RESOLUTION
RE: APPROVE VACATION OF SPECIAL REVIEW PERMIT#1408-RONALD AND MICHELE
SACK
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,by Resolution dated February 12,2003,the Board did approve Special Review
Permit#1406 for a Site Specific Development Plan and Use by Special Review Permit#1406 for
a Business Permitted as a Use by Right or an Accessory Use in the Commercial Zone District
(parking of commercial trucks and equipment)in the A(Agricultural)Zone District on the following
described real estate, to-wit:
LotA of Recorded Exemption#3380;being part of the
SE1/4 of Section 6, Township 1 North, Range 64
West of the 6th P.M., Weld County, Colorado
WHEREAS, the Board has received a request from Ronald and Michele Sack, 24545
Highway 52, Hudson, Colorado 80642, to vacate said Special Review Permit#1406, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present,studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacation.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Special Review Permit#1406 be, and hereby is, vacated.

SUBJECT: Vacation of USR-1406
The Department of Planning Services has received the attached letter dated November 8, 2004
from Ronald and Michele Sack. Mr. and Mrs. Sack are requesting that USR-1406 be vacated
since the use is no longer being performed on the property.
Background information:
Legal Description: Lot A RE-3380 being part of the SE4 Section 6, Ti N, R64W of the 6th
P.M., Weld County, CO.
Location: North of and adjacent to State Highway 52; 1/2 mile west of County Road
51.
USR-1406: USR-1406 was approved by the BOCC on February 12, 2003, for parking
of commercial trucks
Because the conditions of approval attached to the Use by Special Review Permit were never
completed, staff contacted the Sacks to determine if a Probable Cause hearing should be
scheduled. The Sacks have decided that their intentions have changed and they do wish to
vacate the USR.

We are requesting the vacation of Use by Special Review Permit 1406 for the parking of
commercial trucks as we are no longer operating from the site and do not intend to complete the
conditions of approval.

Subject: USR-1406
Dear Mr. and Mrs. Sack,
On February 12, 2003 Use by Special Review Permit 1406 was approved by the Board of County
Commissioners. The plat has never been recorded and the conditions of approval have not been
completed. I was told at one point that your situation has changed and you no longer own the trucks. If this
is still true, please sign the attached document requesting the vacation of USR 1406.
Should I not receive the signed attachment, I will have no option but to set a date for a probable cause
hearing to determine if there is cause to hold a public hearing to consider the revocation of your permit.
The Probable Cause/Show Cause process is lengthy and costly for the County to carry out. If you are not
intending to operate from this site, please return the attachment and let us avoid these unnecessary costs.
If I do not receive the attached letter from you by October 31, 2004, I will schedule a Probable Cause
hearing before the Board of County Commissioners on the first available date.
