RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST THEO AND HELEN SUSURAS, AND WESTERN SKY
HOMEBUILDERS, LLC FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,Theo and Helen Susuras, and Western Sky Homebuilders, LLC,VI#0300195,
are allegedly in violation of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 9th day of March, 2004, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Leslie Martinez representative for Western Sky Homebuilders, LLC, was
present at said hearing, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until April 9, 2004, to allow adequate time for the property owners to submit and
record the Amended Site Plan Review and complete the Building Permit or submit a new permit
for the office building to bring the subject property into compliance and for an inspection of the
property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0300195 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Theo and Helen Susuras, and Western Sky Homebuilders, LLC to
remedy the violation of the Weld County Code, and any other persons occupying the properties,
any persons claiming an interest in the properties, and any persons acting in active concert with
the identified parties, with an instruction for delay of action upon such referral until April 9, 2004,
to allow adequate time for the property owners to submit and record the Amended Site Plan Review
and complete the Building Permit or submit a new permit for the office building to bring the subject
property into compliance.

Currently the property is in violation of Chapter 23, Article 111(3), Division 3 of Sections 23-3-230,

REMEDY
To bring the property into compliance with the Weld County Code, the Amended Site Plan Review
(AmSPR-287) shall be completed and the plat shall be recorded. Additionally, if the "office" building
permit(PRS-023001) is not completed by March 15, 2004, it will be expired. At that time a new building
permit and appropriate fees shall be completed and submitted to the Department of Building Inspections.
RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
Office for immediate legal action.

The property referenced above remains in'violation of the Weld County Code. I have scheduled a
meeting with the Board of County Commissioners on March 9, 2004, at 10:00 a.m., to consider the
violations occurring on the property. The above mentioned property remains in violation of the
following Section(s) of the Weld County Code:
Chapter 23, Article 111(3), Div 3 "Commercial Zone Districts"
Section 23-3-230 "C-3 (Business Commercial) Zone District."
Section 23-3-230.B "Uses allowed by right."
Section 23-3-230.C "Accessory uses."
Section 23-3-230.D "Uses by special review."
Section 23-3-230.E "Site Plan Review Required."
Chapter 29, Article V11(7) "Mobile. Manufactured or Factory-Built Home Permits"
Section 29-7-10 "Permit required."
Section 29-7-90 "Investigation fee."
Section 29-7-130 "Certificate of occupancy."
To bring the property into compliance:
As we have previously discussed, an amended Site Plan Review (AmSPR-287)
application was received and approved with conditions of approval on March 11,2002.
However, our records indicate that a plat map still has not been recorded. Prior to
recording the plat map, all of the conditions of approval shall be completed. For
questions, please speak with Kim Ogle, Planner at (970)353-6100, Ext. 3540.
Additionally, our records indicate that a building permit(PRS-023001)was obtained,but
as well has not been completed. The last documented inspection was conducted on
• October 4, 2002. Since one of the conditions prior to the Certificate of Occupancy is

completing the Site Plan Review process and recording the plat, there should be no
reason that the other inspections would not be completed. As a result, if by
March 5,2004 all of the inspections,with the exception of the Certificate of Occupancy,
have not been completed this permit will be expired. The expiration of this permit will
have several consequences:
1.)The building could be 'red tagged' as unsafe.
2.) A new application and associated fees will be required.
3.) A"road impact" fee may now be instituted.
This meeting will take place in the County Commissioners' Hearing Room, First Floor, Weld County
Centennial Center,915 10th Street,Greeley, Colorado. It is recommended that you or a representative
be in attendance to answer any questions the Board of County Commissioners might have about the
violations.
Please be advised that I will be taking video and/or pictures from the road or adjacent properties the
business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Our
records indicate that you were made aware of the nature of the violation including the action necessary
to correct the violation, and that you were given sufficient time to remedy this violation. If you have any

Dear Ms. Salzman:
In response to the above-referenced letter sent to Western Sky Homebuilders (and Mr. and Mrs.
Theo Susuras), this letter is being sent to you to document my assurance that all zoning
violations cited are being addressed and in process of being rectified. Platinum Home¢ and
David Burke were the previous tenants who were in initial non-compliance with the cited
violations, Western Sky Homebuilders are new tenants since spring of 2003 and were not
notified of these zoning violations until your initial letter to Western Sky Homebuilders dated
October 30, 2003, Therefore, we have not had sufficient time yet to complete all reqttired
improvements to bring the property at 10601 1-25 Frontage Road West, Longmont Ca 80504
into compliance with Weld County Code. i
We are herein requesting that you give us additional time to complete all zoning requui�rements so
we can bring this property into compliance with Weld County Code. Please be assured that we
are in process of completing all listed requirements.
I did meet with someone in the Planning Department to discuss these issues in November 2003,
which I hope also demonstrates my intentions and assurances to you that these issueslare in
process of being completed to Weld County's approval. We do, however, need additional time
to get everything completed.

It has come to the attention of the Department of Building Inspection that a building permit for a 28 X 66
manufactured home to be used as a sales office at 10601 1-25 Frontage Road was issued on February 6,
2002. According to our records, all required inspections have not been completed. Failure to schedule
inspections within 10 days from the date of this letter will result in a violation notice.

This site plan review is approved h .1 the attached conditions:
1. Prior to recording the Site Plan Review plat, the applicant shall address the following to the
Department of Planning Services' satisfaction:
a. The plat shall be amended to delineate the following:
1) The plat shall be drawn to a known scale, preferably one inch equals twenty feet
(1" = 20'). (Department of Planning Services)
2) Appropriate landscaping and buffering in accordance with Section 26-2-70 of the
Weld County Code. Further, berming and shrub or tree planting shall be used to
screen parking lots from view of the roadway. Berms can vary in height depending
on location and proximity of existing trees. Berms shall have smooth transitions from
the top of the curb to the setback line so as to not create snow traps, with allowances
made for placement of the sidewalk. Grading of berms shall not be lumpy or abrupt.
See Appendix 26-H of the Weld County Ccde. (Department of Planning Services)
3) The applicant shall place additional "plant material" screening to mitigate the impacts
of the facades and parking area from the adjacent property. Location of "plant
material" screening shall be parallel to the property line between the parking area,
access drive lanes and the property line. The planting area shall be a minimum of
ten (10) feet in width, running the entire length of the property line. At least seventy-
five percent (75%) of the length of the frontage of the parking lot must be effectively
screened. (Department of Planning Services)
4) A minimum of five percent (5%) of the parking area shall be landscaped exclusive of
setback areas. Trees planted in parking areas should be either in bays or planting
islands of at least five(5)feet by five (5) feet. Trees should be distributed throughout
the parking area, however, they shall be placed so that they do not obstruct visibility
for cars and pedestrians. See Appendix 26-J of the Weld County Code. (Department

Loading, service or storage areas must be screened with an opaque screen that is
an integral part of the building architecture. Chain link fencing with slats or pallets are
not an acceptable screening material. Plant material shall be used to soften the
appearance of the screen. (Department of Planning Services)
6) The major roadway corridors within the MUD area are I-25, State Highway 119, State
Highway 66 and Weld County Road 1. These roadways play an important role in the
function and image of the MUD area. Plantings along road rights-of-way shall be
integrated with the rest of the site, (Department of Planning Services)
7) That portion of a lot in any zone district which abuts a public or private road right-of-
way shall be landscaped with a minimum two-and-one-half-inch caliper shade tree or
six-foot minimum height coniferous tree at a distance of ten (10) feet, measured at
a right angle from the lot line towards the interior of the lot, for every forty (40) linear
feet of street frontage. Trees may be grouped with a maximum distance of one
hundred (100) feet between trees or groupings, with exceptions made at entrance

8) A minimum landscape setback along and their subsequent frontage roads shall be
fifty(50)feet measured from the existing or planned future richt-of-way. (Department

by planting trees and shrubs in layered beds (two [2] or more rows of plant material
rather than a single row). A mix of coniferous and deciduous trees and shrubs shall

10) Applicants adjacent to 1-25 shall construct a berm along 1-25 with maximum 5:1 side
slopes to a height sufficient to screen ground plane development (parking lots,
storage areas or other similar site elements) as far as one hundred eighty (180) feet
from the right-of-way line (fifty [50]feet of landscape setback plus one hundred thirty
[130] feet of site development). The maximum height berm required shall be six (6)
feet above the existing elevation in the location of the berm. If needed, additional
height beyond that which can be achieved with a six-foot-high berm shall be achieved
through dense landscape plantings. Plantings on top of berms shall be designed so
as to not create snow traps. A berm may not be required if the subject property is
elevated above the roadway and it can be demonstrated that views into the site will
not be possible for a distance of one hundred eighty (180) feet. Required
landscaping and screening within the landscape setback and other portions of the
property shall be governed by the landscape standards contained within this Chapter
and any other more restrictive requirements contained in Chapters 23 and 24 of the
Weld County Code. (Department of Planning Services)
11) There shall be a minimum twenty-foot-wide landscape setback measured from the
existing or planned future right-of-way to any parking lot, fencing, storage area or
structure. Required landscaping and screening within the landscape setback and
other portions of the property shall be governed by the landscape standards
contained within this Chapter and any other more restrictive requirements contained
in Chapters 23 and 24 of the Weld County Code. Appendices 26-M through 26-P
illustrate the proposed character, berming and landscape setbacks for the I-25

12) Whenever the use of the property to be developed or redeveloped will conflict with
the use of adjoining property, there shall be an opaque planted screen between the
two (2) properties. The screen shall moderate the impact of noise, light. aesthetic
concerns and traffic. (Department of Planning Services)
13) All landscapes shall strive to maximize the use of native species. Where native
material is not appropriate for the intended use or appearance, plant species that are
regionally adapted and noninvasive shall be used. (Department of Planning Services)
14) Fescue, brome/fescue or other turf types shall be used in lieu of bluegrass where
heavy foot traffic is not anticipated. Seeding versus sodding of all turf types is _
preferred when the growing season allows for adequate germination and
establishment of the turf to sufficiently control erosion. (Department of Planning

15) Landscape areas shall be configured to maximize their interconnectivity within the
site, to natural areas and to landscape areas within existing or future adjacent
development. Small isolated islands of landscaping except as required in parking lots
and for screening along roadways shall be avoided. Open space shall be provided
where significant natural features exist. (Department of Planning Services)
16) Section 23-3-250.A.5 states "areas used for trash collection shall be screened from
public rights-of-way and all adjacent properties. These areas shall be used in a
manner that will prevent wind or animal scattered trash."
The applicar, ihall delineate the location of the trash uumpsters. Further, per the
Mountain View Fire Protection District referral, the trash dumpsters shall not be
located within five (5) feet of a building opening or within five (5) feet of combustible
walls or combustible roof eave lines. (Mountain View Fire Protection District,

17) Section 23-3-250.A.9 states"[Facilities]in the Commercial Zone District involving the
outdoor storage of vehicles, equipment, or materials when permitted, shall be
screened from public rights-of-way and all adjacent properties. (Department of

18) The number of parking spaces for the office facility shall be ten (10) spaces for
employees plus one van accessible handicapped, parking space, further, per
Appendix 23-A of the Weld County Code, parking spaces with a degree angle of 90
degrees shall be at a minimum of nine (9) feet wide by nineteen (19) feet long with
a twenty-four (24) foot wide travel aisle. Parking for customers shall be ten (10)
spaces. Each parking space shall have a fixed wheel stop and the parking area(s)
shall be striped. (Department of Planning Services)
19) This site will be required to meet all requirements of the Americans with Disabilities
Act, ADA parking spaces are twenty (20) feet in length by eight (8) feet in width with
five (5) foot aisles. One of the ADA spaces shall be van accessible with dimension
at twenty (20) feet in length by eight (8) feet in width with eight (8) foot aisles. An
accessible path will be required from the building to the public right-of-way.

20) The sight distance triangles at all points of ingress and egress shall have visual
clearance of 3.5 feet above grade at landscape plant material maturity. The
proposed site grades and Landscape Plan shall be amended to reflect this

21) The parcel borders the proposed expansion of Turner Boulevard to the south. This
is identified on Page 35 of the MUD Standards, Map 2.2, Structural Transportation
Network. Weld County Public Works is asking for a dedication of 40 feet on the rear
portion of the property. Figure 2.10 of the typical cross-section identifies 80 feet of
right-of-way. Dedication of the right-of-way in the rear of the property for a public
roadway portion is necessary. We are requesting dedication from all other
developers in the area in a uniform manner. We request that the applicant provide
40 feet of dedicated right-of-way from the center or section line of Turner Boulevard
for their half of the full build out section. The plat shall be amended to reflect this

22) The applicant shall adhere to the lighting standards, in accordance with Section 23-3-

1) In accordance with the Weld County Code, no land, building or structure shall be

In the event that a portion of the building is proposed to be leased to another party

Protection District and the Department of Planning Services for review. Based upon
the proposed use and/or impacts of the leased portion, the Department of Planning

3) There shall be no parking or staging of trucks allowed on Turner Blvd or the 1-25

14) Weld County has no plans to finance the expansion of Turner Boulevard to the south
of its current terminus. Extensions should be at the expense of development
applicants. There is no public right-of-way for Turner Boulevard south of the existing
pavement.
The owner will be responsible to build one half of the typical cross-section within the
MUD, figure 2.10, Collector/two-lane road with painted median when Turner
Boulevard is extended south and all rights-of-way are in place. This will consist of 25
feet of pavement, curb and gutter, and a four-foot sidewalk. A Road Improvements
Agreement will be required. The County shall provide the final street grade for the
expansion of Turner Boulevard. The two (2) buildings (15 X 6 X 76) within the future

15) Effective December 1, 1999, Building Permits issued on the proposed Lot will be
required to adhere to the fee structure of the Southwest Weld Road Impact Program

d. The applicant shall enter into an Improvements Agreement according to policy regarding
collateral for improvements and post adequate collateral for parking, landscaping and road
requirements. The agreement and form of collateral shall be reviewed by County Staff and
accepted by the Board of County Commissioners prior to recording the plat. (Department

e. The applicant shall submit evidence to the Department of Planning Services that all
conditions and requirements as indicated in the Mountain View Fire Protection Districts letter

f. A Site Plan Review Plat shall be prepared after the Site Plan Review application is- approved.
The plat shall be submitted to the planner and be ready for recording at the Weld County
Clerk and Recorder's Office within 30 days of approval. The plat shall meet all requirements

3. Prior to the release of building permits:
a. Upon approval by the Department of Planning Services, the Site Plan Review plat shall be

b. The applicant shall submit a building permit to the Building Inspection Department for all

c. The applicant shall adhere to the requirements of the Weld County Department of Building

d. The applicant shall meet the Road Impact Fee obligation as outlined in Chapter 20, Article
II of the Weld County Code (Ordinance 211), that states, "effective December 1, 1999,
Building Permits issued on the proposed lots will be required to adhere to the fee structure

a. The applicant shall submit evidence that all conditions and requirements have been met for
