HomeMy WebLinkAbout20041706.tiff RESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI #0400101 AGAINST DONALD AND LEIGH KOLDEWAY FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,Donald and Leigh Koldeway,VI#0400101, are allegedly in violation of the Weld County Code, and WHEREAS,despite efforts by the Planning staff to resolve said matter,the violation has not been corrected, and WHEREAS, on the 22nd day of June, 2004, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Donald and Leigh Koldeway, property owners were present at said hearing,and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation back to the Department of Planning Services for further consideration. Don and Leigh Koldeway 10565 WCR 7 Longmont, CO. 80504 June 22, 2004 Board of County Commissioners Dear Sirs: The first Building Permit, BCS020167, was issued on May 13, 2002. All original conditions were met at that time. Due to an unforeseen hardship, we stopped work on the project and were forced to ask for a refund on the permit. We received $622.20 of the original $1,232.59 paid. We asked to have the original building permit reinstated on November 5, 2002. We received a copy of a letter written to Planner Kim Ogle from Dennis Renley, Plans Examiner for the Department of Building Inspection. A copy of this letter has been submitted for your review today. This letter states in part "the submitted stamped as built indicates compliance with requirements for Areas of Special Flood I lazard". We also received a copy of a memorandum sent to Ms. Ogle from Donald Carroll. Engineering Administrator with the Weld County Public Works Department. A copy of this memo has also been submitted to you today. This memo states. "The Weld County Public Works Department recommends approval of this application". Subsequently, however, the Planning Department asked us to apply for a new Flood Hazards Permit. We did this and paid an associated fee of$180.00. We then received an Administrative Review of the Flood Hazard Permit. We have also included a copy of this review in the submitted papers today. This review includes an additional nine conditions that must he met before a new building permit is issued. These conditions include further requirements involving the existing septic system. Item #5 states "An I.S.D.S. evaluation and inspection is required for commercial facilities. served by an individual sewage disposal system—" The property in question is our residence and is not a commercial facility. We do not see the necessity for any inspection or modification to the system as the Weld County I lealth Department approved the existing septic system under the origdnal permit BCS020167. This review also includes a condition that applies to existing structures. Item #8 would pertain to buildings on our property that have nothing to do with the new construction. We are unclear as to why the Planning Department requested an amended Flood Hazards Permit when building permit 13CS020167 was approved under the origin/Flood Hazards Permit. We are also uncertain why we must adhere to nine new conditions when a// original conditions were met at the time that the first building permit was issued. In addition, the Plans Examiner stated that we are already "in compliance" and the Public Works Department "recommends approval" of our application. ©CHISIT I dl � 1 • �o s We regret that circumstances beyond our control required that we suspend the original permit. We ask today. as we did in November of 2002, to have the origin/building permit t3CS020167 reinstated. We understand that all outstanding fees associated with the original permit are due and payable and we are more than happy to do so. Our comments and { requirements are as follows: - COMMENTS: WCR 7 is designated on the I-25 Mixed Use Development Area Structural Plan May 2.2, Structural Transportation Network, as a four-lane arterial road, which requires 100-foot right-of- way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. is REQUIREMENTS: The Weld County Public Works Department recommends approval of this application. The applicant shall utilize the existing residential access to this parcel,and no additional accesses shall be granted. The installation of any septic system within the 100-year flood plain shall comply with the Weld County I.S.D.S.flood plain policy(attached). In accordance with the Colorado I.S.D.S.Regulations, no septic systems shall be installed within the floodway. It has recently been determined that the septic system(s)serving this facility may be in the 100-year flood plain. Verification of the location of the septic system(s)with regard to the 100-year flood plain elevation is required. If the septic system(s) are found to indeed be in the 100-year flood plain, they must comply with the Weld County I.S.D.S policy. 5. The additional load to the existing septic system(s)will require an I.S.D.S.evaluation,and according to Policy No 2000-012,which states in part"An I.S.D.S. evaluation and inspection is required for commercial facilities,served by an individual sewage disposal system,where a building permit has been applied that will result in increased hydraulic flows to the system. The evaluation and inspection must be performed by a registered professional engineer."The additional hydraulic flow to the system(s) may also require permitting from the State of Colorado. 6. Installation of utilities shall comply with the conditions listed in the Flood Hazard Development Permit Certificate. 7. Construction shall comply with all requirements/conditions of the Weld County Building Code. 8. All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. 9.
