CARGO CONTAINERS SITUATED AS PERMANENT STORAGE UNITS; AND A USE
PERMITTED AS A USE BY RIGHT, AN ACCESSORY USE, OR A USE BY SPECIAL
REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS(AN INDUSTRIAL
MACHINE SHOP), ALL IN THE A (AGRICULTURAL) ZONE DISTRICT - MICHAEL

A public hearing was conducted on June 2, 2004, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated May 14,2004, and duly published May 19, 2004, in
the Fort Lupton Press,a public hearing was conducted to consider the request of Michael Arrington
for a Site Specific Development Plan and Use by Special Review Permit#1454 for an Oil and Gas
Support and Service Facility; Semi-trailer and Cargo Containers Situated as Permanent Storage
Units; and a Use Permitted as a Use by Right, an Accessory Use, or a Use by Special Review in
the Commercial or Industrial Zone Districts(an industrial machine shop),all in the A(Agricultural)
Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Chair
Pro-Tem Jerke advised Michael Arrington,applicant,that he has the option of continuing this matter
to a date when the full board will be present. However,if he decides to proceed today,approval will
require three affirmative votes or be deemed denied.Mr.Arrington indicated he would like to proceed
today.
Michelle Katyryniuk, Department of Planning Services,presented a brief summary of the proposal
and entered the favorable recommendation of the Planning Commission into the record as written.
She gave a brief description of the location of the site and surrounding uses.She stated 14 referral
agencies reviewed this proposal, and 12 responded with comments that have been addressed
through the Conditions of Approval and Development Standards. She further stated staff received
no response from the Colorado Division of Wildlife or LaSalle Fire Protection District, nor any
correspondence from surrounding property owners. Responding to Chair Pro-Tem Jerke, Ms.
Katyryniuk reiterated the LaSalle Fire Protection District was sent a referral; however,a response
was not received.

Char Davis, Department of Public Health and Environment, stated she has no comments at this
time. Responding to Chair Pro-Tem Jerke, Ms. Davis stated the applicant will be required to get a
septic permit for the shop. She further stated a bookkeeper will be using the home office,therefore,
the applicant will also need an engineer's evaluation to determine whether the system is adequate.
Donald Carroll, Department of Public Works, stated Weld County Road 50 is a local paved road,
with an average daily traffic count of 500 to 600 vehicles. He stated the property has 260 feet of
frontage along Weld County Road 50, and although there are two existing gates on the west side
that are closed and locked, staff is requesting the applicant use the main access to the facility.
Mr.Arrington stated he operates a small company that has been in business for 25 years. He stated
the site was previously used for industrial purposes,so this use is not new to the area. Responding
to Commissioner Geile, Mr.Arrington stated he is building a small office onto the back of the house,
and he may build a larger shop in the future.
No public testimony was offered concerning this matter. Responding to Chair Pro-Tem Jerke, Mr.
Arrington stated he has reviewed and concurs with the Conditions of Approval and Development
Standards as proposed.
Commissioner Geile moved to approve the request of Michael Arrington for a Site Specific
Development Plan and Use by Special Review Permit #1454 for an Oil and Gas Support and
Service Facility;Semi-trailer and Cargo Containers Situated as Permanent Storage Units;and a Use
Permitted as a Use by Right,an Accessory Use, or a Use by Special Review in the Commercial or
Industrial Zone Districts(an industrial machine shop),all in the A(Agricultural)Zone District,based
on the recommendations of the Planning staff and the Planning Commission,with the Conditions
of Approval and Development Standards as entered into the record. The motion was seconded by
Commissioner Vaad, and it carried unanimously. There being no further discussion,the hearing
was completed at 10:30 a.m.
This Certification was approved on the 7th day of June 2004.
