HomeMy WebLinkAbout20042117.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING EXTENSION OF TIME FOR FILING FINAL PLAN FOR CHANGE OF ZONE, PZ#602 FOR RIVERDANCE PUD - MIKE SIEGRIST WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated June 26, 2002, the Board did approve the application of Mike Siegrist, 875 West 64th Avenue, Denver, Colorado 80221, for a Change of Zone, PZ #602, from the A (Agricultural) Zone District to a PUD (Planned Unit Development) Zone District for 618 lots with R-1, R-2, R-3, and R-4 (Residential) Zone uses, 31 lots with C-1, C-2, and I-1 (Commercial and Industrial) Zone uses, and 239 acres of common open space, including a community clubhouse, said PUD to be known as Riverdance PUD, on the following described real estate, to-wit: Part of Section 35, and the SW1/4NW1/4 and the NW1/4SW1/4 of Section 36, Township 3 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, pursuant to Section 27-8-50 of the Weld County Code, the applicant submitted a letter dated July 9, 2004, requesting the Board consider an extension of time for filing the PUD Final Plan for RiverDance PUD, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of staff from the County Attorney's Office and the Weld County Department of Planning Services, and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the period of eighteen (18) months, which is a six- month extension of the allowed time. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the time for filing the Final Plan for Change of Zone, PZ #602, for Riverdance PUD, for Mike Siegrist, be, and hereby is, extended for the period of eighteen (18) months. 2004-2117 PL1601 (6: PL, Alft, o8--o& O�1 RE: EXTENSION OF TIME FOR FINAL PLAN - RIVERDANCE PUD, PZ #602, MIKE SIEGRIST PAGE 2 The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 26th day of July, A.D., 2004. FROM: Kim Ogle, Planning Manager Vo, SUBJECT: Riverdance PUD, Change of Zone Case Number PZ-602 Request for extension of time for Final Plat Submittal The Department of Planning Services is in receipt of a letter dated July 9, 2004 from Michael U. Siegrist, applicant and property owner for the development identified as the Riverdance PUD. Mr. Siegrist presented a letter dated July 9, 2004 to staff in accordance with Section 27-8-50. Failure to submit a PUD final plan. The Section states: "If a PUD final plan application is not submitted within three (3) years of the date of the approval of the PUD Zone District, the Board of County Commissioners shall require the landowner to appear before it and present evidence substantiating that the PUD project has not been abandoned and that the applicant possesses the willingness and ability to continue with the submittal of the PUD final plan. The Board of County Commissioners may extend the date for the submittal of the PUD final plan application and shall annually require the applicant to demonstrate that the PUD has not been abandoned. If the Board of County Commissioners determines that conditions or statements made supporting the original approval of the PUD Zone District have changed or that the landowner cannot implement the PUD final plan, the Board may, at a public meeting, revoke the PUD Zone District and order the recorded PUD Zone District reverted to the original zone district. (Weld County Code Ordinance 2002-9; Weld County Code Ordinance 2003-10)" Mr. Siegrist was approved June 26, 2002 for the Change of Zone with the plats recorded December 2, 2002. As stated in the Siegrist letter, CARMA development is currently evaluating the purchase of the Riverdance development property, as such, Mr. Siegrist has not commenced with the preparation of the Final plat application. Given this current circumstance, Mr. Siegrist requests an eighteen month extension for the submission of the Final plat application.
