living in that area. The statute also requests that we supply 18 you an evaluation for assessment, that has also been done . 19 Standards of construction and engineering services , basically, 20 what we have done is provided services to those residents in 21 the usual fashion that is provided, sewage lines and sewage 22 disposal systems that will service their needs . Those systems 23 are not going to be connected to any municipality any time in 24 the near future. The other nearest municipal facility is La 25 Salle, which is six or eight miles away. So there is no need MABEL BROYLES CERTIFIED SHORTHAND REPORTER 258 South 12th — Brighton, Colorado 659-1130 7 1 to have them standardized with any other municipality system. 2 They are, however, the materials that are put in there and the 3 lines were put in there are the usual size and of the usual 4 quality, of course, for that type of project in Weld County. 5 As far as expenses, the statute requires that we give you some 6 idea as to the expenses of the project. Again, since every- 7 thing there is complete, we don' t have any need to tell you 8 what expenses are, except the administrative expenses that 9 have occurred having the area included within the district and 10 that has also been done . 11 So, unless you have any specific questions , I would 12 ask that you approve this service plan because I certainly 13 expect that we have met all the requirements that Mr. Anson 14 read earlier. 15 CHAIRMAN CARLSON: Anybody that' s got any comments 16 on this? If not, what is the Board' s wishes? 17 COMMISSIONER CARLSON: Anyone in the audience who 18 wishes to comment either way? 19 CHAIRMAN CARLSON: We already asked for that. 20 COMMISSIONER STEINMARK: Mr, Chairman, I would move 21 that we approve the addition to the service and the service 22 plan for an addition to the Gilcrest Sanitation District. It 23 appears that they have answered all the questions satisfactorily 24 according to the criteria as set out by the County Attorney. 25 COMMISSIONER KIRBY : Second.
