Dear Kim:
The Board of Directors reviewed the referral information on the above
case. The Directors have the following concerns regarding the matter:
1. The Company wants to make the new owner aware that the
Company requires an agreement and payment of crossing fees for anything
across the ditch. The crossing must be done in accordance with Company
specifications.
2. The owner will not be permitted to use the ditch right-of-way for an
entrance.
3. No pumping is allowed out of the ditch.
4. The new owner should be made aware that under the Company's
bylaws only the stockholder of record can call for Platte Valley Irrigation
Company water.

The Enviromental Health Division would like to request that a change be made to Development
Standard #8. We would like to change the words "Light Industrial"to "Industrial".
This has been discussed with Tim Clancy, Attorney and Joe Kuchinski, Asset Manager for Duke
Energy and they are in agreement with the change.
