There are two building permits on record for this parcel, address or applicant's name. BC-
0101061 was for an 864 square foot steel building without electric and PR-0130095 was for a
32 X 56 manufactured home principal dwelling. Both permits were inspected and received final
approval.
1. A building permit shall be obtained prior to the construction of any building.
2. A plan review is required for each building for which a building permit is required. Except for
simple pole type structures, plans shall bear the wet stamp of a Colorado registered architect or
engineer. Two complete sets of plans are required when applying for each permit.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 1997 Uniform
Building Code; 1998 International Mechanical Code; 1997 International Plumbing Code; 2002
National Electrical Code and Chapter 29 of the Weld County Code.
4. Except for pole type structures, each building will require an engineered foundation based
on a site-specific geotechnical report or an open hole inspection performed by a Colorado
registered engineer. Engineered foundations shall be designed by a Colorado registered
engineer.
5. Building height shall be measured in accordance with the 1997 Uniform Building Code for the
purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with the Bulk Requirements from Chapter 27 of the
Weld County Code. Building height shall be measured in accordance with Chapter 23 of the
Weld County Code in order to determine compliance with offset and setback requirements.
Offset and setback requirements are measured to the farthest projection from the building.
6. A Flood Hazard Development Permit shall be submitted for buildings constructed within the
100-year flood plain.

The Weld County Public Works Department has reviewed this proposal; this project falls
primarily under the preview of the Use by Special Review Standards, Weld County Code
Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows:
COMMENTS:
WCR 48 is designated on the Road Capital Improvement Plan in the County Wide Impact Fee
Code Ordinance, Section 20-1-30, as a local gravel road. The most current traffic count (ADT)
reflects approximately 174 vehicles.
WCR 53 is a collector status road with a traffic count of approximately 288 vehicles at this
location.
There is a minor subdivision located directly north of the proposed USR called Blue Sky Estates
and a USR for a roping arena on Lot B of RE-1670 directly south of the proposed USR.
REQUIREMENTS:
Access: The applicant has identified a circle drive or two access points to the proposed USR.
In accordance with Chapter 8, Article II of the Weld County Code, direct access from a public
road shall be limited; only one access is allowed per legal residential parcel. No circle drives
will be allowed.
The Weld County Public Works Department recommends utilizing only one main access point
for the residential and proposed USR use. There shall be adequate turning radiuses wide
enough to accommodate two-way traffic at this access point.
If a drainage culvert is required, a 15" CMP is the County's minimum size requirement. If the
applicant chooses to place a larger pipe, please contact the Weld County Public Works
Department to adequately size the culvert.
Off-Street Parking: The off-street parking spaces including the access drive shall be surfaced
with gravel or the equivalent and shall be graded to prevent drainage problems. Each parking
space adjacent to buildings shall be equipped with a wheel guard or a curb stop where needed
to prevent vehicles from extending beyond the boundaries of the space and from coming into
contact with other vehicles, walls, fences, or plantings.

Dust Suppressant: The applicant shall enter into a Road Maintenance and Improvements
Agreement with the Weld County Public Works Department for applying a dust suppressant
chemical on WCR 48 between the applicant's west property line and WCR 53 (approximately
900 feet) due to the increase of heavy truck hauling utilizing this location.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on
site in such a manner that it will reasonably preserve the natural character of the area and
prevent property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.
I am referring additional items to the Department of Health and Environment as a portion of this
proposed USR. This USR will deal with a proposed shop (garage) service building associated
with truck and equipment service.

Environmental Health Services has reviewed this proposal. The application requests an USR for
an oil and gas support and service facility along with permanent storage units. We have no
objections to the proposal, however, we do recommend that the following conditions be part of
any approval:
We recommend that the following requirements be met prior to allowing the plat to be recorded:
1. Apply for an Underground Injection Control (UIC) Class V Injection Well permit
through the Environmental Protection Agency (EPA) or provide evidence that the
= applicant is not subject to the EPA Class V requirements.
2. The applicant intends to connect the proposed shop/office to the septic system currently
sewing the home. The septic system shall be reviewed by a Colorado Registered
Professional Engineer. The review shall consist of observation of the system and a
technical review describing the systems ability to handle the proposed hydraulic load.
The review shall be submitted to the Environmental Health Services Division of the Weld
County Department of Public Health and Environment. In the event the system is found
to be inadequately sized or constructed the system shall be brought into compliance with
current Regulations or a separate system shall be installed to serve the shop/office.
3. The applicant shall submit a manure and stormwater management plan to the Weld
County Department of Public Health and Environment for review and approval. The plan
should describe how manure generated on site will be stored, managed, removed, land
applied, etc. The plan should also describe the fate of any stormwater that may come into
contact with manure.
4. The applicant shall submit a waste handling plan, for approval, to the Environmental
Health Services Division of the Weld County Department of Public Health &
Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should include
expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including the
facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as development
standards:
1. The applicant shall remove, handle, and stockpile manure from the livestock area in a
manner that will prevent nuisance conditions. The manure piles shall not be allowed to
exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or
pollutant runoff. The manure storage site shall have a water-tight surface which does not
permit seepage or percolation of manure pollutants into the ground.
2. The facility shall maintain compliance with the Best Management Practices outlined in
the Confined Animal Feeding Operation Regulations (5 CCR 1002-19).
7 All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a
manner that protects against surface and groundwater contamination.
fl: No permanent disposal of wastes shall be permitted at this site. This is not meant to
include those wastes specifically excluded from the definition of a solid waste in the
Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
ff. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, blowing debris, and other potential nuisance conditions.
6. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so
that vermin infestation, odors, disease hazards, and nuisances are minimized.
Fugitive dust shall be controlled on this site.
8. This facility shall adhere to the maximum puniissible noise levels allowed in the light
industrial zone as delineated in 25-12-103 C.R.S., as amended.
The applicant shall operate in accordance with the approved"waste handling plan".
1,0: Adequate handwashing and toilet facilities shall be provided for employees and patrons
of the facility.
V. Any septic system located on the property must comply with all provisions of the Weld
County Code, pertaining to Individual Sewage Disposal Systems.

Department of Public Health &Environment, Water Quality Control Division.

Upon review of my computer and files,a Zoning Violation(VI-0300042)was noted. The violation was initiated
as a result of receiving complaints regarding a commercial trucking facility without an approved and recorded
Use by Special Review(USR) permit.
Please be advised that this violation was presented to the Board of County Commissioners on July 8, 2003.
At that hearing, the Board of County Commissioners referred this case to the County Attorney's Office, but
delayed legal action until November 8, 2003 to allow additional time to complete and submit this Use by
Special Review application. This application, if approved, and once recorded, will correct and close the
violation.
If this application is denied,all business activities and equipment shall be removed from the site within 90 days
of denial by the Board of County Commissioners.

The Department of Planning Services reviewed the above referenced Use by Special Review
Landscape Plat and offers the following comments:
Section 23-3-350 addresses the Design Standards applicable to this proposed facility.
Section 23-3-350.A addresses storm water management. The Department of Public Works
reviews this standard who will make recommendations on the handling of stormwater and
release at a historic rate.
ter Section 23-3-350.B, the applicant shall delineated sufficient screened off street parking
areas. All parking and loading areas shall be screened from adjacent properties and road
rights-of-way. The applicant shall delineate an opaque visual screen on all sides of the
property to mitigate the potential negative impact and aesthetic concerns on surrounding
properties.
vibe application materials state that there will be 2-12 people utilizing the site, of which ten are
employees. Per Appendix 23-B of the Weld County Code, addresses the number of off-street
parking spaces required, 1 spaces for each employee shall be required.
"ie proposed shop and office building is approximately 2500 square feet on size. Per
Appendix 23-B of the Weld County Code, the number of off-street parking spaces required, 1
spaces for every three employees but in no event less than 1 spaces for every 1000 feet of
space is required. At a minimum, four (4) spaces are required for the office structure in addition
to the employee parking. The plan does not delineate parking spaces. All on-site parking shall
meet the requirements of the Appendix 23-A and Appendix 23-B of the Weld County Code.
"Fhe applicant shall delineate curb stops for the parking spaces shown on the USR plat. One
curb stop for each space is the standard. However, one curb stop centered over two parking
spaces is acceptable. Contact this office with any questions.
b8ection 23-3-350.C addresses Loading Areas. A designated loading area is not required for
this application.
erection 23-3-350.D provides for adequate street access. The applicant shall demonstrate a
safe and approved access. Points of ingress and egress to this parcel shall be clearly
identified. Appropriate language shall be included on the plat delineating the access to this
parcel.
v he internal circulation within the service yard and property is unclear. Future drawings shall
delineate the proposed circulation pattern throughout the property, including the proposed
circulation within the screened service yard.
Section 23-3-350.E addresses acceleration and deceleration lanes. If required, the Department
of Public Works will address this issue.
Section 23-3-350.F addresses the setback and offsets for structures from the future right-of-
way line. For this case, the setback is twenty (20) feet from the County Road 45 and the offset
is one foot for every three feet of building height or five feet whichever is greater.
Section 23-3-350.G addresses the Required Landscape areas. Section 23-3-350.G.1 states
"No more than eighty-five percent (85%) of the total area of a Lot shall be covered. Land shall
not be deemed covered if it is used for growing grass, shrubs, trees, plants or flowers or if
covered by decorative gravel or wood chips, or if it is otherwise suitably landscaped."
Further, Section 23-3-350.G.1 states "That portion of a Lot which abuts a public or private street
right-of-way shall be landscaped for a distance of ten (10) feet, measured at a right angle from
the Lot line towards the interior of the Lot. Driveways may pass through the required
landscaped areas."
The USR Plat identifies areas for landscape treatment and the questionnaire states that a
Landscape Plan will be submitted separately from the initial application submittal. Staff has not
received additional materials to review, therefore staff requests, that at a minimum, the
applicant shall submit a plant material list that delineates the proposed and existing plant
material and other landscape treatment areas for review and approval with the Landscape and
Screening Plan prior to recording the USR Plat.
Living landscape materials as indicated on the Approved Landscape Plan shall be maintained
at all times. Dead or diseased plant materials shall be replaced with materials of similar
quantity and quality at the earliest possible time.
The applicant shall demonstrate how the proposed plant material will be watered, thus ensuring
adequate growth and established of the feeder root system. Further, the applicant shall provide
evidence that tap from Central Weld County Water District is able to provide irrigation water for
this site. Evidence of such shall be submitted to this office prior to recording the USR plat.
Section 23-3-350.H addresses the issue of trash collection areas. Areas used for storage or
trash collection shall be screened from adjacent public rights-of-way and adjacent properties.
These areas shall be designed and used in a manner that will prevent wind or animal
scattered trash. The application materials have not delineated this structure on the preliminary
USR Plat.
Section 23-3-350 I and Section 23-3-350. J addresses the water and sewage disposal for the
site. The application materials state water is to be provided by Central Weld County Water
District and disposal of household wastes will be via an engineered ISDS system. The
applicant shall provide evidence that the tap is permitted for a commercial use. The
Department of Public Health and Environment will address additional requirements as
warranted.
Section 23-3-360 addresses operation standards. The applicant shall address the issue of
noise, air quality, water quality, radiation and radioactive material, heat light, and property
maintenance.
Section 23-3-360.A addresses noise. The Department of Public Health and Environment will
regulate the maximum permissible noise levels allowed for this facility. Further, the application
materials propose that the hours of operation be from 6:00 am to 10:00 pm daily. Given the
location of this facility in a rural area with surrounding residential properties, the applicant shall
limit their operation to daylight hours only, except in the case of public or private emergency or
to make necessary repairs to equipment. Hours of operation may be extended with specific
permission from the Weld County Board of County Commissioners. This restriction shall not
apply to operation of administrative and executive offices or repair and maintenance facilities
located on the property.
Section 23-3-360.F addresses the issue of on-site lighting, including security lighting if
applicable, this section.states "any lighting ... shall be designed, located and operated in such a
manner as to meet the following standards: sources of light shall be shielded so that beams or
rays of light will not shine directly onto adjacent properties...."
Section 23-3-360.G addresses property maintenance. Should noxious weeds exist on the
property or become established as a result of the proposed development the applicant/
landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15,
Articles I and II of the Weld County Code.
All other operation standards will be addressed by other referral agencies as warranted.
The applicant has not delineated any on-site sign. If an on-site sign is desired, the signs shall
adhere to Section 23-4-90.A and .B of the Weld County Code. One identification sign per
principal use shall be allowed, provided that the sign does not exceed sixteen (16) square feet

Landscape/Site Plat. All structures, including signs, on site must obtain the appropriate
building permits.
The applicant shall enter into an Improvements Agreement according to policy regarding
collateral for improvements and post adequate collateral for all transportation (access drive,
parking areas, etcetera) and non-transportation (plant materials, fencing, screening, etcetera).
The agreement and form of collateral shall be reviewed by County Staff and accepted by the
Board of County Commissioners prior to recording the USR plat.
Section 23-2-260.D addresses the requirements of the Special Review Permit Plan map. At a
minimum, the applicant shall orient all drawings with north to the top of the page. The vicinity
map shall be at a scale of 1"=2000 feet, minimum, or at a scale that is required to delineated
the required information. The Special Review Permit Plan map shall be at a scale of 1"= 40
feet, or 1"= 20 feet, or at a scale that is required to delineated the required information.
The legal description for the property appears to be inaccurate. The applicant shall verify that
the legal description is accurate and place this on the Special Review Permit Plan map. The
Assessors office describes this parcel as Lot B of RE-2820; being part of the N2 NE4 Section 8,
Township 4 North, Range 64 West of the 6th P.M., Weld County.

The sheriff's office has no concerns with this Special Use Permit. The sheriff's office
would however be willing to provide a program entitled Crime Prevention through
Environmental Design to the developer. This program reduces the likelihood of criminal
activity at a specific location by"hardening" it to crime.
The Sheriffs Office lacks the ability to absorb any additional service demand without the
.-. resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.
