HomeMy WebLinkAbout20040381.tiff RESOLUTION RE: AUTHORIZATION FOR ABATEMENT OF DANGEROUS BUILDING AT THE WINDSOR MEAT PACKING PLANT -JESSE RODRIGUEZ, DBA JACKES, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Department of Building Inspection informed the Board that Jesse Rodriguez, dba Jackes, LLC,has a building on his property, known as the Windsor Meat Packing Plant,which is considered to be dangerous to persons under Section 302 of the 1997 Uniform Code for the Abatement of Dangerous Buildings, as adopted by Chapter 29 of the Weld County Code, and WHEREAS,said property is described as 31665 Weld County Road 17,Windsor,Colorado 80550; being further described as part of the NW1/4 NE1/4 of Section 29, Township 6 North, Range 67 West of the 6th P.M., Weld County, Colorado, and WHEREAS,the Board of County Commissioners held a public hearing on the 2nd day of February,2004,for the purpose of hearing the testimony regarding this matter,at which time Jesse Rodriguez, dba Jackes, LLC, was neither present nor represented, and WHEREAS,the Board deemed it advisable to continue this matter to February 16,2004,at 9:00 a.m.,in order to receive a report regarding the amount of asbestos present in said building,and WHEREAS, with February 16, 2004, being a holiday, on February 16, 2004, the Board deemed it advisable to continue this matter to March 15, 2004, and WHEREAS,on March 15,2004,after hearing all of the testimony and statements of those present and the recommendation of staff, the Board deemed it advisable to authorize the Department of Planning Services to proceed with the demolition of the buildings at the above location and to remove the junk and debris from the property; however, leaving the concrete foundations since they do not constitute a danger to the public, and that the final costs of such abatement work become a lien on the subject real property, pursuant to Section 29-2-60.M of the Weld County Code (adding Section 801.2.1 to the Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition), and WHEREAS, staff has obtained a bid from David Droegemueller of Agtrack, Inc., dated March 12, 2003, in the amount of$32,000.00,which amounts were reconfirmed by telephone on January9,2004,with an additional cost estimated not to exceed$10,000,to accomplish the project. RECOMMENDATION The Department of Planning Services recommends that the Board of County Commissioners authorize the Building Official to proceed with the demolition of the buildings at this location and have all junk and debris removed from the property, but not remove the concrete foundations as the foundations would not constitute a danger to the public. A bid has been received from David Droegemueller of Agtrack, Inc., in the amount of$32,000.00 to do this work. In addition, Mr. Droegemueller quoted an additional $11,500.00 to remove all concrete foundations. The original bid was received on March 12, 2003 and the bid amounts were reconfirmed by telephone on January 9, 2004. The Department of Public Works is not equipped to accomplish this work. CASE SUMMARY October 16, 2002 Received letter from Jerry Ward, Fire chief, declaring the building an unsafe building per the 1997 Uniform Fire Code. 2004-0381 Page 2. November 4, 2002 Notice and Order sent to Jackes, LLC by certified mail. November 18, 2002 Received certified mail receipt signed by Jesse Rodriguez. December 12, 2002 Phone call from Jeff Reif to Danny Casas, Jesse Rodriguez's son. Danny expressed willingness to comply with Notice and Order. March 4, 2003 Phone call from Doug Anderson, Anderson Construction. Asked what must be done to secure the building. March 11, 2003 Jeff Reif met Dave Droegueller at property to discuss bid to demolish the building. While there, Danny Casas arrived and discussed securing the building against entry, removing combustible materials and hiring a security company to provide security inspections nightly. March 12, 2003 Received bid to demolish the building from Dave Droegueller. March 14, 2003 Worksession with the Board of County Commissioners to discuss the agreement with the property owners to secure the building and maintain it against unauthorized entry. The Board supported the agreement. May 21, 2003 Site inspection with Jesse Rodriguez to verify that all conditions of the agreement to secure the building were accomplished. September 10, 2003 Phone call from Jerry Ward, Fire Chief, reporting that the building was being broken into again. Jeff Reif conducted site inspection to verify breach of security measures. Agritrack INC will remove building to the concrete floor level leaving the floor and foundations. The main structure is approximately Soft. x 140ft. for a total of 11,200 Sq. ft. The holding pens and block walls will be removed along with downed trees, cooler doors and discarded equipment from the original packing plant. Agritrack INC. will open up the four drainage manholes and backfill these to ensure public safety as discussed with Mr. Jeff Reif on our walk through. Agritrack INC. will acquire permits from Weld County and from the Colorado State Health Department. Agritrack INC. will not be responsible, or held liable for, the removal / disposal of asbestos or any other hazardous materials. Obtaining the necessary signatures indicating an asbestos / hazardous material free work site will become the responsibility of the owner or that of Weld County. This will need to be accomplished in order to obtain the necessary permits. Agritrack INC. will complete this work in an efficient use of time and equipment ensuring that certain materials are removed and disposed of in a proper manner. The wood debris generated from this job will be removed and hauled to the Waste Management Landfill located in Ault, CO. The steel generated form this job will be removed and hauled to Anderson's Salvage located in Greeley, CO. The concrete will be removed and disposed of legally and in accordance with State law. As you will recall, I sent a Notice and Order to you in which I ordered that the building at 31665 CR 17, Windsor, be abated. As a result of our meeting, I am willing to allow the building to be secured by installing substantial steel framed door and window guards and/or doors on all openings into the building. These guards or doors must be capable of preventing unauthorized entry into the building. The guards or doors shall be maintained to prevent unauthorized entry. In addition, all combustible materials shall be removed from the building to prevent that material from being used as a fuel source. Lastly, a private security company shall conduct regular security inspections of the premises. These security inspections shall be paid for by you. An inspection of the building shall be conducted not later than May 5, 2002, to verify that the conditions of this letter have been met. Please contact me by letter or telephone, at the number which appears in the top of this letter, to schedule this inspection. Representatives of the Building Inspection Department reserve the right to inspect the building and the premises at any reasonable time upon notification to you of our need to inspect the building in order to insure continuing compliance with the conditions of this letter. This building was originally used as a meat packing plant. At one time several years ago, the building was used as the Windsor Youth Center. Evidently the people who organized and operated the Youth Center could not find anyone to continue to operate it and the building has been vacant for several years. The Department of Planning Services has received numerous complaints about persons, allegedly children, braking into the building and vandalizing it. Representatives from the Windsor-Severance Fire Department have complained that they have responded to several fires that were set in and around the building. I conducted a site inspection over a year ago with a Weld County Deputy, a Windsor Police Officer, and the current property time, the property owner assured me that he would completely secure the building and maintain it against unauthorized entry. Y owner. At that On October 15, 2002, Chief Jerry Ward of the Windsor-Severance Fire Department sent a letter to the Department of Planning Services. In this letter, Chief Ward stated that because of an intentionally set fire at that location and his reluctance to risk the safety of firefighters in the event of a future fire emergency, he declared the building to be an unsafe building and a nuisance as per Section 103.4.5 of the 1997 Uniform Fire Code. ulgS Chief Ward asked tat the building be abated under the 1997 Uniform Code for the Abatement of Dangerous Buildings as adopted by Weld County. I conducted another inspection of the property and noticed that there was an attempt to secure the building with chain link fence, however the fence was not installed in a way that l prevent a casual, let alone a determined attempt to enter the building by unauthorized persons. I discovered that the property was purchased by Jackes, LLC, with the intention of ntentinof renovating the property into office space for KWS Radio Station. The transmitting tower for this radio station is located on the property. I also discovered that the building is located in the floodway. I sent a Notice and to Jackes, LLC, ordering that the building be abated. Based upon the declaration by Chief Ward that the building is an unsafe building and a public nuisance, I further ordered that, since previous attempts to secure the building have been unsuccessful, and that there was little likelihood that the building could be substantially repaired or replaced due to being in the floodway, the building must be demolished. I received an estimate from Dave Droegemueller of Agritrack, Inc., for the demolition of the building and cleanup of all debris from the site. The estimate is $32,000.00 to do the demolition and cleanup not including the removal of any foundation slabs. Removal of the slabs would add $11,500.00 to the estimate. Public Works is not equipped to demolish this building. While I was at the property posting required DO NOT ENTER-UNSAFE BUILDING signs on the building on Wednesday, March 12, the property owners, Danny and Ishmael Casas and their contractor from Anderson Construction, arrived. I explained to them the reason for declaring Page 2. the building to be unsafe and why I ordered that the building be demolished. Danny Casas informed me that he wanted to cooperate with Weld County in abating this building by securing the building with welded steel guards and doors to prevent unauthorized persons from entering the building. He further offered to remove all combustible materials from the building to reduce the chance that a fire could be started in the building and to hire a security company to provide daily security checks of the property. His contractor is working with him to do this work now. The Casas family wants to preserve the building and they will pursue the possibility of obtaining a Letter of Map Amendment (LOMA) from FEMA. They may also be able to use existing LOMA or Letter of Map Revisions from nearby properties to show that this property is outside the floodway. This would enable them to obtain necessary permits to renovate the building. I am encouraged by the sincerity expressed by the property owners and their desire to resolve this problem. I am willing to amend the Notice and Order and allow the building to be secured if the property owners will secure the building as outlined above within 30 days. I would also require that all junk and debris be removed from the property and the site cleaned up. I am hesitant to cause the demolition of a building if there is any reasonable alternative. In addition, I have determined that the building is a dangerous building as defined by Section 302 of the 1997 Uniform Code for the Abatement of Dangerous Buildings. The conditions that cause the building to be declared a dangerous building are the failure to secure the building and to maintain it against entry by unauthorized persons. This building is ordered to be abated by demolishing the building and removing all debris from the site. The prior attempt to abate the building by securing it and maintaining it against entry by unauthorized persons has not been successful,therefore that remedy is no longer an option. This structure is an abandoned slaughter/packing house, south of Windsor, located across the road from the new Eastman Park. This park contains a skateboard facility and a number of soccer fields as well as a portion of the regional bike trail. You will note, in the correspondence, that on October 15, 2002 I sent a letter to Weld County and the owner of the property declaring the building "unsafe". Communications between the Weld County Building Inspection Department and the building owner indicate that an agreement was reached to secure the building. I have since been to the site (on two occasions) both resulting in the discovery that trespassers have been in the building and that the building remains unsecured. Under the Uniform Fire Code, Section 103.4.5, 1997 Edition, I again am declaring the structure unsafe and encouraging the County to revisit the conditions that were agreed upon with the owner of the property. With the activity in the area, and the remoteness of the structure it is certainly an attractive nuisance and potentially a dangerous place for our youth to be frequenting. The Fire District requests Weld County proceed with the abatement of the property, requiring the owner to demolish the building according to the Uniform Code of the Abatement of Dangerous Property. The Town completed a LOMR in this vicinity Effective Date 12/6/00 (Case No.: 99-08-352P) and the County Planning Dept was copied -so you should have a copy of the LOMR in your files - however, it did not affect the subject property, as it was located in the floodway prior to the LOMR and the LOMR still depicts the subject property in the floodway (you can call Rick Anderson in the Town's Engineering Dept with any questions about the LOMR). The Town of Windsor's floodplain regulations contain a section specific to floodways which prohibits "...fill, new construction, substantial improvements and other development unles certification by a registered professional engineer or architect is provided demonstrating that encroachments will not result in any increase in flood levels during the occurance of the base flood discharge." I do not specifically recall, but I suspect that the county's floodplain regulations contain a similar section and similar prohibitions to comply with FEMA regulations, so I can only refer you to the • county's ordinance regarding what is allowed to occur in the floodway. I received a call from Doug with Anderson Construction (970-568-9072). He was asked by Danny Casas of KVVS Radio Station, the owners of the building at 31665 CR 17, Windsor, to call me and find out what can be done with the property. I filled Doug in on the history of the building, the declaration of a Dangerous Building by the Windsor-Severance Fire Department, and my current effort to ask the Board for authorization to demolish the building and remove the debris. I told him that the building could not be remodeled or renovated because it is in the floodway, so the "repair" option for abating the building is not available. The only practical option is the demolition of the building with removal of all debris. I also talked to Doug about the possibility of having an engineer submit a Letter of Map Amendment so the building could be remodeled or rebuilt on this site. This meeting was necessitated from the building owners to try and figure out what direction they need to follow to bring the facility up to the required level of safety that is required of them at this time. I had informed them that because they cannot rebuild, remodel, or rehabilitate this structure due to the fact that it is in the floodway it would probably be in there best interest to schedule a meeting with the Weld County Planning Department or the Town of Windsor Planning Department to see exactly what each individual agencies process would be with reference to either annexing into the Town of Windsor or what it will take to satisfy Weld Counties requirements to rebuild, remodel, or rehabilitate the structure. I also suggested that they visit with a civil engineer that could possibly guide them through the process of getting the appropriate elevation drawings together and forwarding these to the next appropriate agency such as FEMA for there approval. I did however reiterate to the building owners that based on the information that was given me today that will not allow them to rebuild, remodel, or rehabilitate the facility because it is in a floodway is indeed a tough situation for them yet at the same time the building has been declared an unsafe building by Chief Ward and to continue to keep chaining and locking the gates is obviously not the solution here and that maybe they should consider demolishing the facility now since they want to build a new facility anyway. The building owner's response was that they cannot afford $40, 000 dollars for demolition costs at this time. I had informed them that they need to stay in contact with all appropriate parties as they continue to move forward with this endeavor. On Saturday October 12, 2002 the Fire District was summoned to a reported structure fire at 31665 Weld County Road 17, Windsor. This property is an old meat packing and processing plant south of Windsor along the Poudre River. As you may recall, the plant has been closed for many years and for a short period of time a portion of the structure later was used as a youth center. The property has since been abandoned and fencing was erected in an effort to keep trespassers out. The District has been to the property several times in the past few years, each time the condition of the building has deteriorated due to vandalism and neglect. The reported fire that occurred on the 12`h was an intentional fire with multiple sets inside the structure. Upon completion of the extinguishment it was again noted that it is apparent youths have been trespassing and vandalizing the property. It is my concern that if we allow this type of activity to continue, we may be faced with injuries or possibly the death of a youth. Coffman St. Longmont, CO 80501 Re: Abatement of Dangerous Building Dear Mr. Rodriguez: As we discussed by telephone last week, a building currently owned by Jackes LLC and located at 31665 WCR 17 has been deemed to be a dangerous building and ordered abated in Weld County Violation Case No. VI-0100263. A Notice and Order, dated November 24, 2003, ordering that the building be demolished by the owner was received by you on December 8, 2003. Jackes LLC did not appeal the Notice and Order within 30 days of its receipt as required by the procedures found in Chapter 29 of the Weld County Code and Chapter 5 of the 1997 Uniform Code for the Abatement of Dangerous Buildings ("Abatement Code"). Therefore, the Notice and Order became final on January 7, 2004. As of this date, the building has not yet been demolished. The issue of the demolition of the building was considered by the Board of County Commissioners of Weld County on Monday, February 2, 2004. Pursuant to Sections 701.3 and 801.1 of the Abatement Code,the Building Official may order that the demolition work be performed by a private contractor. To do so, the Building Official must first obtain approval by the Board of County Commissioners to seek bids for the work. Any costs incurred by Weld County in seeking the demolition of the building may be made a special assessment against the property. Enclosed are copies of documents which were presented to the Board on February 2, 2004. The Board continued the matter to February 18, 2004, in order to allow time for the Building Official, Jeff Reif, and Ito contact you and the Town of Windsor to engage in some discussions regarding a possible solution. I will ask the Board on February 18`" to continue the matter for another two to three weeks to allow time for continued discussions. Letter, Jesse Rodriguez February 17, 2004 Page 2 The enclosed copies include a bid for demolition of the building and removal of foundation and materials by Agritrack, Inc. Although the date of the letter from Mr. David Droegmueller, President of Agritrack is March 12, 2003, Mr. Droegmueller's bid is still good. He has bid $32,000 for the demolition and removal of the materials for the building, and $11,500 for the demolition and removal of the foundation. In addition, there will be a cost for removal of some asbestos materials. Enclosed is a report dated February 3, 2004, from RLH Engineering, Inc. regarding an asbestos inspection conducted by that company. RLH estimates that the total cost for the asbestos abatement may be as high as $10,000. Thus, the total estimated cost of the abatement may reach $53,500. This will include the demolition and removal of materials of all of the improvements, except for the radio antenna. Enclosed is a copy of the Weld County Assessor Parcel Valuation sheet for the property. Jackes LLC purchased the property in 2002 for$113,000. The Assessor's Office has the actual valuation of the property set at $108,863, being comprised of$67,793 for the land (approximately 7.86 acres in size) and $41,070 for the improvements. The listed improvements do not appear to include the radio antenna. The entire property is within the flood way for the Cache La Poudre River. As such, no building permits may issue. If the Board of County Commissioners authorizes the demolition work, the total cost will be placed as a special assessment against the entire property. This will equal an estimated $53,500 lien on property with an actual value of$67,793 that is not eligible for the issuance of building permits. If the special assessment is not paid in 2004, the property will go to tax sale. A holder of a tax sale certificate on the property could apply for a treasurer's deed three years after issuance of the certificate. The deed holder will then be able to dictate the terms upon which the radio antenna will be able to stay, if at all. The alternative we discussed is the following: It appears that the reason Jackes LLC purchased the property was for the location and maintenance of the radio antenna. A recorded exemption could be issued by the Weld County Department of Planning Services wherein a one acre tract surrounding the antenna would be Lot"A," and the remaining land of 6.86 acres (where the packing plant building sits) would be Lot"B." Jackes LLC would retain Lot A for the maintenance of the antenna, along with an access easement across Lot B. Lot B would then be donated by Jackes LLC to the Town of Windsor for a park. The benefit to Jackes LLC is that it would retain ownership of the small tract surrounding the antenna, obtain the tax benefit of the donation, and avoid having to pay the estimated $53,500 in abatement costs. The benefit to the Town of Windsor would be the receipt of donated property for park purposes. The costs of the abatement would be paid for by the Town, with some assistance from Weld County. Additionally, the administrative fees for the recorded exemption would be paid for by Weld County. Jackes LLC would be required to apply for the recorded exemption and pay for the costs of a survey and plat.
